ThepetitionerwasconvictedofattempttocommitthefirstdegreemurderofTamaraRogers,basedonashootingincidentwhichoccurredSeptember3,1991.ThetrialcourtimposedaRangeIsentenceof18years.Thiscourtaffirmedondirectappeal.Statev.RichardNelson,No.02C019211CR00251(Tenn.Crim.App.,atJackson,Oct.13,1993).Therewasnoapplicationforpermissiontoappealtothesupremecourt.  OnDecember14,1994,thepetitionerfiledthisapplicationforpostconvictionreliefalleging,amongotherthings,thathistrialcounselwasineffectiveforfailingtoadequatelycrossexaminethevictim,byfailingtosecurethepresenceofimportantdefensewitnesses,andbyneglectingtoplaceintoevidencemedicalrecordswhichwouldhavesubstantiatedapriorheadinjury.Thetrialcourtmadeextensivefindingsoffactindenyingreliefandaddressedeachallegationofdeficiencyinperformanceonthepartoftrialcounsel:8 8 [Therewas]nothingimproperorseriouslylackingwithhisattorney'scrossexaminationofthevictimattrialand...[the]petitionerhasnotshownintheproofhowanydifferentcrossexaminationinthistrialwouldhaveaffectedtheverdict....Thenextallegation...dealswithhisattorney'sfailuretosubpoena...AnnArnold,ShirleyThompson,andVeraWeeks,whichwereallsupposedtobealibiwitnesses....Thiscourtcontinuedthehearing...toallowpetitionerto...call[them]totestify....[None]ofthemwereeverproducedbythepetitionertosupporthisclaims.Instead,thepetitioner's...brother,JohnNelson,wascalled...andtestifiedthathewaswithpetitionerthenightoftheoffensewithJamesNelson[and]VeraWeeks...(incontradictiontoJamesNelson's[trial]testimonythatJohnwasnotpresent)....HealsostatedthatVeraWeeks...didnotgethomeuntil10:30P.M.thenightoftheoffense....Thereisnothingintheprooftoshowhowthetestimonyof[thethreewomen]wouldhavehelpedpetitionerattrial....JohnNelsonplacedVeraWeeksatworkat9:00P.M.,thetimeoftheoffense....[T]hemedicalrecords...wereproducedatthehearing...[and]wouldhavehurtthepetitioner's...defense.Theyshowthepetitionerwasonlyhospitalizedfortwodays,fromJuly13...untilJuly15,1991....C.T.scans...werenormal....TheserecordsindicatethathisfamilyconsideredhimbacktonormalonJuly15,morethansixweekspriortotheshooting,andthathisinjuries,ifany,werenotserious....  Inorderforthepetitionertobegrantedreliefonthebasisofineffectiveassistanceofcounsel,hemustfirstestablishthattheservicesrenderedortheadvicegivenwasbelow"therangeofcompetencedemandedofattorneysincriminalcases."Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Second,hemustshowthatthedeficiencies"actuallyhadanadverseeffectonthedefense."Stricklandv.Washington,466U.S.668,693(1984).Theremustbeareasonableprobabilitythatbutforcounsel'serrors,theresultsoftheproceedingwouldhavebeendifferent.Strickland,466U.S.at694;Bestv.State,708S.W.2d421,422(Tenn.Crim.App.1985).Shouldthepetitionerfailtoestablisheitherfactor,heisnotentitledtorelief.  Whendeterminingwhethercounsel'sperformancewasdeficient,"everyeffort[must]bemadetoeliminatethedistortingeffectsofhindsight,toreconstructthecircumstancesofcounsel'schallengedconduct,andtoevaluatetheconductfromcounsel'sperspectiveatthetime."Strickland,466U.S.at689."Thus,thefactthataparticularstrategyortacticfailedorevenhurtthedefensedoesnot,alone,supportaclaimofineffectiveassistance."Cooperv.State,847S.W.2d521,528(Tenn.Crim.App.1992).Wemustdefertotrialstrategyandtacticalchoiceswhentheyareinformedonesbaseduponadequatepreparation.Id.  Moreover,inBlackv.State,794S.W.2d752(Tenn.Crim.App.1990),thiscourtenumeratedthestandardforestablishingprejudicebycounsel'sfailuretosubpoenawitnesses.Toestablishprejudice,thepetitionermust:"(1)producethewitnessathispostconvictionhearing;(2)showthatthroughreasonableinvestigation,trialcounselcouldhavelocatedthewitness;and(3)elicitbothfavorableandmaterialtestimonyfromthewitness."Dentonv.State,945S.W.2d793,80203(Tenn.Crim.App.1996)(citingBlack,794S.W.2dat757).Thisstandardrequirespetitionerstoproducetheuncalledwitnessatthepostconvictionproceedingsothatcourtsneednotspeculateastothematerialityofthetestimonyorcredibilityofthemissingwitness.Black,794S.W.2dat758.  Onappeal,thefindingsoffactmadebythepostconvictioncourtareconclusiveandwillnotbedisturbedunlesstheevidencecontainedintherecordpreponderatesagainstthem.Rhodenv.State,816S.W.2d56,60(Tenn.Crim.App.1991);Brooksv.State,756S.W.2d288,289(Tenn.Crim.App.1988).Theburdenisonthepetitionertoshowthattheevidencepreponderatesagainstthosefindings.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).  Aftercarefullyscrutinizingthisrecord,itisourviewthattheevidencesupportstheconclusionsofthetrialcourt.Thecrossexaminationofthevictimwaswithinprofessionalguidelines.Thepetitionerfailedtodemonstratehowthewitnessesnotcalledattrialwouldhaveaidedhisdefense.Themedicalrecordswouldhavetendedtounderminethepetitioner'sclaimsabouttheseriousnessofhisheadinjury.Thuswefindnetherdeficiencyinperformancenorprejudiceinresult.
