FACTS   DeputyRustyBordenoftheBlountCountySheriffsDepartmenttestifiedthatheobservedthedefendantsvanstraddlingthewhitelineontherightsideofthehighway.Thevanwastravelingapproximatelytwentyfive(25)tothirty(30)milesperhour,whichwasbelowthepostedlimit.Whenthevanpassedthedeputy,thedefendanthada glazedlook. Basedonthevanstravelontheoutsideline,itsslowrateofspeed,andtheappearanceofthedriver,thedeputydecidedtostopthevehicletoinvestigatewhetherthedriverwasundertheinfluenceofanintoxicant.Thevanpulledintotheparkinglotofanadjacentstore.Beforethedeputycouldapproachthedefendant,thedefendantwentinside.Whenthedefendantreemerged,hegotintothebackseatofthevan,andanotherpersondrovethevan. DeputyBordensubsequentlystoppedthevan.Thedefendantwassittinginthebackseatatthistime.Thedeputytestifiedthatthedefendanthadtheodorofalcoholonhisbreath,slurredspeech,bloodshoteyes,andwasunsteadyonhisfeet.Thedefendantexplainedtotheofficerthattheyswitcheddriversbecausehe hadalittletoomuchtodrink.Thedefendantdeclinedtoperformfieldsobrietytestsortakeabloodalcoholtest.Afterrunningacheckofthedefendantslicense,thedeputydiscoveredithadbeenrevokedinTennessee.ThedefendantproducedanexpiredGeorgialicense. Thedefendanttestifiedthathehadtwo(2)beerswithbreakfastandwasnotdrivingthevanatanytimethatmorning.HealsodeniedeverhavinghisTennesseedriverslicenserevoked.Theessenceofhistestimonywasthatthedeputywas thelyingest(phonetically)humanIeverseeninmylife. InresponsetothedefendantstestimonythestaterecalledDeputyBordentoaskwhetherhewasabletoformanopinionastowhetherthedefendantwasintoxicated.Thedeputystatedhisopinionwasthatthedefendantwasintoxicatedwhenhewasarrested.  REBUTTALTESTIMONY   ThedefendantcontendshewasunfairlyprejudicedbythestatepresentingtherebuttaltestimonyofDeputyBorden.Heallegesthistestimonywasnotproperrebuttaltestimony,butratherwasarestatementofthedeputysformertestimony. Rebuttalevidenceisthatwhichtendstoexplainorcontrovertevidenceproducedbyanadverseparty.Cozzolinov.State,584S.W.2d765,768(Tenn.1979).Whethertopermitrebuttaltestimonyiswithinthesounddiscretionofthetrialcourt.Statev.Brown,795S.W.2d689,695(Tenn.Crim.App.1990).Thetrialcourtsdecisioninthisregardwillonlybereversedonappealuponashowingofaclearabuseofdiscretion.Statev.Scott,735S.W.2d825,828(Tenn.CrimApp.1987). Intheinstantcasewefindnoabuseofdiscretionbythetrialcourt.Thedefendantinhistestimonyhadspecificallydeniedbeingintoxicated.Allowingthedeputytocontradictthistestimonyinrebuttal,evenifthedeputyhadbrieflytestifiedtothesamethingduringthestatescaseinchief,wasnotanabuseofdiscretion.Thisissueiswithoutmerit.
