ÐHarrisóó,€953€S.W.2d€701,€705€(Tenn.€Crim.€App.€1996).€€Thus,€upon€review€by€an€appellate€court,Ð $X" Ðif€"any€substantial€evidence€[exists€in€the€record]€to€support€the€refusal,"€the€decision€of€the€trialÐ ô$D # Ðcourt€will€be€upheld€and€this€court€will€not€revisit€the€issue.€€òòSeeóó€€òòState€v.€Hammersleyóó,€650€S.W.2dÐ à%0!$ Ð352,€356€(Tenn.€1983).Ð Ì&"% ÐÌà  àIn€making€its€decision€to€grant€or€deny€judicial€diversion,€the€sentencing€court€must€consider:Ð ¤(ô#' Ð(a)€the€accused's€amenability€to€correction;€(b)€the€circumstances€of€the€offense;€(c)€the€accused'sÐ )à$( Ðcriminal€record;€(d)€the€accused's€social€history;€(e)€the€status€of€the€accused's€mental€and€physicalÐ |*Ì%) Ðhealth;€and€(f)€the€deterrence€value€to€the€accused€as€well€as€others.€€òòState€v.€Lewisóó,€978€S.W.2d€558,Ð h+¸&* Ð566€(Tenn.€Crim.€App.€1997),€òòperm.€to€appeal€deniedóó,€(Tenn.€1998);€òòState€v.€Bonestelóó,€871€S.W.2dÐ ° Ð163,€168€(Tenn.€Crim.€App.€1993).€€The€trial€court€should€also€consider€whether€judicial€diversionÐ œì Ðwill€serve€the€ends€of€justice€„„€the€interests€of€the€public€as€well€as€the€accused.€€òòIdóó.€€AdditionalÐ ˆØ Ðfactors€include€the€appellant's€attitude,€her€behavior€since€arrest,€her€home€environment,€current€drugÐ tÄ Ðusage,€emotional€stability,€past€employment,€general€reputation,€family€responsibilities,€and€theÐ `° Ðattitude€of€law€enforcement.€€òòLewisóó,€978€S.W.2d€at€566€(citing€òòState€v.€Washingtonóó,€866€S.W.2dÐ L œ Ð950,€951€(Tenn.€1993)).Ð 8 ˆ ÐÌà  àThe€record€in€the€present€case€reveals€that€the€youthful€appellant€has€no€prior€criminal€record.€Ð  ` ÐShe€is€pursuing€a€college€education€and€aspires€to€attend€graduate€school€and€to€obtain€a€CPAÐ ü L  Ðlicense.€€She€has€exhibited€good€behavior€since€her€arrest€and€has€maintained€suitable€employment.€Ð è 8  ÐSince€her€arrest,€her€college€grades€have€improved€to€the€point€that€she€has€made€the€Dean's€List.€Ð Ô$  ÐShe€also€voluntarily€submitted€herself€for€drug€assessment,€an€evaluation€which€revealed€no€needÐ À  Ðfor€professional€intervention.€€The€appellant€has€refrained€from€any€use€of€controlled€substancesÐ ¬ü  Ðsince€her€arrest.€The€record€further€reveals€that€the€appellant€cooperated€with€authorities€inÐ ˜è  Ðidentifying€"suppliers"€of€controlled€substances€in€the€community.€€Ð „Ô  ÐÌà  àDespite€these€factors€favoring€judicial€diversion,€the€sentencing€court€denied€the€requestÐ \¬ Ðbased€upon€the€circumstances€of€the€offense€and€the€inherently€dangerous€nature€of€controlledÐ H˜ Ðsubstances.€€The€appellant€contends€that€the€trial€court's€reliance€on€these€factors€without€consideringÐ 4„ Ðthe€numerous€positive€factors€was€error.€€Specifically,€she€argues€that€the€court€failed€to€explain€whyÐ  p Ðits€reliance€on€the€circumstances€of€the€offense€outweighed€all€other€factors.€€òòBonestelóó,€871€S.W.2dÐ  \ Ðat€168.€€Although€the€record€is€absent€any€indication€that€the€trial€court,€in€denying€judicial€diversion,Ð øH Ðconsidered€any€positive€factors€attributable€to€the€appellant,€the€trial€court€properly€"looked€behind"Ð ä4 Ðthe€plea€agreement€and€considered€the€true€nature€of€the€offenses€committed.€€òòSeeóó€€òòState€v.Ð Ð  ÐHollingsworthóó,€647€S.W.2d€937,€939€(Tenn.€1983).€€The€circumstances€of€the€offense€are€that€theÐ ¼  Ðappellant€was€a€major€participant€in€the€sale€of€an€excessive€quantity€of€illegal€substances.€€SheÐ ¨ø Ðadmitted€that€her€involvement€was€motivated€by€her€desire€to€make€money.€€We€also€find€as€justifiedÐ ”ä Ðthe€trial€court's€concern€over€the€prevalence€and€affect€of€drug€use€in€our€communities.€€Ð €Ð ÐÌà  àOur€supreme€court€has€held€that€two€of€the€factors,€circumstances€of€the€offense€andÐ X ¨ Ðdeterrence,€may€not€be€given€ð ðcontrolling€weight€unless€they€are€ððof€such€overwhelming€significanceÐ D!” Ðthat€they€[necessarily]€outweigh€all€other€factors.ðððð€€òòState€v.€Washingtonóó,€866€S.W.2d€950,€951Ð 0"€  Ð(Tenn.€1993).€€Although€the€trial€court€made€no€such€conclusion€in€its€findings,€the€overwhelmingÐ #l!
