Attrial,DeputyKingtestifiedthathecalledforassistance_after___Ԁtheoccupantsofthevan p _entered___Ԁthehouse.Becauseonlythestormdoorofthehousewasclosed,hecouldseeMs.Weeks \ asshewalkedaroundinsidethehousetalkingonthetelephone.Ashorttimelater,BlountCounty H SheriffsDepartmentDeputySteveDonald,whohadarrivedtoassist,calledthe911 4 CommunicationsCenterandaskedthedispatchertoestablishtelephonecontactwiththeoccupants  p _oftheresidence._ԀWhenDeputyKingtalkedwithMs.Weeksthroughthestormdoor,sherefusedto  \ comeoutsideandclosedthedoor.DeputyKingtestifiedthatDeputyDonaldthencontactedtheshift H supervisor,SergeantTimWilson.WhenSergeantWilsonarrivedatthescene,DeputyKingleftto 4 obtainawarrantforMs.Weeksarrest.     WhenDeputyKingarrivedwiththewarrant,SergeantWilsonknockedonthedoor,informed  theoccupantsofthehousethattheyhadawarrantforMs._Weeks_Ԁarrest,andorderedthemtoopen  thedoor.Whentherewasnoresponse,theofficerskickedinthedoor,enteredthe_residence__,_Ԁand  foundMs.Weekssitting_onthe_Ԁfloorofabedroomlookingatcompactdiscs.Thedefendantlayon l thebed.DeputyDonaldinformedMs.Weeksthatshewasunderarrest.Whensherefusedto X  cooperate,hedraggedher,kickingandscreaming,fromtheroom.Atthatpoint,DeputyKing D! noticedthedefendantrisefromthebedandwalktowardthedoorofthebedroomwithsomething 0"  inhishand.Heshouted_at_ԀDeputyKevin_Condee,whoseviewofthedoorwasobstructed,to #l!  [W]atchout,hesgotsomething,watchit.DeputyKingorderedthedefendanttostopandDeputy $X" Condeedirectedthedefendanttoshowhishands.Whenthedefendantcontinuedtoadvancetoward $D # theofficers,DeputyKingsawthatheheldabatoverhisleftshoulder.Becausethedefendantwas %0!$ advancinginan aggressivemanner,DeputyCondeeshotthedefendant.Uponinspection,Deputy &"% Kingobservedthatthebullethadgonethroughthedefendantsforearmandenteredhisabdomen. H   DeputyKevinCondee,whowasstandinginanarrowhallwaywhileDeputyDonaldremoved  p Ms.Weeksfromthebedroom,heardDeputyKingremark, [W]atchhim,hesgotsomethinginhis  \ hands,hesgotsomethinginhishands.DeputyCondee,whocouldnotseethedefendantfromhis H vantagepoint,orderedthedefendanttoshowhishands.Heexplainedthatwhenhesteppedcloser 4 tothebedroomdoor,heencounteredthedefendantholdingabaseballbatabovehisrightshoulder.   DeputyCondeetestifiedthatwhenthedefendantcontinuedtoadvance,hefiredasingleshotwhich   struckthedefendantinthearm.Thedefendantthenfellintothehallwayandthebatfelloutofhis  handsoverhisshoulder.Oncrossexamination,DeputyCondeeconcededthatthedefendantshowed  nosignsofaggressionatanytimebeforeheappearedinthedoorwaywiththebat.    DeputyStevenLynnDonald,whoissixfeetandfourinchestallandweighsoverthree X  hundredpounds,wasthefirsttoentertheresidence,followedbyDeputyCondee.Accordingto D! '#&   Thedefendanttestifiedthatonthenightoftheshooting,Ms.Weekshadpickedhimupat )$( hismothershouseanddrivenhimtoherresidence.Heclaimedthatthetwostoppedbrieflyatthe |*%) SmokyViewMarkettogetsomecigarettes,butleftupondiscoveringthatthestorewasclosed. h+&* Whileintheparkinglotofthemarket,thedefendantnoticedthatapolicecruiserwasbehindthem.  HeclaimedthathedidnotseethecruiseragainuntilitparkedbehindtheminthedrivewayofMs.  Weeksresidence.Accordingtothedefendant,Ms.Weeksgotoutofthevanand hadwordswith  theofficer.Thedefendantclaimedthatwhenhesteppedoutofthevan,theofficer gothateful,and t inresponse,thedefendantstatedhisintentiontogoinsidethehouse.Beforeenteringthehouse,the ` defendantattemptedtoremovehiscigarettesfromthevananddiscoveredthatthedoorswerelocked. L  Hetestifiedthathethenwentinsidetolieonthebed.Hestatedthathewasntworriedaboutthe 8  officerspresence,explainingthat Ifigured[Ms.Weekswould]gotojailandIdbondheroutthe $ t nextday.HetestifiedthatMs.Weeksrefusedtogooutsideandarguedwiththeofficersforalong  ` whilebeforereturningtothebedroom.  L    Thedefendantacknowledgedthatheheardtheofficersannounce, [W]erekickingyourdoor $  in.HeclaimedthathewokeMs.Weeksandinstructedhertoanswerthedoorbutshewastoo   intoxicatedtostand.HecontendedthatDeputyDonald grabbedheraroundthethroatwithhisarm,   anddrughertoherfeetanddrugheroutbackwards.Thedefendanttestifiedthatwhenhegotout   ofthebedandwalkedtowardthebedroomdoor,heheardagunshotandsawbloodcomingfromhis   arm.Afterfallingtothefloor,helookedupandsawDeputyCondee standinginthebathroomwith p hisgunuptohischest,shaking.Thedefendantinsistedthathedidnothaveabaseballbatinhis \ handsandexplainedthatthereweretwobatsonthebackporchonlybecauseMs.Weekssonplayed H baseball.Thedefendantclaimedthathehadneverseenthebattheofficersproducedattrialand 4 insistedthatthebatfoundbycrimesceneinvestigatorswasplantedbytheofficers.  p   Dr.CharlesHarlan,aforensicpathologist,testifiedonbehalfofthedefendant.Hestatedthat H asinglegunshotenteredthedefendantsrightforearmjustbelowtheelbowcrease,shatteredthe 4 ulna,andthenenteredtheabdomennearthebellybutton.AccordingtoDr.Harlan,itwouldbe   physicallyimpossibleforthedefendanttohavereceivedawoundofthatnaturewhileholdingabat   raisedoverhisshoulder.Whileconcedingthathecouldnotascertainthelocationofthedefendants  armjustbeforehewasshot,itwashisopinionthatthewoundwasconsistentwithhisbeingina  walkingmotionatthetimeoftheshot.    Thedefendantcontendsthattheevidenceisinsufficienttosupporthisconvictionforassault. X  Onappeal,ofcourse,thestateisentitledtothestrongestlegitimateviewoftheevidenceandall D! reasonableinferenceswhichmightbedrawntherefrom.Statev.Cabbage,571S.W.2d832,835 0"  (Tenn.1978).Thecredibilityofthewitnesses,theweighttobegiventheirtestimony,andthe #l! reconciliationofconflictsintheproofaremattersentrustedtothejuryasthetrieroffact.Byrgev. $X" State,575S.W.2d292,295(Tenn.Crim.App.1978).Whenthesufficiencyoftheevidenceis $D # challenged,therelevantquestioniswhether,afterreviewingtheevidenceinthelightmostfavorable %0!$ tothestate,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyonda &"% reasonabledoubt.Tenn.R.App.P.13(e);Statev.Williams,657S.W.2d405,410(Tenn.1983). '#& Questionsconcerningthecredibilityofthewitnesses,theweightandvalueoftheevidence,aswell (#' asallfactualissuesraisedbytheevidenceareresolvedbythetrieroffact.Liakasv.State,199Tenn. )$( 298,286S.W.2d856,859(1956).Becauseaverdictofguiltremovesthepresumptionofinnocence |*%) andraisesapresumptionofguilt,theconvictedcriminaldefendantbearstheburdenofshowingthat h+&* theevidencewaslegallyinsufficienttosustainaguiltyverdict.Statev.Evans,838S.W.2d185,191  (Tenn.1992).    InitiallychargedwiththeaggravatedassaultofDeputyKing,thedefendantwasconvicted t ofthelesserincludedoffenseofassault.TennesseeCodeAnnotatedsection3913101providesthat ` apersonwho [i]ntentionally,knowinglyorrecklesslycausesanothertoreasonablyfearimminent L  bodilyinjuryisguiltyofassault.Tenn.CodeAnn.3913101(a)(2). 8    Here,DeputyKingtestifiedthatthedefendantwalkedtowardtheofficersinthehallwhile  ` carryingabaseballbat.Heclaimedthathefearedthatthedefendantintendedtoinflict bodily  L  harm,andthatthedefendantcontinuedtoadvancedespitewarningstostop.Therewasalso  8  testimonythatthedefendantignoredDeputyCondeesrepeatedrequeststoshowhishands.Byits $  verdict,thejurydeterminedthatthedefendantactedinathreateningmannersufficienttocause   reasonablefearofinjuryandaccreditedatleastportionsofthestatestheory.Thatwasits   prerogative.Thiscourtmayneitherreweightheevidencenorreassessthecredibilityofthe   witnesses.
