Around11:00p.m.ontheeveningofNovember6,1995,appellantandthevictim,GlennMiller,wereleavinganexoticnightclubinKnoxCounty.Bothappellantandthevictimhadbeendrinking.Appellanttestifiedatthesentencinghearingthathedrankfourbeersduringthethreehoursthattheyspentattheclub,whilethevictimdranksubstantiallymore. /   ׀Appellantwasthedesignateddriver. 0    Astheylefttheclub,thevictimstatedthatheneededtousetherestroomandsaidthathewasgoingtourinateonapolicecarthatwasparkedintheparkinglot.Althoughappellantcautionedagainstit,thevictimwalkedtowardthepolicecar.Appellantgotintohiscarandwaitedforthevictim.Suddenly,thevictimopenedthepassengersidedoorandstartedscreamingfortheappellantto getthefoutofthere.AppellantspedoutoftheparkinglotasanofficerfromtheKnoxCountySheriffsDepartmentpursued.AppellantdrovedownAlcoaHighwayandthenturnedonSingletonStationRoad.Atsomepoint,officersfromtheBlountCountySheriffsDepartmentandtheAlcoaPoliceDepartmentjoinedthechase,whichcoveredapproximatelysixmiles.WhiledrivingonSingletonStationRoad,appellantlostcontrolofhis1986Camryonthewetroadwayandcrashedintoautilitypole.Thevictimdiedasaresultofthecrash. Althoughappellantdeniedanymemoryofthecrashorwhathappenedafterwards,policereportedthatheranfromthesceneafterthewreckandstruggledwithofficerswhenapprehended.Appellantwaslaterindictedandpledguiltytovehicularhomicidebyintoxication. 1   ׀Thepleaagreementrecommendedtheminimumeight(8)yearsentence,withthetrialcourttodecidethemannerofserviceofthesentence.Followingthesentencinghearing,thetrialcourtorderedtheappellanttoservehissentenceinthecustodyoftheDepartmentofCorrection. Appellantarguesonappealthathewasentitledtosomeformofalternativesentencingbecausethecircumstancesofhisoffensedidnotjustifyacompletedenialofprobation.HeasksthisCourttogranthimasentenceofsplitconfinement.Wedeclinetodoso. Whenadefendantchallengeshisorhersentence,wemustconductadenovoreviewoftherecord.Tenn.CodeAnn.4035401(d)(1990).Thesentenceimposedbythetrialcourtisaccompaniedbyapresumptionofcorrectnessandtheappealingpartycarriestheburdenofshowingthatthesentenceisimproper.Tenn.CodeAnn.4035401SentencingCommissionComments.Thepresumption,however,isconditioneduponanaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Becausethetrialcourtinthiscasecarefullyconsideredtherelevantprinciplesofsentencing,weafforditsdecisionthepresumptionofcorrectness. Initially,wenotethatalthoughtheappellantwaseligibleforanalternativesentence,hewasnotentitledtothepresumptioninfavorofalternativesentencingbecausehewasconvictedofaClassBfelony.Tenn.CodeAnn.4035102(6)(Supp.1995);Tenn.CodeAnn.3913213(b)(Supp.1995).However,astherecipientofaneight(8)yearsentence,appellantwasstatutorilyeligibleforprobation.Tenn.CodeAnn.4035303(Supp.1995).Whilethetrialcourtwasrequiredtoautomaticallyconsiderappellantforanalternativesentence,includingprobation,appellantboretheburdenofestablishingbothhissuitabilityandthatanalternativetoincarcerationwould subservetheendsofjusticeandthebestinterestofboththepublicandthedefendant.Statev.Dykes,803S.W.2d250,259(Tenn.Crim.App.1990)(quotingHooperv.State,297S.W.2d78,81(Tenn.1956));Statev.BradleyJoeHousewright,No.03C019705CR00195(Tenn.Crim.App.atKnoxville,December16,1997),perm.app.filed(Tenn.Feb.16,1998).Thetrialcourtfoundthatappellantfailedtocarrythatburden.Statev.Boston,938S.W.2d435,438(Tenn.Crim.App.1996). Indenyingalternativesentencing,thetrialcourtdeterminedthatconfinementwasnecessaryinordertoavoiddepreciatingtheseriousnatureoftheoffenseandthatmeasureslessrestrictivethanconfinementhadbeenappliedunsuccessfullytoappellantinthepast.SeeTenn.CodeAnn.4035103(1)(B),(C)(1990).Thetrialcourtsconclusioninthatregardissupportedbythefactualrecordbeforeus. Inordertodenyprobationbaseduponthenatureoftheoffense,thecircumstancesoftheoffensemustbeespeciallyviolent,shocking,reprehensible,offensive,orofanexaggerateddegreesoastooutweighallotherfactorsfavoringanalternativesentence.Statev.Bingham,910S.W.2d448,454(Tenn.Crim.App.1995)(citationsomitted).Inthiscase,appellanttookthewheelofhisautomobiletodrivehomeadisabledfriendwhotrustedhimfortransportation.Whileknowinglyintoxicated,appellantspedoutoftheparkinglotofthedancebarandrefusedtoyieldtopursuingpoliceofficersforsixmiles.Afterthehorrificcrash,appellantattemptedtofleethescene,demonstratingacallousindifferenceforhisinjuredfriend.Thosecircumstancesweighheavilyagainstanyfactorsthatfavoranalternativesentence. Next,asdeterminedbythetrialcourt,measureslessrestrictivethanconfinementhavebeenappliedunsuccessfullytotheappellant.Tenn.CodeAnn.4035103(1)(C)(1990).In1984,appellantbeganservingathree(3)yearprobationarysentenceforaconvictionoflarceny.Hewaslatersentencedtoanadditionalfour(4)monthsafterhefailedtoreporttohisprobationofficer.Inaddition,appellanttestifiedthathewasconvictedofD.U.I.in1986.Thecommissionoftheinstantoffenseindicatesthathewasnotrehabilitatedfollowinghispreviousconvictions.Tenn.CodeAnn.4035103(5)(1990). Furthermore,wenotethattheappellantwasreleasedonbondafterhisarrestinthepresentcaseandhesubsequentlywenttoArizona.Followingtheindictmentsonvehicularhomicide,heagreedtosubmittoTennesseeauthorities,butfailedtoreportonthescheduleddate.OveronemonthpassedbeforehewasfinallyarrestedathishomeinTucson,Arizona,andanadditionalten(10)dayspassedbeforeheagreedtowaiveextradition. 2   ׀Thetrialcourtfoundthatsuchconductwasindicativeofappellantspoorpotentialforsuccessifplacedonprobation.Weagree.
