ŠAppellant€stated€he€š šwas€staying€at€Mr.€Forrestššs€trailer€for€a€time,€ššcause€[he]€was€in€betweenŠ ü L  Šhouses.šš€€The€Appellant€did€not€pay€rent€but,€rather,€the€arrangement€was€that€he€would€š šbuy€theŠ č 8  Šfood€and€stuff€and€cook.šš€€The€Appellant€was€present€in€the€residence€when€the€search€wasŠ Ō$  Šperformed.€€Based€upon€the€foregoing€principles,€we€conclude,€contrary€to€the€ruling€of€the€trialŠ Ą šstarting€to€move€in,šš€ņņi.e.óó,€it€is€unclear€whether€Tim€Forrest€hadŠ ˆŲ Š"mutual€use€of€the€property€by€generally€having€joint€access€or€control€for€most€purposes.€.€.€.šš€Š tÄ Šat€trial.€€Furthermore,€there€is€no€other€evidence€or€testimony€which€supports€the€Stateššs€assertionŠ L œ Šthat€Tim€Forrest€resided€in€the€trailer.€€Because€the€State€has€the€burden€of€establishing€that€theŠ 8 ˆ Šsearch€was€conducted€pursuant€to€this€exception,€we€conclude€that€the€State€has€not€sufficientlyŠ $ t Šshown€that€Tim€Forrest€had€š
