OnFebruary25,2000,whileonpatrol,DeputyJohnnyBohananoftheSevierCounty ` SheriffsDepartmentspottedthestolenCadillac.Thecarwasspeedingandslidingsidewaysalong L  theroad.DeputyBohananactivatedhisemergencylightsandsirenandpursuedthecar.The 8  CadillacfledfromtheDeputy,andashegavechase,hecouldseethatitdidnothavealicenseplate. $ t AstheCadillaccrossedabridge,DeputyBohananobservedthepassengeroftheCadillac,the  ` Defendant,throwingitemsoutofthepassengerwindow.Someoftheitemsfellontothebridgeand  L  wereretrievable,whileotherswentovertherailingandwerelostinthelakebelow.Eventuallythe  8  Cadillacstruckastopsignandaconcretepoleandcametoanabruptstop. $    AfterthecarstoppedandDeputyBohananhaditstwooccupantsoutofthevehicle,heasked   themtowhomthecarbelonged.TheDefendantrepliedthat theyhadjustpurchasedthecarfora   hundreddollars.WhenotherofficersarrivedtoassistDeputyBohanan,hewentbacktothebridge   andcollectedtheitemsthattheDefendanthadthrownoutofthecarduringthepursuit.TheDeputy p recoveredthreeglovesandabrokenbeerbottle.Twoofthegloveswereapairofcamouflage \ gloves,andoneofthegloveswasbrown.TheotherbrownglovewaslaterfoundintheDefendants H pocket. 4   AninspectionofthestolenCadillacrevealedthatthedriverssidewindowwasbrokenand  \ shardsofglassremainedinthedriversfloorboard,thesteeringcolumnwasbrokenandadevicehad H beeninsertedtoturntheignition,andpartsofthedashboardhadbeenremoved.Later,atthepolice 4 station,DeputyBohananquestionedtheDefendantaboutthestolenvehicle.TheDefendanttoldthe   Deputythat somebodyhadjustleftthevehiclethereandthathedidntbuythevehicle.The   Defendanttoldyetanotherstoryattrial.Hetestifiedthathewasatafriendshouseataround2:00  a.m.whenathirdpersondroveupinthestolenCadillac.TheDefendantandhisfrienddecidedto  getinthecarand justridearound.WhentheDefendantgotinthepassengersideofthecar,he  noticedthebrokensteeringcolumn,thebrokenwindow,andtheglassinthefloorboard.When l askedoncrossexaminationbytheprosecutingattorney, Yougotinastolencarandyouknewit X  wasstolenonceyougotintoit,isthatwhatyouretellingtheJury?,theDefendantreplied, Yes, D! sir. 0"    ThesoleissueraisedbytheDefendantonappealiswhetherthereissufficientevidenceto $X" convicthimoftheftofproperty.TennesseeRuleofAppellateProcedure13(e)prescribesthat $D #  [f]indingsofguiltincriminalactionswhetherbythetrialcourtorjuryshallbesetasideifthe %0!$ evidenceisinsufficienttosupportthefindingsbythetrieroffactofguiltbeyondareasonable &"% doubt.Evidenceissufficientif,afterreviewingtheevidenceinthelightmostfavorabletothe '#& prosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyond (#' areasonabledoubt.SeeJacksonv.Virginia,443U.S.307,319(1979);Statev.Smith,24S.W.3d )$( 274,278(Tenn.2000).Inaddition,becauseconvictionbyatrieroffactdestroysthepresumption |*%) ofinnocenceandimposesapresumptionofguilt,aconvictedcriminaldefendantbearstheburden h+&* ofshowingthattheevidencewasinsufficient.SeeMcBeev.State,372S.W.2d173,176(Tenn.  1963);seealsoStatev.Buggs,995S.W.2d102,10506(Tenn.1999);Statev.Evans,838S.W.2d  185,191(Tenn.1992);Statev.Tuggle,639S.W.2d913,914(Tenn.1982). ThequestionthenbecomeswhethertherewassufficientevidencethattheDefendant,asa N passengerinthestolenautomobile,knowinglyobtainedorexercisedcontrolovertheproperty.In : Statev.MackSamuelStokes,No.M199902252CCAR3CD,2000Tenn.Crim.App.LEXIS460, &v at*67(Nashville,June9,2000),thisCourtaffirmedtheconvictionofthedefendant,apassenger  b inastolenvehicle,fortheftofthevehicle.Inthatcase,thedefendantwasridinginthepassenger  N seatofastolenautomobilewhenitwasstoppedbythepolice.Hegavethepoliceofficerapieceof !: paperthathesubmittedwasthebillofsaleandassertedownershipofthevehicle.ThisCourtheld "&  thatarationaljurorcouldfindbeyondareasonabledoubtthatthedefendantknowinglyexercised #! controloverthestolenvehicle. $"   Theinstantcaseisquitesimilar.Thejurywaspresentedwithtestimonythatafterabrief ,'|"$ chaseofthestolenCadillacbytheSevierCountySheriffsDepartment,duringwhichtheDefendant (h#% threwvariousitemsoutthepassengersidewindowofthevehicle,theDefendantvolunteeredthat )T$& heandhisfriendhadboughtthecarforonehundreddollars.Hechangedhisstoryatthepolice )@%' station,sayingthatsomeonehadapparentlyabandonedthevehicle.Ms.Dirl,theownerofthestolen *,&( car,testifiedthatwhensherecoveredthecar,thedriverssidewindow hadbeensmashedout, +')  [t]heCDplayerhadbeentakenoutofthedashboard, [t]hebackseatofthecarhadbeenpulled  outfromwheretheyhadwentandcutthespeakersoutofthecar, [t]hesteeringcolumnwas  messedupandalsothe[glove]boxhadbeentornoff....    WeconcludethatitwasreasonableforthejurytofindthattheDefendantdidexercisecontrol  V overthestolenautomobile.ThejurywasentitledtocreditthefactthattheDefendantwasthrowing  B itemsoutofthecarasheandhisfriendfledfromDeputyBohanan,aswellastheinitialstatement  . thattheDefendantmadetotheDeputy,thathewas,atleast,thepartialownerofthecar.Obviously,   theDefendantdidnotactalone,butratherinconcertwithothers.Nevertheless,webelievetheproof   showsthathewasexercisingcontroloverthevehicleatthetimeofhisarrest.
