STATUTEOFLIMITATIONS    PetitionerarguesthatheisentitledtoapostconvictionhearingbecausethenewPostConvictionProcedureActextendsthefilingperiodtoMay10,1996.UnderthenewPostConvictionProcedureAct,thestatuteoflimitationsforpostconvictionreliefisreducedtoone(1)year.Tenn.CodeAnn.4030202(Supp.1996).TheActalsoprovidesforaone(1)yeargraceperiodfromMay10,1995,tofileapetitionorreopenapetitionforpostconvictionrelief.However,thegraceperioddoesnotapplyinthisinstancebecausepostconvictionreliefwasalreadybarredbythestatuteoflimitationswhenthelegislationwasenacted.Sincethepetitionerdidnotappealhisoriginalconviction,thejudgmentbecamefinalin1991.HisclaimwasinexistenceandexpiredpriortoenactmentofthenewPostϜConvictionProcedureAct.Tenn.CodeAnn.4030102(repealedby1995Tenn.Pub.Act207,1).
