H,',  4-(- _  Thenextday,November12,1988,Perkinsreturnedtoherhomefromworkandfellasleep  onhercouch.Sheawoketothedefendant'sknockingonherdoor.Perkinstestifiedsheallowedthe  defendanttoenterherhousewhenhestatedthathewantedtoapologizeforparkinginherdriveway.  Perkinstestifiedthedefendantthenattemptedtoplacehishandsonherbreastsandvagina.When t shetoldhimtoleaveheralone,helaughed. `   Perkinstestifiedthedefendantpushedherontothecouchand jabbedhisfingersintoher 8  vagina.Shestatedsheunsuccessfullyattemptedtofighthim,butthedefendantwas thrusting[his $ t fingers]hard.Perkinsthenhitthedefendantovertheheadwithanashtray;however,thedefendant  ` didnotstop.Thedefendantgrabbedherarmandputitaroundherhead.Perkinsunsuccessfully  L  attemptedtochokethedefendantwiththecordtohercurlingiron.Thedefendantcontinuedtolaugh  8  throughouttheincident. $    Afterthedefendantleftherhouse,PerkinscalledHannah,whotookhertotheemergency   room.Whileattheemergencyroom,PerkinswasexaminedbyDr.CorneliaGraves.Dr.Graves   performedapelvicexaminationonPerkins,whichrevealedbloodinhervagina.Dr.Gravestestified   herfindingswereconsistentwiththoseofavictimofasexualassault. p   Thedefendant,whotestifiedattrial,deniedcommittingtheoffense.Thedefendanttestified H hedidnotseePerkinsonNovember12th;rather,hewaswithhisnephew. 4   Thedefendantwaschargedwithaggravatedrapeshortlyaftertheincident.InMay1991,on  \ thedaysetforhistrial,thedefendant,whohadpostedbail,failedtoappearincourt.Thedefendant H wasfoundinFloridain2001andwasextraditedbacktoDavidsonCountytostandtrial.Thejury 4 foundhimguiltyofsexualbattery,alesserincludedoffense.Thetrialcourtsentencedthedefendant   totwoyears.     SUFFICIENCYOFTHEEVIDENCE      Thedefendantcontendstheevidencewasinsufficienttosupportaconvictionforsexual X  battery.Wedisagree. D! Sexualcontactisdefinedas theintentionaltouchingofthevictimsordefendants L  intimatepartsortheintentionaltouchingoftheclothingcoveringtheimmediateareaofthevictims 8  ordefendantsintimateparts,ifthatintentionaltouchingcanreasonablybeconstruedasbeingfor $ t thepurposeofsexualarousalorgratification.Id.602(10)(repealed1989).  `   Weviewtheevidenceinalightmostfavorabletothestate.Thevictimtestifiedthatthe  8  defendantenteredherhouse,pushedherontothecouch,andpenetratedhervaginawithhisfingers. $  Thevictimsaidsheattemptedtofighthimoff;however,thedefendantcontinuedto jabhisfingers   intohervagina.Thevictimfurthertestifiedshewasinpainandexperiencedsomebleeding.We   concludethisevidencewassufficienttosupportaconvictionforsexualbattery.
