AssistantDistrictAttorneyGeneral      201PoplarAvenue,Suite301      Memphis,TN3810319470 OPINIONFILED________________________AFFIRMEDTHOMAST.WOODALL,JUDGE@ # OPINION #   ThePetitioner,AnthonyDewayneParker,appealstheorderoftheShelbyCountyCriminalCourtdismissinghisprosepetitionforpostconvictionrelief.Inthisappeal,Petitionerraisesnumerousissueswhichcancollectivelybesummarizedaschallengingthetrialcourtsrulingthatthepetitionforpostconvictionreliefistimebarred.ThePetitionersprimaryargumentisthatthePostConvictionProcedureActthatbecameeffectiveMay10,1995,giveshimanewoneyeartimeperiodinwhichtofileaPetitionforPostConvictionRelief.Afterareviewoftherecord,weaffirmthelowercourtsdenialofpostconvictionrelief. Petitionerpledguiltyandwasconvictedofthefollowingoffensesonthefollowingdates:ShootingaMissileCalculatedtoProduceBodilyHarmorDeath,convictedonMarch6,1986;RobberywithaDeadlyWeapon,convictedonAugust7,1989;UnlawfulPossessionofaSawedOffShotgun,convictedonAugust7,1989;AssaultwithIntenttoCommitRobberywithaDeadlyWeapon,convictedonAugust7,1989;andAssaulttoMurderintheFirstDegree,convictedonAugust7,1989.OnMarch5,1996,PetitionerfiledaPetitionforPostConvictionReliefandCertiorarionDirectReview.Thetrialcourtsubsequentlydismissedthepetitionasbeingbarredbythethreeyearstatuteoflimitations. Therecordsupportsthetrialcourtsfindingthatthepetitionistimebarred.InJuly1986,theTennesseeLegislatureenactedathreeyearstatuteoflimitationsonpostconvictionpetitions.Tenn.CodeAnn.4030102(repealed1995);seealsoPassarellav.State,891S.W.2d619,624(Tenn.Crim.App.),perm.toappealdenied,(Tenn.Nov.28,1994).PetitionersconvictionsandsentenceswereeffectiveonMarch6,1986andAugust7,1989,andhedidnotappealanyoftheconvictions.Underthe1986statute,Petitionerhad3yearsfromJuly1,1986,tofileacognizableclaimforpostconvictionreliefofthe1986conviction.Tenn.CodeAnn.4030102(repealed1995).Furthermore,sincePetitionerdidnotappealthe1989convictions,hehadthreeyearsfromAugust7,1989topetitionforpostconvictionrelief.SeeWarrenv.State,833S.W.2d101,102(Tenn.Crim.App.1992).ThethreeyearperiodendedonAugust7,1992.Petitionerdidnotfilehispetitionforboththe1986and1989convictionsuntilMarch5,1996,wellpastthethreeyearstatuteoflimitations.Thus,thePetitionerisbarredfromseekingpostconvictionreliefforthe1986and1989convictions. PetitionerarguesthatthenewPostConvictionProcedureAct,effectiveMay10,1995,grantsanadditionaloneyearperiod,untilMay10,1996,forhimtofileapostconvictionpetition.However,inArnoldCarterv.State,oursupremecourtheld: petitionersforwhomthestatuteoflimitationsexpiredpriortotheeffectivedateofthenewAct,i.e.,May10,1995,donothaveanadditionalyearinwhichtofilepetitionsforpostconvictionrelief.____S.W.2d_____,No.03S019612CR00117,slipop.at2(Tenn.,atKnoxville,Sept.8,1997).
