CodeAnn.4028123.TheDefendantreliesupondecisionsofthisCourtand 8^/0 ofoursupremecourtwhichholdthatbecausethelawrequiresthetrialcourttoimposeaconsecutivesentenceonanydefendantconvictedofafelonycommittedwhileonparolefromastateprison,jail,orworkhouse,atrialcourtiswithoutjurisdictionorauthoritytoenterajudgmentagainstadefendantforaconcurrentsentence.SeeArcherv.State,851S.W.2d157,at񛀜163(Tenn.1993);Hendersonv.Stateexrel.   Lance,419S.W.2d176(Tenn.1967);Taylorv.Morgan,909S.W.2d17,20   (Tenn.Crim.App.1995). ` WeconcludethattheDefendantsargumentslackmerit.Initially,wenotethatthejudgmentssentencingtheDefendanttotheeightyeartermsforburglaryprovidethattheburglarysentencesshallbeservedconcurrentwitheachotherandconcurrentwithasentencefromthestateofTexas.ThejudgmentsmakenoreferencetoanypriorTennesseesentences.TherecordonappealcontainsnoevidenceconcerningapriorTennesseesentenceotherthantheDefendantsunsupportedallegationsinhispetition. ` Secondly,wenotethatasentenceforafelonycommittedwhiletheDefendantwasonparoleforanotherfelonyshallbedeemedtorunconsecutivetothepriorsentencebeingservedonparolewhetherthejudgmentexplicitlysoprovidesornot.Tenn.R.Crim.P.32(c)(3)(A).BasedontheallegationscontainedintheDefendantspetitionandstatementsmadeinhisargument,theBoardofParolesandtheDepartmentofCorrectionbecameawareofthepriorsentenceandcorrectlytreatedtheeightyearsentencesasrunningconsecutivetothepriorsentence.  7.0  ` AlthoughtheDefendantallegesthathispleaagreementprovidedthatthe eightyearsentenceswouldrunconcurrentwithhispriorsentence,thejudgmentsdonotsoprovide.Aswehavenoted,thejudgmentsmakenoreferencetohisanypriorunservedTennesseesentence.BecausetheDefendantseightyearsentenceswerenotorderedtobeservedconcurrentlywithapriorunservedsentence,theeightyearsentencesforburglaryarenotillegalandthejudgmentofconvictionisnotvoid. ` WeconcludethattheconvictingcourthadjurisdictionandauthoritytosentencetheDefendant,anditisclearthattheDefendantstermofimprisonmentunderhiseightyearsentenceshadnotexpired.Forthisreason,weconcludethatthetrialjudgedidnoterrindenyingtheDefendanthabeascorpusrelief. ` TheDefendantalsoallegesthathisguiltypleasresultingintheburglaryconvictionswerenotknowingandvoluntarybecausehispleaagreementprovidedthathisburglarysentenceswouldrunconcurrentwithhispriorsentences.Eveniftheseallegationsweretrue,theywouldnotprovidetheDefendantabasisforhabeascorpusrelief.Theseallegationscouldprovidegroundsforpostconvictionrelief,assumingconsiderationoftheallegationsisnotbarredbytheapplicablestatuteoflimitations. ` ThejudgmentofthetrialcourtdismissingtheDefendantspetitionforhabeascorpusreliefisaffirmed. `     h      p      x   (#  `    ____________________________________ `     h   DAVIDH.WELLES,JUDGE 9p02 ЇCONCUR:___________________________________JERRYL.SMITH,JUDGE___________________________________JOHNK.BYERS,SENIORJUDGE
