×€€For€these€Class€B€felonyÏconvictions,€the€Defendant€was€ordered€to€serve€two€consecutive€ten„yearÏterms€in€the€Department€of€Correction€as€a€Range€I€standard€offender.€€It€is€fromÏthe€sentences€imposed€by€the€trial€court€that€the€Defendant€appeals.€€We€affirmÏthe€judgment€of€the€trial€court.ÌÌà àThe€Defendant€and€her€husband€were€jointly€indicted€by€the€RutherfordÏCounty€Grand€Jury€for€four€counts€of€the€Class€A€felony€of€rape€of€a€child.€€TheÏDefendantððs€guilt€was€predicated€on€her€being€criminally€responsible€for€theÏconduct€of€her€œcodefendant„husband.›× ƒ1 ××  ×€€The€victim€of€the€offense€was€theÏDefendantððs€ten„year„old€daughter,€who€at€the€time€resided€with€the€DefendantÏand€her€œcodefendant„husband.›€€ÌÌà àThe€Defendant€entered€into€a€plea€agreement€which€allowed€her€to€pleadÏguilty€to€two€counts€of€the€reduced€charge€of€facilitating€the€rape€of€her€child,€withÏsentencing€left€to€the€discretion€of€the€trial€court.€€The€Defendant€also€agreed€toÏtestify€against€her€œcodefendant„husband›€at€his€trial.€€As€part€of€the€agreement,Ïthe€State€dismissed€two€of€the€counts€of€raping€her€child.ÌÌà àWe€will€briefly€summarize€the€facts€surrounding€the€Defendantððs€twoÏconvictions.œ× ƒ2 ××  ×›€€In€the€first€instance,€the€victim€was€asleep€in€her€bed.€€TheÏDefendant€went€and€woke€her€and€led€her€to€œthe€living€room,›€œwhere€theÏcodefendant€was€waiting.€€The€victim€was€forced€to€perform€oral€sex€on€theÏcodefendant.€€The›€œcodefendant›€œbegan€rectal€intercourse.€€He€then€attempted›Ïvaginal€intercourse€but€was€œapparently€unable›€to€penetrate€the€victim.€€œTheÏcodefendant€then€vaginally€penetrated€the€victim€with€his€finger.€€The›€facts€whichÏled€to€the€second€conviction€occurred€about€three€weeks€after€the€firstÏoccurrence.€€The€victim€was€œbrought›€into€the€bedroom€of€the€Defendant€and€herÏœcodefendant„husband›€where€various€acts€of€oral€and€anal€intercourse€tookÏplace€between€the€Defendant,€the€œcodefendant,›€and€the€victim.€€œThe€victim€wasÏforced€to€perform€oral€sex€on€the€codefendant.€€The€Defendant€and€theÏcodefendant€then€had€intercourse.€€The›€Defendant€maintained€that€herÍœcodefendant„husband›€was€physically€and€mentally€abusive€to€her€and€thatÏshe€was€forced€by€him€to€participate€in€the€actions€involving€the€rape€of€her€ten„year„old€daughter.€ÌÌà àAfter€conducting€a€sentencing€hearing,€the€trial€judge€sentenced€theÏDefendant€to€the€mid„range€sentence€of€ten€years€for€each€offense.€€TheÏsentences€were€ordered€to€be€served€consecutively€in€the€Department€ofÏCorrection€as€a€Range€I€standard€offender.€œ€On€this€appeal€the€DefendantÏargues€that€her€sentences€are€excessive€and€that€we€should€order€theÏsentences€served€concurrently€rather€than€consecutively.›ÌÌà àWhen€an€accused€challenges€the€length,€range,€or€the€manner€of€serviceÏof€a€sentence,€this€court€has€a€duty€to€conduct€a€òòdeóó€òònovoóó€review€of€theÏsentence€with€a€presumption€that€the€determinations€made€by€the€trial€court€areÏcorrect.€€Tenn.€Code€Ann.€ðð€40„35„401(d).€€This€presumption€is€"conditionedÏupon€the€affirmative€showing€in€the€record€that€the€trial€court€considered€theÏsentencing€principles€and€all€relevant€facts€and€circumstances."€€òòState€v.€Ashbyóó,Ï823€S.W.2d€166,€169€(Tenn.€1991).ÌÌà àIf€our€review€reflects€that€the€trial€court€followed€the€statutory€sentencingÏprocedure,€imposed€a€lawful€sentence€after€having€given€due€consideration€andÏproper€weight€to€the€factors€and€principals€set€out€under€the€sentencing€law,Ïand€that€the€trial€court's€findings€of€fact€are€adequately€supported€by€the€record,Ïthen€we€may€not€modify€the€sentence€even€if€we€would€have€preferred€aÏdifferent€result.€€òòState€v.€Fletcheróó,€805€S.W.2d€785,€789€(Tenn.€Crim.€App.€1991).ÌÌà àThe€presentence€report€reflects€that€the€Defendant€was€twenty„eightÏyears€old€and€was€married€to€her€œcodefendant.›€€She€had€two€children€by€aÏprevious€marriage.€€She€œmarried›€her€œcodefendant„husband€some€three€or€fourÏmonths€after€the€attacks€on€her€ten„year„old€daughter.× ƒ3 ××  ×€€The€Defendantððs€formalÏeducation€ended€with€the€eleventh€grade€although€she€reported€that€she€hadÍobtained€her€GED.€€No€record€of€prior€convictions€was€set€forth€in€theÏpresentence€report,€although€the€Defendant€reported€she€had€been€arrested€forÏpossession€of€marijuana€and€that€she€had€two€prior€shoplifting€convictions.€€TheÏDefendant€also€reported€a€long€history€of€marijuana€use.€€She€did€not€reportÏsteady€employment€but€she€had€worked€as€a€factory€worker€at€severalÏlocations.ÌÌà àAt€the€sentencing€hearing€the€Defendant€testified€concerning€the€assaultsÏupon€her€daughter.€€She€admitted€that€she€had€assisted€her€husband€in€rapingÏthe€child€during€the€first€assault,€although€she€said€she€acted€only€out€of€fear€ofÏher€husband.€€She€said€she€didnððt€report€the€assaults€to€anyone€because€sheÏwas€afraid€of€her€husband.€€She€also€admitted€her€involvement€in€the€secondÏrape€although€she€again€stated€she€participated€only€because€her€husbandÏphysically€abused€her€and€she€was€afraid€of€him.€€It€appears€from€the€recordÏthat€the€victim€was€penetrated€both€vaginally€and€anally€and€was€required€toÏperform€oral€sex€on€the€codefendant„husband.€€The€Defendant€expressed€herÏremorse€for€her€crimes.€€We€have€already€noted€that€the€Defendant€actuallyÏmarried€her€codefendant„husband€some€three€or€four€months€after€the€rapesÏoccurred.€€At€the€sentencing€hearing,€a€psychologist€testified€generally€concerningÏthe€characteristics€of€an€abused€spouse,€although€the€psychologist€had€neverÏexamined€the€Defendant.ÌÌà àPrior€to€the€Defendantððs€sentencing,€she€had€testified€at€the€trial€of€herÏcodefendant„husband.€€During€her€sentencing€hearing,€references€were€madeÏby€counsel€for€the€Defendant€and€counsel€for€the€State€regarding€testimonyÏgiven€by€the€Defendant€at€the€trial€of€her€codefendant.€€Statements€were€madeÏto€and€by€the€trial€judge€concerning€testimony€presented€at€the€codefendantððsÏtrial,€particularly€statements€against€interest€made€by€the€Defendant.€€The€trialÏjudge€herein€presided€over€the€codefendant„husbandððs€trial.€€While€we€believeÏthat€the€record€on€appeal€is€sufficient€to€allow€us€to€adequately€review€theÏDefendantððs€sentencing€issues,€we€do€point€out€that€the€record€on€appeal€doesÏnot€contain€a€transcript€of€the€Defendantððs€testimony€at€her€codefendantððs€trial.€ÏA€party€seeking€review€in€this€court€is€required€to€prepare€a€record€whichÏconveys€a€fair,€accurate,€and€complete€account€of€what€transpired€in€the€trialÏcourt€with€respect€to€the€issues€that€will€be€presented€to€the€appellate€court€forÏdetermination.€€T.R.A.P.€24(b);€òòState€v.€Ballardóó,€855€S.W.2d,€557,€560„61€(Tenn.Ï1993).ÌÌà àWhen€we€consider€the€nature€and€characteristics€of€the€DefendantððsÏcriminal€conduct,€we€can€only€conclude€that€it€was€most€reprehensible.€€TheÏcrimes€that€the€Defendant€not€only€allowed€to€be€perpetrated€against€her€ownÍchild,€but€also€participated€in,€were€terrible.€€That€the€Defendant€married€herÏcodefendant€after€these€acts€were€committed€is€almost€beyond€comprehension.ÌÌà àIn€sentencing€the€Defendant,€the€trial€court€found€as€an€enhancementÏfactor€that€the€victim€was€particularly€vulnerable€because€of€her€age.€€Tenn.ÏCode€Ann.€ðð€40„35„114(4).€€The€victim€was€ten€years€old.€€The€trial€judge€notedÏthat€the€child€was€located€in€a€county€where€no€other€family€members€existedÏother€than€her€mother€and€her€younger€sister.€€Because€no€one€was€readilyÏavailable€to€which€the€child€could€turn€for€help,€we€believe€that€the€recordÏsupports€the€application€of€this€enhancement€factor,€even€though€the€age€of€theÏvictim€is€an€element€of€the€offense.€€òòSeeóó€òòState€v.€Adamsóó,€864€S.W.2d€31,€35Ï(Tenn.€1993).ÌÌà àThe€court€also€found€as€an€enhancement€factor€that€the€DefendantÏabused€a€position€of€private€trust€in€a€manner€that€significantly€facilitated€theÏcommission€or€the€fulfilment€of€the€offense.€€Tenn.€Code€Ann.€ðð€40„35„114(15).€ÏWe€believe€this€enhancement€factor€clearly€applies,€and€obviously€the€trial€courtÏgave€it€great€weight.€€A€more€serious€violation€of€private€trust€is€hard€to€imagine.€ÏIn€addition,€although€not€specifically€found€by€the€trial€court,€this€record€doesÏsupport€as€an€enhancement€factor€that€the€Defendant€has€a€previous€history€ofÏcriminal€behavior€in€addition€to€that€necessary€to€establish€her€sentencing€range.€ÍTenn.€Code€Ann.€ðð€40„35„114(1).€€The€Defendant€admitted€to€shopliftingÏconvictions€and€long€standing€marijuana€use.ÌÌà àAs€a€mitigating€factor,€the€trial€judge€found€that€the€Defendant€did€actÏunder€some€duress€and€under€some€domination€of€her€codefendant„husband,Ïeven€though€the€duress€and€domination€was€not€sufficient€to€constitute€aÏdefense.€€Tenn.€Code€Ann.€ðð€40„35„113(12).€€The€court€found€no€furtherÏmitigating€factors€and€we€agree€that€none€are€supported€by€the€record.ÌÌà àThe€Defendantððs€sentencing€range€for€these€Class€B€felonies€wasÏbetween€eight€and€twelve€years.€€Based€upon€our€review€of€this€record,€weÏcannot€conclude€that€the€trial€judge€erred€or€abused€his€discretion€in€setting€theÏDefendantððs€sentence€at€the€mid„range€of€ten€years.ÌÌà àThe€trial€court€found€that€consecutive€sentences€were€warranted€becauseÏthe€Defendant€had€been€convicted€of€two€statutory€offenses€involving€sexualÏabuse€of€a€minor€with€consideration€of€the€aggravating€circumstances€arisingÏfrom€the€relationship€between€the€Defendant€and€her€victim,€the€time€span€of€theÏDefendantððs€undetected€sexual€activity,€the€nature€and€scope€of€the€sexualÏacts€and€the€extent€of€the€residual,€physical€and€mental€damage€to€the€victim.€ÏTenn.€Code€Ann.€ðð€40„35„115(5).€€The€Defendant€first€argues€that€this€section€ofÍthe€law€does€not€apply€because€she€was€convicted€of€facilitating€the€rape€ofÏthe€child€rather€than€the€rape€itself.€€We€find€this€argument€to€be€without€merit.€ÏWe€believe€that€it€is€clear€that€the€Defendantððs€crimes€qualify€as€ð ðstatutoryÏoffenses€involving€sexual€abuse€of€a€minor.ðð€€ÌÌà àWe€also€believe€that€the€crime€is€aggravated€because€of€the€relationshipÏof€the€Defendant€and€the€victim,€same€being€a€mother„daughter€relationship.€ÏAlthough€the€time€span€of€the€Defendantððs€undetected€sexual€activity€is€notÏclear,€it€is€apparent€from€the€record€that€the€abuse€of€the€victim€took€place€overÏat€least€a€four„month€period€of€time€and€possibly€longer.€€We€also€agree€thatÏconsecutive€sentencing€is€warranted€based€on€the€nature€and€scope€of€theÏsexual€acts€and€the€extent€of€the€residual,€physical€and€mental€damage€to€theÏvictim,€which€factors€are€supported€by€evidence€in€this€record.€€In€summary,€weÏbelieve€that€the€Defendant€met€the€criteria€for€consecutive€sentences€and€weÏcannot€conclude€that€the€trial€judge€erred€or€abused€his€discretion€in€ordering€theÏsentences€served€consecutively.ÌÌà
