Ќ    XQXXXQ X    XXQXXXQ     #    Thedefendantcamebackintothebarafewminuteslaterandsatatatablebehindthe "$r# victim.Thebartenderinstructedthetwomennottotalktoeachotherortheywouldhaveto %X $ leave.Thedefendantstayedafewminutesandthenleftthebar.Thedefendantreturnedtothe %>!% bartwentyorthirtyminuteslaterandthevictimtoldthebartenderthathebelievedthedefendant &$"& hadaweapon.Thebartendersearchedthedefendantforaweaponbypattinghimdownbutdid ' #' notfindanyweapons.Thebartenderreturnedtothebarandcontinuedtowatchthedefendant (#( frombehindthebar.Afewminuteslater,thebartenderwalkedtotheotherendofthebarto )$) serveacustomer.Asthebartenderturnedtowalkbacktowardthevictim,hesawthedefendant l*%* stabthevictiminthebackwithaknife.Afterthepolicearrivedatthebar,thebartenderfounda R+&+ knifewithbloodonitoutsidethebar. ##݌ 8,', Ќ    XQXXXQ X    XXQXXXQ      |(  LarayHays,abarpatrononthenightofthealtercation,alsotestifiedforthestate.She  arrivedwithafriendandobservedthevictimandthedefendantfightingoutsidethebar.She | arrivedafterthefighthadstartedbutdidseethevictimstrikethedefendantinthefaceand b knockhimdown.Shealsoheardthevictimtellthedefendanttostaydownasshewaswalking H intothebar.Ms.Hayscontinuedinsideandsatatthebar.Thevictimcamebackinsideandsat . ~ afewseatsdownfromMs.Haysatthebar.Thedefendantreturnedtothebarfifteenortwenty  d minuteslaterandsatatatabledirectlybehindthevictim.Ms.Hayssawthebartendercheckthe  J defendantforweapons.Shealsoheardthebartendersaythatthedefendantdidnothave  0 anything.Afterafewminutes,Ms.Hayssawthedefendantstandupandapproachthevictim    frombehind.ThevictimdidnotseethedefendantapproachingandMs.Haysdidnothearthem    exchangeanywords.Thedefendantstabbedthevictimintherightsideofhisback.Thevictim   appearedstunnedatfirstbutthenjumpedupandranafterthedefendant.Afewminuteslaterthe x  victimcamebackinsidethebar,andMs.Haysputtowelsonhiswoundstostopthebleeding ^  untilanambulancearrived.|( )݌ D  Ќ    XQXXXQ X    XXQXXXQ      /  Twopoliceinvestigators,whospokewiththedefendant,testifiedforthestate.Officer ` KeithDebowoftheKnoxvillePoliceDepartmentwascalledtothebarafterthevictimwas F stabbed.OfficerDebowinterviewedthevictimbeforehewastakentothehospital.Thevictim , toldOfficerDebowthatthedefendantstabbedhimintheback.OfficerDebowwasalsopresent  atthebarwhenaknifewithbloodonitwasfoundoutsidethebackdoorofthebar.After  learningfromwitnessesthatthedefendantlivednearthebar,OfficerDebowwenttothe  defendantshome.Thedefendantwasfoundsittinginachairbehindhishouse.OfficerDebow t observedthatthedefendantwas bloodyandbeatenandcalledanambulancetotakethe Z defendanttothehospital.Beforetheambulancearrived,thedefendantmadeastatementtothe @ officerindicatingthathehadbeeninafightwiththevictimandhadgonebackintothebar &v wherehestabbedthevictimonetime./?0݌  \ Ќ    XQXXXQ X    XXQXXXQ      5  SergeantTammyHamlinoftheKnoxvillePoliceDepartmentinterviewedthedefendant ( atthehospital.ThedefendanttoldOfficerHamlinthataknifefelloutofthevictimspocket  duringtheirfightoutsidethebar.Thedefendantsaidthathepickeduptheknifeafterthevictim  wentbackinsidethebarandwaitedforabouttenminutesbeforehewentbackinsidethebar.   Thedefendantadmittedtostabbingthevictiminthebackwhilehisbackwasturned.The p!  defendanttoldOfficerHamlinthathewasplanningtoleavethevictimsknifewithhimorin V"! him.OfficerHamlincouldnotrecallwhetherhesaid withhimor inhim.56݌ <#" Ќ    XQXXXQ X    XXQXXXQ      9  Thedefendantalsotestifiedattrial.Thedefendantworkedasabartenderatthebar %X $ acrossthestreetandhadpreviouslyworkedasabartenderatMaryJanesPlace.Heknewthe %>!% victimfromhisworkinthetwobars.Accordingtothedefendant,hedidnotsayanythingtothe &$"& victimwhenhefirstarrivedatthebar.Thedefendantsatatatablebyhimselfandthevictim ' #' askedhimtogooutside.ThevictimorderedabottleofBudweiserbeer,whichthedefendant (#( believedtobeforhimbecauseheknewthevictimtodrinkcansofMillerbeer.Heagreedtogo )$) outsidewiththevictim,believingthattheyweregoingtosmokemarijuana.Onceoutside,the l*%* victimhithimintheheadwiththebeerbottleand knockedhiseyeaboutout.Thebottle R+&+ brokeandthevictim jabbeditinthetopof[thedefendants]head.Thedefendantfelldown 8,', andthevictimkickedhimrepeatedly.Afterthevictimwentbackinsidethebar,thedefendant  tookhisteeshirtoffandusedittostopthebleedingontopofhishead.Hepushedhiseyeback  intoplace,putonanothershirt,andwentbackinsidethebar.9W:݌ | Ќ    XQXXXQ X    XXQXXXQ      K@  Thebartendersearchedthedefendantwhenheenteredthebaranddidnotfindanything. H Thedefendantdeniedhavingaknifewithhimwhenheenteredthebar.Healsosaidthathedid . ~ notremembertellingOfficerHamlinthathepickedupthevictimsknifeoutsidethebar.The  d defendantsatatatableanddrankabeer.Whenhestoodtoleave,thevictimturnedtowardhim  J andaskedifhe wantedsomemoreofit.Thedefendanttestifiedthathedidnotwanttobe  0 beatenbythevictimagain.Ashewalkedtowardthedoor, someoneinthebartappedhimon    theleg.Hereacheddown,and someoneplacedaknifeinhishand.Thevictimstartedto    stand,andthedefendantputhisarmsaroundthevictimandfelttheknifegointhevictimsback.   Heimmediatelypulleditout.Thevictimbeganswinginghisfistsathimandcuthimselfonthe x  knife,whichthedefendantstillhadinhishand.Thebartenderjumpedoverthebarwitha ^  baseballbat,tookthedefendantoutsideandhithimwiththebatinthechest,arms,andthighs. "$r# Jacksonv.Virginia,443U.S.307,319(1979).Questionsconcerningthecredibilityofthe %X $ witnesses,theweightandvaluetobegiventheevidence,aswellasallfactualissuesraisedby %>!% theevidenceareresolvedbythetrieroffact,notthisCourt.Statev.Pappas,754S.W.2d620, &$"& 623(Tenn.Crim.App.1987).ThisCourtmaynotreweighorreevaluatetheevidencebutshould ' #' presumethatthejuryhasresolvedallconflictsinthetestimonyanddrawnallreasonable (#( inferencesfromtheevidenceinfavorofthestate.Statev.Sheffield,676S.W.2d542,547(Tenn. )$) 1984);Statev.Cabbage,571S.W.2d832,835(Tenn.1978). l*%*  X R+&+     XFollowingthestandardofreviewsetoutabove,weconcludethattheelementsof   aggravatedassaultwereestablishedintheinstantcase.Thejurymemberswereinstructedthat  theycouldfindthedefendantguiltyofaggravatedassaultaschargedinCountsOne,Two,or | Threebutcouldonlyconvictthedefendantofonecount.Thejuryfoundthedefendantguiltyof b CountTwo.Therefore,tosupportthedefendant'sconvictionforaggravatedassault,thestate H wasrequiredtoprovethatthedefendantknowinglycausedbodilyinjurytothevictimbyusinga . ~ deadlyweaponpursuanttoTennesseeCodeAnnotatedsections39-13-101(a)(1)and102  d (a)(1)(B).  J  X XрThereisampleevidencetosupportafindingthatthedefendantcausedbodilyinjuryto    thevictimbyusingadeadlyweapon.Thevictimtestifiedthathewassittingonabarstoolwith    hisbacktothedefendantwhenhefeltthedefendantstabhimintheback.Thebartender   testifiedthathesawthedefendantstabthevictiminthebackwithaknife.Abarpatrontestified x  thatshesawthedefendantapproachthevictimwithaknifeandstabhimintheback.Twopolice ^  investigators,whoquestionedthedefendantaftertheincidentoccurred,testifiedthatthe D  defendantadmittedduringquestioningthathehadstabbedthevictiminthebackwithaknife.A *z  knifefoundoutsidethebarwithbloodonitwasidentifiedbythebartenderandintroducedinto ` evidence.Finally,thedefendanthimselftestifiedandadmittedtostabbingthevictimwitha F knife. ,   Turningtothedefendantscontentionthatheactedinselfdefense,wemustconclude  thattherewassufficientevidenceforthejurytofindbeyondareasonabledoubtthatthe  defendantwasnotactinginselfdefense.Theissueofself-defenseisamatterforthejuryto t decide.Statev.Ivy,868S.W.2d724,727(Tenn.Crim.App.1993).However,onceevidenceis Z admittedsupportingthedefense,thestatemustprovebeyondareasonabledoubtthatthe @ defendantdidnotactinselfdefense.Tenn.CodeAnn.39-11-201(a)(3);Statev.Belser,945 &v S.W.2d776,783(Tenn.Crim.App.1996).TennesseeCodeAnnotatedsection39-11-611(a)  \ statesthat B  X X Xapersonisjustifiedinthreateningorusingforceagainstanotherpersonwhenand ( tothedegreethepersonreasonablybelievestheforceisimmediatelynecessaryto  protectagainsttheother'suseorattempteduseofunlawfulforce.Theperson  musthaveareasonablebeliefthatthereisanimminentdangerofdeathorserious   bodilyinjury.Thedangercreatingthebeliefofimminentdeathorseriousbodily p!  injurymustbereal,orhonestlybelievedtoberealatthetime,andmustbe V"! foundeduponreasonablegrounds.Thereisnodutytoretreatbeforeaperson <#" threatensorusesforce. "$r#  X] X]Tenn.CodeAnn.3911611(a). %X $  XIntheinstantcase,thedefendanttestifiedonhisownbehalf.Accordingtothe &$"& defendantsversionoftheevents,hewenttoalocalbarintheearlyevening,andthevictimwas ' #' seatedatthebarwhenhearrived.Thevictimorderedabeerandthenaskedthedefendanttogo (#( outsidewithhim.Thedefendantagreedbelievingthatthevictimboughtthebeerforhimand )$) thattheyweregoingtosmokemarijuana.Onceoutside,thevictimhithimintheheadwitha l*%* beerbottlewithoutprovocation.Theblowcausedthedefendantsrighteyetocomepartiallyout R+&+ ofthesocketandswellseverely.Thevictimthenstabbedthetopofthedefendantsheadwith 8,',       thebrokenbottle.Thedefendantfelltotheground,andthevictimkickedhimrepeatedlyashe  layontheground.Afterhestoppedkickingthedefendant,thevictimwentbackinsidethebar  andreturnedtohisseatatthebar. |  b Shortlythereafter,thedefendantalsowentbackinsidethebaranddrankabeeratatable H locatedseveralfeetbehindthevictim.Thedefendantmaintainsthatwhenhestoodtoleavethe . ~ victimturnedtofacehimandsaid, Doyouwantsomemoreofit?Atthispoint,thedefendant  d claimsthatsomeoneinthebartappedhimonthelegandplacedaknifeinhishand.Thevictim  J startedtogetupfromhisbarstool,andthedefendantputhisarmsaroundthevictimandfeltthe  0 knifepiercethevictimsback.Thedefendantimmediatelypulledtheknifeback,andthevictim    chargedathim,swinginghisfists.Thenthebartenderjumpedoverthebarwithabaseballbat    andbeganhittingthedefendantasheusheredthedefendantoutsidethebar.Whenaskedwhyhe   stabbedthevictim,thedefendantrespondedthathewasafraidthatthevictimwasgoingtobeat x  himuplikehehadearlier.Hesaidhedidnotintendtostabthevictimbutthathewasunwilling ^  totakeanotherbeatingfromthevictim.Theonlycorroboratingevidenceintroducedbythe D  defendantwaspicturesofhisinjuries,whichconformedtohisdescriptionofthefightbetween *z  himandthevictimoutsidethebar. `  X XIncontrasttothedefendantsversionofwhathappened,thestateswitnessesalltestified , thatthevictimdidnotsayanythingtothedefendantbeforehewasstabbed.Additionally,the  stateswitnessestestifiedthatthedefendantessentiallysnuckupbehindthevictimandstabbed  himinthebackashesatatthebar.Thevictimadmittedthatheandthedefendantfought  outsidethebarearlierintheevening.However,thevictimassertedthatitwasthedefendant t whostruckhimwithabeerbottlefirst. Z  @ Werecognizethatthedefendant'saccountoftheeventsdifferedsubstantiallyfromthe &v stateswitnessesandthat,ifhisversionweretobebelieved,thejurycouldhavefoundthathe  \ wasactinginselfdefense.However,theevaluationofwitnesses'credibility,theweightand B valuetobegiventotheevidence,andresolutionoffactualissuesraisedbytheevidenceareleft ( tothetrieroffact.Cabbage,571S.W.2dat835.Therefore,takingtheevidenceinthelightmost  favorabletothestate,weconcludethejurycouldhavefoundthedefendant'sclaimof  self-defensewasnegatedbythestate'sproof.Thisissueiswithoutmeritandthejudgmentofthe   trialcourtisaffirmed. p! B  X  X  Onceadefendanthasbeenaffordedthestatutorypresumptionofalternativesentencing,  theburdenofestablishingsuitabilityfortotalprobationisonthedefendantBingham,910  S.W.2dat455LXXQ.XQXLԀTomeetthisburden,thedefendantmustdemonstratethatprobationwill   "subservetheendsofjusticeandthebestinterestofboththepublicandthedefendant."Id.at !  456.Indeterminingwhetherornottograntprobation,thetrialcourtshouldconsider,among |"! otherfactors,thecircumstancessurroundingtheoffense,thedefendant'scriminalrecord,the b#" defendant'spresentcondition,thedefendant'scredibilityorlackthereof,andwhetherasentence H$# offullprobationwouldundulydepreciatetheseriousnessoftheoffense.Statev.Davis,940 .%~ $ S.W.2d558,559(Tenn.1997);Bingham,910S.W.2dat456.LXXQ &d!%  X XXQXLIntheinstantcase,thetrialcourtcorrectlyobservedthatitisthedefendants (V#' responsibilitytoestablishhissuitabilityforfullprobation.Thetrialcourtacknowledgedthatthe (<$( defendantsconvictionwasnot thetypeofoffenseforwhich[thedefendant]shouldbesentto )"%) thepenitentiaryforafiveyearsentence.Afterreviewingthestatutoryfactors,thetrialcourt *&* foundthattheseriousnessoftheoffenserequiredthatthedefendantservesometimeincustody. +&+       Tenn.CodeAnn.4035103(1)(B).Inconsideringtheseriousnessoftheoffense,thetrial  courtfoundthatthevictimsufferedseriousbodilyinjuryandthevictimsfamilywasalso  significantlyimpactedbytheassault.Thevictimslungwaspuncturedwhenthedefendant | stabbedhimintheback,whichrequiredthevictimtobehospitalized.Thevictimsuffereda b greatdealofpainasaresultofthetreatmentforhiscollapsedlung.Atthetimeoftheassault, H thevictimwasresponsibleforcaringforhisinjuredandelderlyfatherandwasunableto . ~ continuedoingsoaftertheassault.Thevictimalsohadatwelveyearolddaughteratthetimeof  d theassaultwhowaspsychologicallytraumatizedbytheassaultonherfather.
