Inthisappealofright,thedefendantcomplainsthatheshouldhavebeengrantedanalternativesentence.  OnSeptember25and26of1995,thedefendantpassedthreeforgedchecksintheamountsof$35.00,$75.00,and$150.00.Althoughnotwrittenbythedefendant,thedefendantcashedthechecksandusedthemoneytopurchasecrackcocaine.  Thedefendant,thirtysixyearsofage,washomelessatthetimeofthesentencinghearing.Hehasonechild,fiveyearsoldatthattime,wholiveswithhergrandmother.Thedefendantacknowledgedthathewasanalcoholicandthathewasaddictedtococaine.Thedefendanthasasporadicworkrecord.Heisafarmworkerduringthesummermonthsandoccasionallydoesoddjobssuchasmowingorrakingyards.Hetakesmedicationforanillnessandhasreceivedsomedisabilitypayments.ThedefendantwasdiagnosedHIVpositivein1990.  Whenthereisachallengetothelength,range,ormannerofserviceofasentence,itisthedutyofthiscourttoconductadenovoreviewwithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d).Thepresumptionis"conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991).TheSentencingCommissionCommentsprovidethattheburdenisonthedefendanttoshowtheimproprietyofthesentence.  Ourreviewrequiresananalysisof(1)theevidence,ifany,receivedatthetrialandsentencinghearing;(2)thepresentencereport;(3)theprinciplesofsentencingandtheargumentsofcounselrelativetosentencingalternatives;(4)thenatureandcircumstancesoftheoffense;(5)anymitigatingorenhancingfactors;(6)anystatementsmadebythedefendantinhisownbehalf;and(7)thedefendant'spotentialforrehabilitationortreatment.Tenn.CodeAnn.4035102,103,and̄210;Statev.Smith,735S.W.2d859,863(Tenn.Crim.App.1987).  Amongthefactorsapplicabletothedefendant'sapplicationforprobationoranyotheralternativesentencearethecircumstancesoftheoffense,thedefendant'spriorcriminalrecord,socialhistory,presentcondition,andthedeterrenteffectuponandbestinterestofthedefendantandthepublic.Statev.Grear,568S.W.2d285,286(Tenn.1978).EspeciallymitigatedorstandardoffendersconvictedofClassC,D,orEfeloniesarepresumedtobefavorablecandidates"foralternativesentencingoptionsintheabsenceofevidencetothecontrary."Tenn.CodeAnn.4035102(6).Withcertainstatutoryexceptions,noneofwhichapplyhere,probationmustbeautomaticallyconsideredbythetrialcourtifthesentenceimposediseightyearsorless.Tenn.CodeAnn.4035303(a).BecausethedefendantisaRangeIIIoffender,heisnotpresumedtobeafavorablecandidateforalternativesentencingoptions.Tenn.CodeAnn.4035102(6).  Thetrialcourtfoundtwomitigatingfactors.Itruledthatthedefendantplayedaminorroleintheoffenseandthathisconductneithercausednorthreatenedseriousbodilyinjury.Tenn.CodeAnn.4035113(1)and(4).Thus,thetrialcourtimposedtheminimumsentencepossibleforaRangeIIIoffender.Tenn.CodeAnn.4035112(c)(5).ServiceoffortyfivepercentisrequiredbyaRangeIIIoffender.Tenn.CodeAnn.4035501(e).  Onlyfivemonthsbeforethisoffense,thedefendantreceivedasentencewhichincludedafouryeartermofprobation.Asentencingconsiderationiswhethermeasuresthatdidnotincludeconfinementhad"recentlybeenappliedunsuccessfullytothedefendant."Tenn.CodeAnn.4035103(1)(C).Thedefendanthasapriorcriminalrecordwhichbeganasearlyas1987andwhichincludesconvictionsforburglary(twocounts),attemptedburglary,grandlarceny,andasaleofcocaine.Theforgerieswerecommittedwhilethedefendantwasonprobationforthemostrecentburglaryconviction.Allofthat,inourview,suggestsalackofamenabilityforrehabilitation.Forthesereasons,thetrialcourthadareasonablebasisforthedenialofanalternativesentence.Thesentenceofconfinementisappropriateunderthesecircumstances.
