Ð194,€197€(Tenn.€Crim.€App.€1992).€€This€deference€applies€to€a€trial€courtððs€findings€of€fact€in€theÐ $X" Ðcontext€of€sentencing€hearings.€€òòSeeóó€òòState€v.€Rainesóó,€882€S.W.2d€376,€383€(Tenn.€Crim.€App.€1994).€Ð ô$D # ÐUpon€òòdeóó€òònovoóó€review,€we€agree€that€the€trial€courtððs€findings€concerning€Ô#†Xî(XXXî(±9#Ôthe€nature€of€the€offenseÐ à%0!$ Ðand€Defendantððs€continuous€criminal€activity€are€sufficient€to€deny€probation.€€Ð Ì&"% ÐÌà  àWith€regard€to€Defendantððs€criminal€activity,€we€first€observe€that€Defendant€committedÐ ¤(ô#' Ðtwenty„five€to€thirty€acts€of€aggravated€sexual€battery€against€his€stepdaughter€over€a€four„monthÐ )à$( Ðperiod.€€In€addition,€the€record€reveals€that€although€Defendant€admitted€to€having€a€problem€withÐ |*Ì%) Ðalcohol,€he€continued€to€drink€alcohol€and€smoke€marijuana€even€after€he€was€arrested.€€We€furtherÐ h+¸&* Ðfind€the€nature€of€the€offense€deplorable€in€that€a€father€would€give€his€stepdaughter,€or€any€twelve„Ð ° Ðyear„old€girl€for€that€matter,€alcohol€and€marijuana.€€Defendantððs€actions€showed€excessive€depravityÐ œì Ðin€repeatedly€sexually€abusing€his€young€stepdaughter,€in€spite€of€his€awareness€that€she€hadÐ ˆØ Ðpreviously€been€raped.€€Lastly,€he€evinced€a€complete€disregard€for€the€gravity€of€his€wrongfulÐ tÄ Ðconduct€when€he€failed€to€seek€help€for€the€problem€which€he€claims€caused€his€appalling€behaviorÐ `° Ðin€the€first€place.€€In€spite€of€the€severity€of€his€offense,€Defendant€failed€to€seek€any€form€ofÐ L œ Ðrehabilitation€or€treatment€for€his€alcohol,€drug,€or€sexual€abuse€problems.€€Consequently,€we€findÐ 8 ˆ Ðincarceration€for€the€full€term€of€Defendantððs€sentence€would€not€be€inappropriate€in€this€case.€€Ð $ t ÐÌà  àIn€his€brief,€Defendant€asserts€that€before€a€court€may€deny€probation€based€upon€theÐ ü L  Ðseriousness€of€the€offense,€the€circumstances€of€the€offense€as€committed€must€be€especiallyÐ è 8  Ðhorrifying,€shocking,€reprehensible,€offensive€or€otherwise€of€an€excessive€or€exaggerated€degree,Ð Ô$  Ðand€the€nature€of€the€offense€must€outweigh€all€other€factors€favoring€a€sentence€other€thanÐ À  Ðconfinement.€€òòState€v.€Binghamóó,€910€S.W.2d€448,€454€(Tenn.€Crim.€App.€1995)€(quoting€òòState€v.Ð ¬ü  ÐHartleyóó,€818€S.W.2d€370,€374„75€(Tenn.€Crim.€App.€1991)).€€Defendant€is€correct.€€However,€theÐ ˜è  Ðrecord€contains€ample€evidence€that€Defendantððs€actions€were€sufficiently€shocking,€reprehensible,Ð „Ô  Ðand€offensive€to€deny€full€probation.€€In€other€words,€a€sentence€of€confinement€to€avoid€depreciatingÐ pÀ Ðthe€seriousness€of€the€offense€would€be€proper€in€this€case.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„103(1)(B)Ð \¬ Ð(1997).€Ð H˜ ÐÌà  àMoreover,€we€note€that€Ô‡Xî(XXXî(Ôthe€potential€for€rehabilitation€and€its€lack€thereof€is€a€properÐ  p Ðconsideration€in€determining€whether€confinement€is€appropriateòòóó.€€Tenn.€Code€Ann.€ðð€40„35„103(5)Ð  \ Ð(1997).€€This€Court€has€previously€held€that€a€defendantððs€lack€of€candor,€credibility,€and€willingnessÐ øH Ðto€accept€responsibility€for€his€crime€are€relevant€considerations€in€determining€a€defendantððsÐ ä4 Ðpotential€for€rehabilitation.€€òòState€v.€Zeoliaóó,€928€S.W.2d€457,€463€(Tenn.€Crim.€App.€1996);€òòStateÐ Ð  Ðv.€Dowdyóó,€894€S.W.2d€301,€306€(Tenn.€Crim.€App.€1994);€òòState€v.€Andersonóó,€857€S.W.2d€571,€574Ð ¼  Ð(Tenn.€Crim.€App.€1992).€€Ô#†Xî(XXXî(4a#ÔDefendantððs€actions€and€testimony€demonstrate€a€clear€lack€of€potentialÐ ¨ø Ðin€this€regard.€€Although€Defendant€claimed€to€be€sorry€for€his€crime,€he€nevertheless€proceeded€toÐ ”ä Ðlay€blame€for€his€criminal€conduct€on€his€problems€with€alcohol€and€drugs.€€He€refused€to€takeÐ €Ð Ðresponsibility€even€for€those,€claiming€to€need€drugs€for€the€pain€in€his€leg€and€that€the€chargesÐ l¼ Ðagainst€him€increased€his€need€for€alcohol.€€This€apparent€unwillingness€to€accept€responsibility€forÐ X ¨ Ðhis€past€and€present€criminal€conduct€further€indicates€that€incarceration€is€appropriate.€€For€theÐ D!” Ðabove€reasons,€Defendant€has€failed€to€show€that€the€sentence€imposed€is€improper€or€that€probationÐ 0"€  Ðwill€be€in€the€best€interest€of€the€defendant€and€the€public.Ð #l! ÐÌò òII.€€Alternative€Sentencing€Other€Than€Full€Probationó ó€Ð ô$D # ÐÌà  àThe€Appellant€also€argues€that€the€trial€court€erred€by€not€granting€him€a€form€of€alternativeÐ Ð& "% Ðsentencing€other€than€probation.€As€a€preliminary€matter€regarding€alternative€sentencing€in€general,Ð ¼' #& Ðwe€note€that€Defendantððs€convictions€for€attempted€aggravated€sexual€battery,€a€ð ðcrime€against€theÐ ¨(ø#' Ðperson,ðð€made€him€ineligible€for€alternative€sentencing€in€the€form€of€€Community€Corrections.€€òòSeeóóÐ ”)ä$( ÐTenn.€Code€Ann.€ðð€40-36-106(a)(2).€€Neither€does€the€record€support€Defendantððs€eligibility€for€theÐ €*Ð%) Ðspecial€needs€provision€in€Tennessee€Code€Annotated€section€40-36-106(c).€Ð l+¼&* ÐÔ‡Xî(XXXî(Ôà  àAs€a€Range€I€standard€offender€convicted€of€Class€C€felonies,€Defendant€may€be€presumedÐ ° Ða€favorable€candidate€for€alternative€sentencing€options€in€the€absence€of€evidence€to€the€contrary.€Ð œì ÐTenn.€Code€Ann.€ðð€40-35-102(6)€(1997).€€This€presumption€was€acknowledged€by€the€trial€court€inÐ ˆØ Ðthe€case€òòsubóó€òòjudiceóó€and€may€be€rebutted€by€evidence€that€(1)€ð ðconfinement€is€necessary€to€protectÐ tÄ Ðsociety€by€restraining€the€defendant€who€has€a€long€history€of€criminal€conduct,ðð€(2)€ð ðconfinementÐ `° Ðis€necessary€to€avoid€depreciating€the€seriousness€of€the€offense€or€confinement€is€particularly€suitedÐ L œ Ðto€provide€an€effective€deterrence€to€others€likely€to€commit€similar€offenses,ðð€or€(3)€ð ðmeasures€lessÐ 8 ˆ Ðrestrictive€than€confinement€have€frequently€or€recently€been€applied€unsuccessfully€to€theÐ $ t Ðdefendant.ðð€€òòId.óó€ðð€40-35-103(1)(A)-(C);€òòseeóó€òòAshbyóó,€823€S.W.2d€at€169.€€In€addition,€a€defendantððsÐ  ` Ðpotential€for€rehabilitation€or€lack€thereof€should€be€examined€when€determining€whether€anÐ ü L  Ðalternative€sentence€is€appropriate.€€Tenn.€Code€Ann.€ðð€40-35-103(5).€Ô#†Xî(XXXî(ùj#ÔÐ è 8  ÐÌà  àUpon€òòdeóó€òònovoóó€review,€we€first€note€that€neither€(1)€nor€(3)€apply€in€this€case.€€AlthoughÐ À  ÐDefendant€has€a€history€of€criminal€conduct,€it€cannot€be€considered€ð ðlong.ðð€€The€presentence€reportÐ ¬ü  Ðshows€only€two€misdemeanor€convictions€in€1994,€one€for€resisting€arrest€and€the€other€forÐ ˜è  Ðpossession€of€marijuana,€and€Defendant€admitted€to€a€third€conviction€(not€in€the€record)€ofÐ „Ô  Ðpossession€of€drug€paraphernalia€in€the€year€prior€to€October€2000.€€Nor€have€measures€lessÐ pÀ Ðrestrictive€than€confinement€frequently€or€recently€been€applied€unsuccessfully€to€Defendant.€Ð \¬ ÐInstead,€we€find€the€nature€of€Defendantððs€conduct,€for€the€reasons€discussed€òòsupraóó€in€the€contextÐ H˜ Ðof€determining€the€propriety€of€probation,€is€sufficiently€shocking€and€reprehensible€to€also€denyÐ 4„ Ðalternative€sentencing.€€This€conclusion€is€further€supported€by€Defendantððs€lack€of€potential€forÐ  p Ðrehabilitation,€also€previously€discussed,€which€is€a€proper€consideration€in€determining€whetherÐ  \ Ðsentence€alternatives€other€than€probation€are€appropriate.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„103(5)Ð øH Ð(1997).Ð ä4 ÐÌà  àIn€sum,€we€find€that€Defendant€failed€to€carry€his€burden€of€showing€that€the€sentenceÐ ¼  Ðimposed€is€improper€and€that€probation€would€be€in€the€best€interest€of€the€Defendant€and€the€public.€Ð ¨ø ÐWe€also€conclude€that€the€State€successfully€rebutted€the€statutory€presumption€favoring€alternativeÐ ”ä Ðsentencing€under€the€circumstances€of€this€case.€€Therefore,€Defendant€is€not€entitled€to€relief€on€thisÐ €Ð Ðissue.Ð l¼ ÐÌò òÓ  ÓCONCLUSIONó óÐ D!” ÐÓÃwÓÌà  àAccordingly,€the€judgment€of€the€trial€court€is€affirmed.Ð #l!
