Ðagain€about€9:00€p.m.,€and€did€not€return.€€Mr.€Holloway€said€he€asked€Ms.€Eady€how€she€recalledÐ ¢#ò" Ðthe€specific€date€of€these€events,€and€she€told€him€she€saw€his€arrest€on€television€the€next€day.€Ð ‹$Û# ÐBased€on€the€date€the€murder€was€committed,€and€the€dates€the€petitioner€was€arrested€and€his€arrestÐ t%Ä $ Ðtelevised,€Mr.€Holloway€concluded€that€she€was€referring€to€a€date€more€than€three€days€after€theÐ ]&­!% Ðmurder.€€He€said€that€he€reported€his€findings€to€the€petitionerððs€attorney,€who€determined€that€noÐ F'–"& Ðalibi€defense€was€possible€based€upon€this€information.€€Mr.€Holloway€testified€the€PublicÐ /(#' ÐDefenderððs€Office€had€an€answering€machine,€but€he€did€not€recall€receiving€a€message€from€Ms.Ð )h$( ÐEady.€€Ð *Q%) Ðâ âÐ ê*:&* Ðà  àMr.€Mickey€Campbell,€an€investigator€with€the€Public€Defenderððs€Office,€testified€that€heÐ ° Ðâ âworked€with€Mr.€Holloway€during€the€investigation€of€the€petitionerððs€case.€€He€said€that€he€did€notÐ ™é Ðrecall€the€name€Eric€Wharton€but€that€he€spoke€with€Mr.€Pepper,€Sr.,€ten€or€twelve€times.€€RegardingÐ ‚Ò ÐMs.€Eady,€Mr.€Campbell€said€he€and€Mr.€Holloway€attempted€to€contact€her€within€days€of€learningÐ k» Ðthat€she€might€have€important€information.€€He€said€that€they€visited€her€workplace€twice€and€herÐ T¤ Ðresidence€once€but€were€unsuccessful€in€making€contact.€€He€said€he€was€present€when€Mr.Ð =  ÐHolloway€finally€spoke€with€her€by€telephone.€€Mr.€Campbell€testified€that€they€reviewed€theÐ & v Ðinformation€with€the€petitionerððs€attorney€and€concluded€that€Ms.€Eady€could€not€provide€theÐ  _ Ðpetitioner€with€an€alibi.€Ð ø H ÐÌà  àRecalled€as€a€witness,€the€petitionerððs€attorney€denied€stating€that€witness€subpoenas€wereÐ Ê   Ðtoo€expensive€or€troublesome€to€use.€€He€testified€that€during€the€preparation€for€trial,€the€petitionerÐ ³  Ðclaimed€only€that€he€had€nothing€to€do€with€the€crime€and€did€not€give€him€much€information.€€HeÐ œì  Ðsaid€the€petitioner€denied€having€a€shotgun€and€knowledge€how€his€name€appeared€on€theÐ …Õ  Ðregistration€form€for€the€weapon€or€how€it€became€located€under€the€hood€of€his€car.€€The€petitionerÐ n¾  Ðalso€denied€going€to€the€Summersðð€home,€being€with€Summers,€and€knowing€where€he€was€on€theÐ W§  Ðnight€of€the€crime.€€The€attorney€said€he€spoke€with€the€investigators€daily€during€their€search€forÐ @ ÐMs.€Eady,€but,€with€regard€to€her€testimony,€he€believed€it€would€have€only€damaged€the€petitionerððsÐ )y Ðcase.€€He€said€he€explained€this€to€both€the€petitioner€and€his€father.€€Ð b ÐÌà  àAfter€the€hearing€was€concluded,€the€trial€court€found€the€following:€The€Public€DefenderððsÐ ä4 ÐOffice€represented€the€petitioner€for€more€than€twelve€months€before€trial€and,€during€this€time,€allÐ Í Ðwitnesses€known€to€the€Office€were€interviewed,€or€an€attempt€was€made€to€do€so,€which€constitutedÐ ¶ Ðmore€than€adequate€investigation.€€Counsel€met€with€the€petitioner€to€discuss€the€investigatorððsÐ Ÿï Ðfindings€and€trial€strategy,€but€the€petitioner€initially€maintained€that€he€could€not€recall€hisÐ ˆØ Ðwhereabouts€at€the€time€of€the€crime.€€Six€days€before€trial,€the€petitioner€gave€the€name€of€aÐ qÁ Ðpotential€alibi€witness,€Ms.€Eady,€to€counsel€and€he€made€attempts€to€contact€her,€which€resulted€inÐ Zª Ðthe€telephone€conversation€between€Ms.€Eady€and€Mr.€Holloway.€€Based€on€the€information€sheÐ C“ Ðgave€him€at€that€time,€it€was€reasonable€to€conclude€that€Ms.€Eady€was€mistaken€about€the€date€sheÐ ,| Ðsaw€the€petitioner€in€her€store.€€This€information€was€communicated€to€the€petitioner€who€did€notÐ e Ðobject€to€proceeding€to€trial,€during€which€Ms.€Eady€was€not€called€as€a€witness€for€tactical€reasons.€Ð þN ÐSix€weeks€after€the€trial€concluded,€Ms.€Eady€gave€a€notarized€statement€to€the€petitionerððs€father.€Ð ç 7 ÐÌà  àThe€trial€court€concluded€that€if€trial€counsel€had€been€furnished€the€name€of€Ms.€Eady€atÐ ¹" !
