Ðshoulders€and€attempted€to€pull€the€gun€from€the€Defendantððs€hands€ð ðso€she€wouldnððt€try€to€shootÐ $X" Ðit€again.ðð€€Perkins€testified€that€a€struggle€ensued,€and€during€the€struggle,€the€victim€tripped€overÐ ô$D # Ðsome€shoes€in€the€living€room€floor€and€landed€on€his€knees.€€Perkins€stated€that€her€mother€was€stillÐ à%0!$ Ðstanding€at€this€point,€holding€the€barrel€of€the€gun€with€both€hands€and€with€her€fingers€on€theÐ Ì&"% Ðtrigger,€and€the€victim,€who€had€his€back€turned€toward€her€and€also€had€his€hands€on€the€barrel€ofÐ ¸'#& Ðthe€gun,€was€trying€to€pull€the€gun€away€from€his€head.€€Perkins€testified€that€as€the€victim€attemptedÐ ° Ðto€wrest€the€gun€from€the€Defendantððs€hands,€ð ðshe€shoved€[the€gun]€back€where€his€head€was€andÐ œì Ð.€.€.€the€gun€went€off.ðð€€She€testified€that€she€did€not€see€the€victimððs€finger€on€the€trigger€when€itÐ ˆØ Ðfired.€€Perkins€testified€that€she€next€saw€a€ð ðbig€flashðð€and€heard€ð ða€big€loud€noise,ðð€and€the€victimÐ tÄ Ðfell€backwards,€hitting€some€furniture€as€he€fell.€€Perkins€recalled€that€when€the€gun€fired,€she€wasÐ `° Ðð ðstanding€close€enough€.€.€.€for€the€bullet€to€ricochet€and€.€.€.€hitðð€her.€€€€Ð L œ ÐÌà  àPerkins€stated€that€her€mother€then€ð ðgot€up€acting€like€she€didnððt€know€what€to€doðð€and€wentÐ $ t Ðinto€an€adjoining€room€to€get€the€phone.€€Perkins€recalled€that€she€walked€to€the€victim€to€check€hisÐ  ` Ðpulse€and€heartbeat.€€She€stated€that€when€she€placed€her€head€on€the€victimððs€chest,€she€heard€faintÐ ü L  Ðheartbeat,€ð ðbut€it€was€going€down€slowly.ðð€€Perkins€reported€that€at€this€point,€the€Defendant€ð ðjerkedÐ è 8  Ð[her]€back€upðð€and€told€her€to€go€to€her€room,€where€she€waited€for€a€few€minutes€until€policeÐ Ô$  Ðarrived.€€She€recalled€that€she€then€climbed€out€of€her€bedroom€window€and€walked€to€the€sidewalk,Ð À  Ðwhere€a€police€officer€met€her€and€then€escorted€her€to€a€police€vehicle.Ð ¬ü  ÐÌà  àOn€cross„examination,€Perkins€testified€that€the€victim€ð ðprobablyðð€drank€beer€before€they€leftÐ „Ô  Ðtheir€home€to€go€eat€pizza.€€She€stated€that€her€mother€also€drank€beer€during€the€drive€to€theÐ pÀ Ðrestaurant€where€they€ate€dinner.€€She€recalled€that€the€victim€was€driving€at€the€time.€€PerkinsÐ \¬ Ðfurther€testified€on€cross„examination€that€she€recalled€telling€a€detective€that€the€victim€alwaysÐ H˜ Ðkicked€the€door,€resulting€in€a€hole€in€the€door,€instead€of€hitting€her€mother€ð ð[b]ecause€he€cared€forÐ 4„ Ðher€too€much.ðð€€€€€€€Ð  p ÐÌÓ  ÓII.€€FACTS€PRESENTED€AT€THE€SENTENCING€HEARINGÐ øH ÐÌÓ*Óà  àThe€Defendantððs€sentencing€hearing€was€conducted€on€October€15,€2001.€€The€followingÐ Ð  Ðevidence€was€presented€at€the€hearing:€Randy€Smith,€Director€of€Communications€for€LoudonÐ ¼  ÐCounty€911,€€testified€that€the€Defendant€was€an€employee€of€Loudon€County€911.€€However,€heÐ ¨ø Ðstated€that€she€resigned€her€position€after€testing€positive€for€marijuana€in€a€random€drug€screen.€Ð ”ä ÐAccording€to€personnel€records,€the€Defendant€requested€that€her€employer€grant€her€a€forty„five„day,Ð €Ð Ðunpaid€leave€of€absence€to€attend€a€drug€rehabilitation€program.€€The€records€also€indicated€that€theÐ l¼ ÐDefendant€agreed€that€if€she€were€granted€the€leave€of€absence,€she€would€subsequently€submit€toÐ X ¨ Ðmonthly€drug€screens€by€her€employer€for€an€undetermined€amount€of€time.€€Smith€testified€that€heÐ D!” Ðhad€no€knowledge€of€whether€the€Defendantððs€request€was€granted€because€these€events€took€placeÐ 0"€  Ðbefore€he€became€Director€of€Communications.€€He€reported,€however,€that€the€Defendant€resignedÐ #l! Ðher€position€on€March€8,€1999.€€Smith€testified€on€cross„examination€that€€personnel€recordsÐ $X" Ðindicated€that€the€Defendant€had€no€criminal€record.€€According€to€other€records,€the€DefendantÐ ô$D # Ðcompleted€and€became€certified€by€several€programs€designed€to€train€911€operators.Ð à%0!$ ÐÌà  àCaptain€James€B.€Long€of€the€Blount€County€Sheriffððs€Office€stated€that€he€acted€as€leadÐ ¸'#& Ðdetective€in€this€case.€€He€introduced€into€evidence€a€photograph€of€the€Defendant€standing€next€toÐ ¤(ô#' Ða€marijuana€plant€on€the€back€deck€of€the€residence€that€she€shared€with€the€victim.€€Long€stated€thatÐ )à$( Ðofficers€had€seized€the€photograph€from€the€home.€€He€testified€that€officers€had€also€seized€aÐ |*Ì%) Ðphotograph€of€the€Defendant,€the€victim,€and€possibly€the€Defendantððs€children€standing€next€toÐ h+¸&* Ðmarijuana€plants.€€In€addition,€Long€testified€that€one€of€the€investigators€working€on€the€case€foundÐ ° Ðat€least€one€potted€marijuana€plant€on€a€hill€behind€the€home€shared€by€the€Defendant€and€the€victim.€Ð œì ÐLong€further€testified€that€a€marijuana€plant€was€found€in€a€growing€unit€inside€the€home.€€He€statedÐ ˆØ Ðthat€he€had€no€knowledge€of€who€had€grown€the€plant.€€Finally,€he€testified€that€blood€testsÐ tÄ Ðperformed€on€both€the€Defendant€and€the€victim€detected€no€marijuana€in€either€individualððs€blood.€Ð `° ÐÌà  àOfficer€Jeff€Birchfield,€a€narcotics€officer€with€the€Blount€County€Sheriffððs€Office,€testifiedÐ 8 ˆ Ðthat€he€had€been€working€as€a€police€officer€for€thirteen€yearsÔ#†X!XXX!y #ÔÔ‡X!XXX!Ô€and€that€he€was€assigned€to€the€FifthÐ $ t ÐJudicial€Drug€Task€Force.€€He€identified€the€plants€shown€in€the€photographs€seized€from€theÐ  ` ÐDefendantððs€home€as€marijuana€plants.€€He€stated€that€the€plants€were€between€five€and€six€feet€inÐ ü L  Ðheight€and€estimated€that€the€plants€were€approximately€forty„five€days€old.€€He€also€testified€thatÐ è 8  Ðthe€plants€appeared€to€be€healthy€and€probably€had€been€given€some€type€of€extra€nutrient€toÐ Ô$  Ðencourage€their€growth.€€Birchfield€admitted€that€he€did€not€see€any€paraphernalia€or€view€the€plantsÐ À  Ðin€the€Defendantððs€home.€€He€also€stated€that€he€did€not€know€who€had€grown€the€plants.€€Ð ¬ü  ÐÌà  àSusan€Butler€Kneafsey€testified€that€she€was€the€victimððs€sister.€€She€stated€that€at€the€timeÐ „Ô  Ðof€the€sentencing€hearing,€she€was€living€in€Los€Angeles,€California,€where€she€had€resided€forÐ pÀ Ðshortly€over€two€years.€€Prior€to€living€in€Los€Angeles,€she€had€resided€in€Lake€Tahoe,€California,Ð \¬ Ðand€she€reported€that€she€was€living€in€Lake€Tahoe€at€the€time€of€her€brotherððs€death.€€KneafseyÐ H˜ Ðtestified€that€because€she€lived€out€of€town,€she€did€not€know€the€Defendant€well.€€However,€sheÐ 4„ Ðstated€that€she€ð ðdid€have€opportunity€to€witness€the€nature€of€[the]€relationshipðð€between€theÐ  p ÐDefendant€and€the€victim.€€She€explained€that€her€father€had€been€diagnosed€with€terminal€brainÐ  \ Ðcancer€approximately€a€year€before€her€brotherððs€death,€and€she€testified€that€after€her€fatherððsÐ øH Ðdiagnosis,€she€returned€home€at€least€every€other€month€and€spent€a€ð ðsignificant€amount€of€timeðð€atÐ ä4 Ðher€fatherððs€home.€€She€also€stated€that€she€spoke€with€her€family€on€the€phone€ð ða€minimum€ofÐ Ð  Ðprobably€every€couple€of€hours€every€day.ðð€€Ð ¼  ÐÌà  àKneafsey€testified€that€she€generally€saw€her€brother€several€times€during€each€of€her€tripsÐ ”ä Ðhome.€€She€stated€that€she€also€saw€the€Defendant€and€the€Defendantððs€children,€and€she€recalled€thatÐ €Ð Ðthe€Defendant€spent€several€holidays€with€her€family.€€Kneafsey€testified€that€she€and€her€familyÐ l¼ Ðwere€initially€unaware€that€the€Defendant€had€three€children,€although€the€Defendant€had€spentÐ X ¨ ÐThanksgiving€and€Christmas€at€her€familyððs€home.€€She€maintained€that€she€never€went€to€the€houseÐ D!” Ðthat€the€Defendant€shared€with€her€brother€because€she€ð ðwas€afraid€for€[her]€own€safety.ðð€€Ð 0"€  ÐÌà  àKneafsey€testified€that€she€became€aware€that€the€Defendant€and€the€victim€had€seriousÐ $X" Ðrelationship€problems€after€her€father€went€to€the€Mayo€Clinic€in€Rochester,€Minnesota€for€radiationÐ ô$D # Ðtreatments.€€She€stated€that€her€parents€ð ðbasically€moved€up€thereðð€for€the€duration€of€the€treatments,Ð à%0!$ Ðand€during€this€time,€the€victim€remained€in€Tennessee€to€help€take€care€of€his€parentsðð€house€andÐ Ì&"% Ðto€ð ðcoordinate€.€.€.€a€lot€of€the€details.ðð€€Kneafsey€maintained€that€her€brother€did€not€go€to€MinnesotaÐ ¸'#& Ðfor€Christmas€ð ðbecause€he€was€afraid€that€[the€Defendant]€was€going€to€destroy€.€.€.€a€lot€of€hisÐ ¤(ô#' Ðproperty.ðð€€She€further€testified€that€during€this€time,€the€Defendant€exhibited€ð ðextremely€jealousÐ )à$( Ðbehavior,ðð€and€she€stated€that€the€Defendant€did€not€want€the€victim€to€go€to€Minnesota€because€heÐ |*Ì%) Ðwould€ð ðbe€cheating€on€nurses€at€the€hospital.ðð€€Ð h+¸&* Їà  àKneafsey€testified€that€one€night€while€she€was€at€her€parentsðð€home,€the€victim€came€to€theÐ ° Ðhome€at€approximately€11:00€p.m.€with€his€two€dogs.€€According€to€Kneafsey,€the€victim€told€hisÐ œì Ðfamily€that€he€and€the€Defendant€had€had€an€argument€and€that€during€the€argument,€the€DefendantÐ ˆØ Ðð ðstarted€shooting€inside€the€house.ðð€€The€victim€reportedly€told€the€Defendant€that€he€was€ð ðgoing€outÐ tÄ Ðfor€some€woodðð€and€instead€put€the€dogs€into€his€car€and€left€the€home€before€the€Defendant€realizedÐ `° Ðthat€he€was€gone.€€Kneafsey€recalled€that€when€the€victim€arrived€at€their€family€home,€he€did€notÐ L œ Ðhave€dog€food€for€his€pets,€so€she€accompanied€him€to€the€grocery€store.€€Kneafsey€testified€thatÐ 8 ˆ Ðwhile€driving€to€the€store,€the€victim€told€her€that€their€family€ð ðdidnððt€know€the€half€of€the€violenceÐ $ t Ðthat€[the€Defendant]€had€committed€against€him.ðð€€Kneafsey€testified,€Ð  ` Ðà8  àHe€said€heððd€had€bottles€broken€over€his€head.€.€.€.€And€he€indicated€that€these€wereÐ ü L  Ðrepeated€incidents€.€.€.€.€€I€couldnððt€understand€why€he€was€still€staying€[in€the€houseÐ è 8  Ðwith€the€Defendant].€.€.€.€[H]e€seemed€to€feel€like€he€owed€[the€Defendant]€somethingÐ Ô$  Ðor€her€child€ð!ð€Iððm€not€sure€who€he€felt€the€obligation€to,€her€or€her€children,€to€notÐ À  Ðleave.€Ð¬ü Ð Ð  ÐÌà  àKneafsey€testified€that€her€brotherððs€death€ð ðwas€shocking€.€.€.€but€was€not€really€surprisingððÐ „Ô  Ðbecause€her€family€knew€that€the€Defendant€ð ðhad€already€been€shooting€at€[the€victim]€at€previousÐ pÀ Ðtimes€before.ðð€€She€maintained€that€prior€to€her€brotherððs€death,€the€Defendant€regularly€fired€shotsÐ \¬ Ðinside€the€home€shared€by€the€Defendant€and€the€victim.€€Kneafsey€recalled€that€after€learning€of€herÐ H˜ Ðbrotherððs€death,€she€flew€home€to€be€with€her€family.€€She€testified€that€after€she€returned€home,€theÐ 4„ ÐDefendant€called€her€parentsðð€house€from€jail,€crying€and€asking€for€their€help.€€Kneafsey€stated,€ð ðIÐ  p Ðwas€.€.€.€immediately€struck€by€the€fact€that€[the€Defendant]€was€one€hundred€percent€concernedÐ  \ Ðabout€herself€and€.€.€.€she€had€no€remorse€whatsoever€about€[the€victimððs]€death€and€[no]€concernÐ øH Ðabout€our€family.ðð€€Ð ä4 ÐÌà  àWhen€asked€how€the€victimððs€death€had€affected€her€family,€Kneafsey€responded,€ð ð[I]tÐ ¼  Ðcompletely€changed€the€dynamics€of€our€family.ðð€€She€also€stated€that€she€believed€that€her€brotherððsÐ ¨ø Ðdeath€hastened€her€fatherððs€subsequent€death.€€She€stated€that€shortly€after€her€brotherððs€death,€herÐ ”ä Ðfather€went€through€ð ðthe€most€dramatic€change€that€[she€had]€ever€seen€in€a€person.ðð€€She€recalledÐ €Ð Ðthat€her€father€stopped€speaking€and€began€to€use€a€wheelchair.€€Kneafsey€testified€that€her€motherÐ l¼ Ðhad€also€been€greatly€affected€by€the€victimððs€death.€€She€testified,€ð ðThe€stress€that€itððs€put€on€bothÐ X ¨ Ðmyself€and€my€mother€has€been€extremely€high.€.€.€.€The€shock€value€of€it€all€is€enough€in€itself€butÐ D!” Ðjust€trying€to€cope€with€everything,€itððs€been€difficult€to€say€the€least.ðð€€Finally,€she€reported€that€herÐ 0"€  Ðbrotherððs€death€had€placed€a€great€financial€burden€on€her€and€her€family€because€she€had€spent€aÐ #l! Ðð ðtremendous€amount€of€moneyðð€on€plane€tickets€from€California€and€on€babysitting€for€her€childrenÐ $X" Ðduring€the€trial.€€Ð ô$D # ÐÌà  àIn€closing,€Kneafsey€requested€that€the€Defendant€receive€the€maximum€penalty€possible€forÐ Ì&"% Ðher€crime.€€She€stated,€ð ðI€feel€that€given€[the€Defendantððs]€background€and€her€awareness€with€lawÐ ¸'#& Ðenforcement,€she€was€fully€aware€of€the€results€that€could€come€about€.€.€.€from€using€a€firearm€.€.Ð ¤(ô#' Ð.€in€a€home€setting€and€around€her€children€to€having€marijuana€in€the€home.ðð€€She€also€pointed€outÐ )à$( Ðthat€at€trial,€the€Defendant€had€admitted€to€drinking€ð ða€couple€of€Long€Island€Teaððs€[sic]ðð€when€sheÐ |*Ì%) Ðtook€her€children€to€dinner€at€a€bar.€€In€addition,€she€stated€that€although€the€Defendant€had€beenÐ h+¸&* Ðprescribed€medication€for€psychological€problems,€she€had€failed€to€take€her€medication€regularlyÐ ° Ðand€properly.€€Kneafsey€further€testified€that€she€believed€that€the€Defendantððs€ð ðactions€wereÐ œì Ðdeliberateðð€and€that€the€Defendant€had€a€ð ðviolent€nature.ðð€€She€stated€that€she€believed€that€theÐ ˆØ ÐDefendant€needed€to€be€separated€from€her€children€so€that€her€children€would€not€learn€domesticÐ tÄ Ðviolence€from€her.€€Ð `° ÐÌà  àOn€cross„examination,€Kneafsey€admitted€that€she€knew€that€her€brother€had€had€alcohol€andÐ 8 ˆ Ðdrug€problems€prior€to€his€death.€€She€maintained€that€she€ð ðhad€not€seen€any€evidence€of€a€drugÐ $ t Ðproblem€in€quite€a€while.ðð€€Kneafsey€reported,€however,€that€her€brother€had€been€convicted€inÐ  ` ÐKentucky€of€possession€of€marijuana.€€She€also€admitted€that€she€had€smoked€marijuana€with€herÐ ü L  Ðbrother€ð ðmany,€many€years€ago.ðð€€Kneafsey€stated€that€her€brother€told€her€that€he€drank€a€beer€orÐ è 8  Ðtwo€every€evening€before€the€Defendant€came€home€ð ðso€heððd€be€able€to€take€whatever€she€was€goingÐ Ô$  Ðto€dish€out.ðð€€However,€she€testified€that€she€did€not€know€the€extent€of€her€brotherððs€drinking€andÐ À  Ðtherefore€did€not€know€whether€he€had€an€alcohol€problem€while€he€was€living€with€the€Defendant.€Ð ¬ü  ÐÌà  àKneafsey€maintained€that€at€the€time€of€her€brotherððs€death,€her€brother€had€marks€on€hisÐ „Ô  Ðhead€from€being€beaten€by€the€Defendant.€€She€stated€that€at€the€time€of€his€death,€her€brother€wasÐ pÀ Ðð ðkind€of€going€through€the€motions€with€[the€Defendant]€but€he€was€secretly€planning€to€moveÐ \¬ Ðhome.ðð€€Kneafsey€testified€that€on€the€day€after€she€arrived€home€after€the€victimððs€death,€she,€herÐ H˜ Ðfamily,€and€a€friend€went€to€the€home€where€the€Defendant€and€the€victim€lived€and€retrievedÐ 4„ Ðpossessions€belonging€to€the€victim.€€Ð  p ÐÌà  àCarolyn€Butler,€the€victimððs€mother,€testified€that€her€son€was€thirty„one€years€old€at€the€timeÐ øH Ðof€his€death.€€Butler€stated€that€she€met€the€Defendant€a€short€time€before€the€Defendant€and€theÐ ä4 Ðvictim€moved€in€together.€€She€reported€that€the€Defendant€and€her€son€often€visited€her€home.€Ð Ð  ÐHowever,€she€stated€that€she€never€went€to€their€home€because€she€ð ðdid€not€approve€of€them€livingÐ ¼  Ðtogether€out€of€wedlock.ðð€€Butler€testified€that€the€Defendant€spent€Christmas€1997€with€the€ButlerÐ ¨ø Ðfamily.€€She€also€testified€that€the€Defendant€lived€at€her€home€for€at€least€two€weeks€while€she€wasÐ ”ä Ðsearching€for€jobs€in€Knoxville;€Butler€stated€that€the€Defendant€stayed€in€her€home€until€Butler€toldÐ €Ð Ðher€son€that€ð ðit€was€time€for€[the€Defendant]€to€get€out.ðð€€Butler€testified€that€while€the€DefendantÐ l¼ Ðwas€living€with€her,€the€Defendant€never€mentioned€her€children,€and€Butler€was€therefore€unawareÐ X ¨ Ðthat€the€Defendant€had€children.Ð D!” ÐÌà  àButler€testified€that€the€Defendant€was€ð ðvery€controlling€verbally€and€physicallyðð€with€herÐ #l! Ðson.€€She€recalled€that€on€more€than€one€occasion€when€her€son€came€to€her€house€to€mow€theirÐ $X" Ðlawn,€a€process€which€Butler€stated€took€three€hours,€the€Defendant€called€their€home€after€the€victimÐ ô$D # Ðhad€been€there€for€fifteen€minutes,€and€the€victim€then€went€home,€saying,€ð ðI€[sic]€better€go€home,Ð à%0!$ ÐIððm€already€in€trouble.ðð€€Butler€also€testified€that€her€son€would€not€visit€her€house€without€theÐ Ì&"% ÐDefendantððs€permission.€€Ð ¸'#& ÐÌà  àButler€recalled€that€on€one€occasion,€while€the€victim€was€visiting€her€home,€he€began€cryingÐ )à$( Ðand€told€her€that€the€Defendant€had€hit€him€across€his€shins€with€a€baseball€bat.€€According€to€Butler,Ð |*Ì%) Ðthe€victim€told€her€that€he€had€to€leave€work€because€he€was€in€such€pain.€€Butler€claimed€that€sheÐ h+¸&* Ðsaw€her€sonððs€injuries;€she€specified€that€his€shins€looked€reddish€and€bruised€and€that€ð ðhis€shinsÐ ° Ðlooked€dented€in€the€front.ðð€€Butler€recalled€that€on€other€occasions,€her€son€had€a€black€eye€and€aÐ œì Ðgash€on€his€forehead,€but€he€did€not€explain€to€her€how€he€became€injured.€€Ð ˆØ ÐÌà  àButler€testified€that€on€another€occasion€when€the€victim€visited€her€home,€he€was€very€upsetÐ `° Ðbecause€the€Defendant€ð ðwas€shooting€up€the€house.ðð€€According€to€Butler,€the€victim€said,€ð ðIððmÐ L œ Ðrunning€out€of€money€to€repair€things,€I€canððt€get€them€all€repaired€at€one€time.ðð€€Upon€his€fatherððsÐ 8 ˆ Ðrequest,€the€victim€later€took€photographs€of€the€home€that€he€shared€with€the€Defendant.€€A€coupleÐ $ t Ðof€days€after€their€conversation€and€a€couple€of€weeks€before€his€death,€the€victim€brought€a€roll€ofÐ  ` Ðfilm€to€his€parentsðð€home€and€put€it€in€a€cabinetÔ#†X!XXX!ó5#Ô,€stating,€ð ð[I]f€you€need€this,€here€it€is.ðð€€Butler€statedÐ ü L  Ðthat€after€her€sonððs€death,€she€remembered€the€undeveloped€roll€of€film€and€gave€it€to€Captain€Long.Ð è 8  ÐÌà  àButler€testified€that€over€a€period€of€a€couple€of€weeks,€the€victim€brought€some€of€hisÐ À  Ðpersonal€belongings€which€were€ð ðinvaluable€to€himðð€to€his€parentsðð€home€to€prevent€them€fromÐ ¬ü  Ðbeing€destroyed.€€She€recalled€that€the€victim€also€told€his€parents€that€he€was€ð ðlooking€at€propertyÐ ˜è  Ðin€Anderson€Countyðð€and€that€he€did€not€want€to€tell€the€Defendant€that€he€ð ðwas€planning€to€comeÐ „Ô  Ðhome.€.€.€.€until€he€got€ready€to€leave.ðð€€She€explained€that€the€victim€loved€the€Defendantððs€children,Ð pÀ Ðtook€care€of€them€most€of€the€time,€and€ð ðwanted€to€make€sure€the€children€were€taken€care€of€beforeÐ \¬ Ðhe€left.ðð€€Butler€testified€that€on€the€day€prior€to€his€death,€the€victim€told€his€parents€that€he€ð ðwouldÐ H˜ Ðbe€home€the€next€day.ðð€€She€stated,€ð ð[H]is€dad€and€I€thought€he€told€[the€Defendant]€and€that€thatððsÐ 4„ Ðwhy€she€killed€him.€€Because€she€told€him€that€if€he€ever€tried€to€leave€her,€that€she€would€kill€him.€Ð  p ÐAnd€she€said€that€on€numerous€occasions.ðð€€She€further€testified€that€her€son€repeatedly€told€her€andÐ  \ Ðhis€father€that€the€Defendant€had€threatened€his€life€and€that€he€was€afraid€of€her.€€Ð øH ÐÌà  àButler€reported€that€the€victimððs€death€was€ð ðdevastatingðð€to€the€victimððs€father.€€She€statedÐ Ð  Ðthat€after€the€victim€died,€her€husband€ð ðwent€downhillðð€and€was€forced€to€begin€using€a€wheelchair.Ð ¼  ÐShe€stated€that€her€husband€simply€ð ðcouldnððt€cope€with€[the€victimððs]€death.ðð€€Ð ¨ø ÐÌà  àButler€testified€that€she€was€aware€that€the€victim€had€had€problems€with€alcohol.€€She€statedÐ €Ð Ðthat€he€went€through€alcohol€treatment€at€the€University€of€Tennessee.€€She€also€reported€that€sheÐ l¼ Ðand€her€husband€became€very€involved€with€Al„Anon€for€four€years.Ð X ¨ ÐÌà  àFinally,€Butler€testified€that€she€believed€the€Defendant€was€ð ðmeanðð€and€ð ðself„centered.ðð€€SheÐ 0"€  Ðstated,€ð ðShe€doesnððt€even€appear€to€care€for€her€kids€except€when€itððs€saving€her€life.€€Sheððs€neverÐ #l! Ðbeen€remorseful€to€me€or€my€family€at€all.ðð€€She€further€testified€that€if€the€Defendant€did€not€serveÐ $X" Ðtime€in€jail,€she€feared€that€the€Defendant€might€harm€her€own€child,€Natasha€Perkins,€who€testifiedÐ ô$D # Ðagainst€her€at€trial.€€She€maintained€that€Perkins€was€afraid€of€her€mother.€€Ð à%0!$ ÐÌà  àOn€cross„examination,€Butler€stated€that€she€knew€that€her€son€had€a€severe€alcohol€problemÐ ¸'#& Ðand€that€during€the€five€years€prior€to€his€death,€he€had€a€problem€with€marijuana.€€She€stated€thatÐ ¤(ô#' Ðhe€entered€into€treatment€and€that€the€treatment€worked€for€ð ðquite€a€while,ðð€but€ultimately€her€sonÐ )à$( Ðbegan€to€have€problems€again.€€She€further€testified€that€the€Defendant€threatened€to€ð ðturn€him€inððÐ |*Ì%) Ðfor€a€violation€of€his€probation€for€his€drug„related€conviction€if€he€left€her.€€Ð h+¸&* Їà  àFollowing€Carolyn€Butlerððs€testimony,€Captain€Long€was€recalled€to€the€stand.€€He€identifiedÐ ° Ðphotographs€developed€from€the€roll€of€film€that€was€given€to€him€by€Carolyn€Butler.€€He€stated€thatÐ œì Ðthe€photographs€depicted€ð ðholes€in€different€places€of€the€wall€in€the€residenceðð€shared€by€the€victimÐ ˆØ Ðand€the€Defendant.€€Long€testified€that€a€ð ðspent€round€of€a€bulletðð€was€found€underneath€or€near€theÐ tÄ Ðbed€in€the€master€bedroom€inside€the€residence.€€He€also€recalled€that€he€saw€what€appeared€to€beÐ `° Ða€bullet€hole€in€the€wall€across€from€the€bed.€€Long€admitted€that€he€did€not€know€how€the€holes€inÐ L œ Ðthe€wall€were€made€and€that€he€did€not€know€when€the€photographs€on€the€roll€of€film€were€taken.€Ð 8 ˆ ÐÌà  àThe€Defendant€testified€that€she€was€thirty„two€years€old€and€that€she€was€living€in€KentuckyÐ  ` Ðat€the€time€of€the€hearing.€€She€reported€that€she€had€three€children:€two€girls,€age€twelve€and€ten,Ð ü L  Ðand€a€boy,€age€eight.€€She€stated€that€she€became€divorced€from€Stacy€Donovan€Perkins,€the€fatherÐ è 8  Ðof€her€two€girls,€in€July€or€August€1991.€€She€stated€that€her€former€husband€did€not€want€to€payÐ Ô$  Ðchild€support,€so€they€engaged€in€a€custody€battle.€€As€a€result,€her€husband€retained€custody€of€herÐ À  Ðoldest€child,€while€she€retained€custody€of€her€youngest€two€children.€€She€stated,€ð ðIððve€raised€myÐ ¬ü  Ðchildren€by€myself€for€the€last€10€years,ðð€and€specified€that€at€the€time€of€the€victimððs€death,€she€hadÐ ˜è  Ðall€of€her€children€with€her.€€She€explained€that€two€of€her€three€children,€however,€were€away€atÐ „Ô  Ðchurch€camp.€€The€Defendant€maintained€that€Carolyn€Butler€knew€that€the€Defendant€had€childrenÐ pÀ Ðat€the€time€she€moved€in€with€the€victim.€€She€claimed€that€when€she€told€Butler€about€her€children,Ð \¬ ÐButler€told€the€Defendant€that€the€victimððs€grandmother€did€not€need€to€know€about€the€children.€€Ð H˜ Ѐ€Ìà  àThe€Defendant€maintained€that€she€had€never€been€unemployed.€€She€stated€that€at€the€timeÐ  p Ðof€the€crime€in€this€case,€she€was€employed€by€the€Anderson€County€Sheriffððs€Department€as€anÐ  \ Ðofficer€in€the€detention€center.€€She€stated€that€prior€to€the€crime,€her€supervisors€were€consideringÐ øH Ðmoving€her€into€ð ðtransportation,ðð€which€she€explained€was€a€job€promotion.€€She€testified€that€sheÐ ä4 Ðeventually€hoped€to€ð ðwork€up€into€the€detective€sectionðð€and€then€attend€law€school.€€She€alsoÐ Ð  Ðtestified€that€her€performance€evaluations€with€the€Anderson€County€Sheriffððs€Department€wereÐ ¼  Ðð ðnormal.ðð€€She€stated€that€she€was€very€ð ðenthusiasticðð€about€her€work.Ð ¨ø ÐÌà  àThe€Defendant€testified€that€prior€to€her€employment€with€the€Anderson€County€SheriffððsÐ €Ð ÐDepartment,€she€was€employed€by€the€Loudon€County€Sheriffððs€Department€dispatch€center.€€SheÐ l¼ Ðclaimed€that€she€resigned€from€her€position€there€because€she€and€the€victim€were€looking€for€landÐ X ¨ Ðin€Anderson€County€where€they€could€live,€and€she€heard€that€the€Anderson€County€SheriffððsÐ D!” ÐDepartment€was€ð ðdesperate€for€people€and€.€.€.€paid€quite€a€bit€more.ðð€€She€maintained€that€whileÐ 0"€  Ðemployed€in€Loudon€County,€she€received€letters€from€families€whom€she€had€helped;€she€stated,Ð #l! Ðð ð[T]hey€were€touched€by€the€concern€I€had€for€them,€the€time€that€I€spent€with€them.ðð€€TheÐ $X" ÐDefendant€admitted€that€she€failed€a€drug€screen€by€testing€positive€for€marijuana€during€herÐ ô$D # Ðemployment€in€Loudon€County.€€However,€she€stated€that€she€was€ð ðshockedðð€and€ð ðupsetðð€when€sheÐ à%0!$ Ðlearned€of€the€test€results.€€She€stated€that€at€the€time€she€learned€the€results,€she€had€already€appliedÐ Ì&"% Ðfor€a€job€in€Anderson€County€and€had€resigned€from€her€position€in€Loudon€County.€€She€stated€thatÐ ¸'#& Ðshe€learned€about€her€drug€screen€results€when€she€went€to€the€supervisor€for€her€Loudon€CountyÐ ¤(ô#' Ðposition€to€inquire€about€returning€to€her€job€there.€€According€to€the€Defendant,€her€supervisor€toldÐ )à$( Ðher€that€she€would€be€allowed€a€second€test€or€that€she€could€attend€a€rehabilitation€program.€€TheÐ |*Ì%) Ðsupervisor€also€told€the€Defendant€that€her€test€results€would€be€kept€confidential.€€Ð h+¸&* ЀÌà  àThe€Defendant€testified€that€prior€to€working€as€a€dispatcher€in€Loudon€County,€she€workedÐ œì Ðthree€jobs€for€a€short€time.€€She€stated€that€she€was€employed€by€Baileyððs€Sports€Bar,€by€Goodyððs,Ð ˆØ Ðand€by€Now€AudioVideo.€€She€testified€that€she€worked€three€jobs€to€support€her€children.€€SheÐ tÄ Ðreported€that€during€this€time,€the€father€of€her€oldest€two€girls€was€paying€$200€per€month€in€childÐ `° Ðsupport,€and€the€father€of€her€youngest€child€was€not€paying€child€support€because€he€had€beenÐ L œ Ðunemployed€for€some€time.€€Ð 8 ˆ ÐÌà  àThe€Defendant€testified€that€she€was€previously€employed€for€almost€three€years€as€a€911Ð  ` Ðcommunications€officer€for€the€Corbin€City€Police€in€Kentucky.€€She€stated€that€she€resigned€fromÐ ü L  Ðher€position€there€after€the€victim€was€arrested€in€Kentucky€for€a€drug„related€charge€because€sheÐ è 8  Ðð ðdidnððt€want€the€controversy€to€come€back€onðð€her€department.€€The€Defendant€stated€that€to€becomeÐ Ô$  Ðaccredited€as€a€911€operator€in€Kentucky,€she€attended€ð ðthe€academyðð€at€Eastern€KentuckyÐ À  ÐUniversity.€€She€testified€that€she€had€also€trained€and€worked€as€a€firefighter€and€as€an€emergencyÐ ¬ü  Ðmedical€technician.€€In€addition,€she€reported€that€she€had€taken€continuing€education€courses.€Ð ˜è  ÐFinally,€the€Defendant€stated€that€she€attended€Cumberland€College€until€the€second€semester€of€herÐ „Ô  Ðsophomore€year€and€that€she€worked€on€campus€while€there.€€Ð pÀ ÐÌà  àThe€Defendant€testified€that€when€she€met€the€victim€in€1992,€she€was€dating€one€of€hisÐ H˜ Ðfriends.€€She€recalled€that€the€victim€asked€her€for€her€phone€number€on€the€first€night€that€they€metÐ 4„ Ðand€began€calling€her.€€She€testified€that€she€later€moved€in€with€the€victim€and€lived€with€him€forÐ  p Ðsixteen€to€eighteen€months€before€his€death.€€The€Defendant€stated€that€she€became€aware€that€theÐ  \ Ðvictim€had€a€trust€fund€prior€to€the€time€that€she€and€the€victim€began€living€together.€€However,€sheÐ øH Ðmaintained€that€she€and€the€victim€never€discussed€his€trust€fund€while€they€lived€together,€and€sheÐ ä4 Ðclaimed€that€she€had€no€idea€how€much€money€he€received€from€the€fund.€€She€denied€staying€withÐ Ð  Ðthe€victim€because€of€his€money.€€Ð ¼  ÐÌà  àThe€Defendant€testified€that€she€first€became€aware€that€the€victim€had€a€problem€with€drugsÐ ”ä Ðwhen€they€first€began€to€live€together,€although€she€admitted€that€she€was€previously€aware€that€theÐ €Ð Ðvictim€had€been€arrested€on€a€drug€charge€in€Kentucky.€€She€recalled€that€while€she€and€the€victimÐ l¼ Ðwere€living€together,€ð ðpeople€were€showing€up€at€[their]€house€with€more€gold€teeth€than€[she€had]Ð X ¨ Ðever€owned€in€[her]€life.ðð€€She€also€stated,€ð ð[The€victim]€kept€waking€me€up€at€5:00€in€the€morningÐ D!” Ðthinking€the€newspaper€man€was€the€police.€€And€he€took€my€sonððs€ambulance€(phonetic)€apartÐ 0"€  Ðbecause€it€had€baby€powder€in€it.€€And€when€I€asked€him€what€was€going€on,€he€stated€to€me€thatÐ #l! Ðheððd€spent€over€$20,000€on€crack€cocaine.ðð€€She€testified€that€after€she€offered€for€the€victim€to€Ð $X" Ðmove€away€with€her,€the€victim,€to€the€best€of€her€knowledge,€ð ðdropped€it€cold€turkey.ðð€€TheÐ ô$D # ÐDefendant€denied€ingesting€crack€cocaine€herself.€€She€testified€that€during€this€period€of€time,€theÐ à%0!$ Ðvictim€worked€at€several€places,€including€a€Burger€King€Exxon,€a€Dairy€Mart€Queen,€andÐ Ì&"% ÐAudioVideo€Now.Ð ¸'#& ÐÌà  àThe€Defendant€maintained€that€the€victim€and€his€friend,€Mike€Kelly,€grew€the€marijuanaÐ )à$( Ðplants€shown€in€the€photographs€obtained€from€her€home,€and€she€denied€any€involvement€in€buyingÐ |*Ì%) Ðor€planting€the€plants.€€She€stated€that€the€victim€and€Kelly€began€the€project€together€with€seedsÐ h+¸&* Ðsaved€over€the€years€and€were€very€excited€about€growing€the€plants.€€The€Defendant€testified€thatÐ ° Ðas€the€plants€grew€larger,€she€became€afraid,€so€the€victim€bought€other€plants€to€place€on€their€deckÐ œì Ðalongside€the€marijuana€plants.€€She€stated€that€the€victim€asked€her€to€take€a€picture€of€him€next€toÐ ˆØ Ðhis€marijuana€plant,€which€she€did,€and€that€he€then€asked€to€take€her€photograph€beside€the€plant.€Ð tÄ ÐThe€Defendant€stated€that€during€the€time€that€the€victim€began€growing€the€plants,€her€children€wereÐ `° Ðnot€living€with€them,€but€when€it€became€time€for€the€children€to€live€with€them,€she€became€afraid.€Ð L œ ÐShe€also€stated€that€she€was€frightened€that€someone€would€see€the€plants,€which€were€then€six€orÐ 8 ˆ Ðseven€feet€tall,€on€their€deck.€€Ð $ t ÐÌà  àThe€Defendant€reported€that€one€evening,€she€and€the€victim€were€arguing€about€the€plantsÐ ü L  Ðwhen€her€father€called.€€She€recalled€that€she€was€ð ðupset,€crying,€hysterical,ðð€and€her€father€came€toÐ è 8  Ðtheir€house.€€She€testified€that€when€he€arrived,€she€showed€her€father€a€marijuana€plant,€and€herÐ Ô$  Ðfather€told€the€victim€to€ð ðget€rid€of€it€because€the€police€would€probably€be€coming.ðð€€According€toÐ À  Ðthe€Defendant,€the€victim€threw€ten€or€fifteen€marijuana€plants€over€the€side€of€their€deck€into€someÐ ¬ü  ÐEnglish€ivy.€€The€Defendant€stated€that€after€this€incident,€the€victim€stopped€smoking€marijuana€andÐ ˜è  Ðtaking€ð ðpills.ðð€€She€testified€that€he€also€stopped€allowing€friends€to€smoke€marijuana€inside€theirÐ „Ô  Ðhome.€€Ð pÀ ÐÌà  àThe€Defendant€explained€that€the€victim€had€never€used€the€grow€unit€found€inside€theirÐ H˜ Ðhome.€€She€stated€that€the€victim€got€it€from€a€friendððs€house,€and€she€reported€that€she€had€no€ideaÐ 4„ Ðthat€plants€were€inside€the€unit€because€the€unit€stayed€closed.€€She€admitted,€however,€that€shortlyÐ  p Ðprior€to€his€death,€the€victim€began€to€grow€marijuana€plants€in€their€attic.€€She€stated€that€she€toldÐ  \ Ðhim€that€she€did€not€like€the€plants€being€inside€her€home€because€she€was€a€police€officer€with€theÐ øH ÐBlount€County€Sheriffððs€Department,€and€she€reported€that€she€threw€all€of€the€plants€over€the€deckÐ ä4 Ðof€their€home.€€She€stated,€ð ðIf€I€had€any€idea€that€[the€grow€unit€contained]€.€.€.€three€to€fiveÐ Ð  Ðmarijuana€plants,€it€wouldððve€went€over€the€deck€.€.€.€with€the€other€20€that€I€threw€over€the€deckÐ ¼  Ðwhen€I€found€them.ðð€€Ð ¨ø ÐÌà  àThe€Defendant€testified€that€during€her€relationship€with€the€victim,€the€victim€ð ðmade€.€.€.Ð €Ð Ðremark[s]€about€killing€himself€quite€a€bit.ðð€€She€stated€that€he€was€depressed€about€his€father.€€SheÐ l¼ Ðtestified,€ð ðWhen€he€would€get€intoxicated,€he€would€get€angry.€€He€would€rip€his€shirts€.€.€.€.€€HeÐ X ¨ Ðwould€sit€on€the€bed€with€his€fists€clinched€[sic].€€His€eyes€would€be€bulging,€he€would€be€red€allÐ D!” Ðover.€€I€.€.€.€have€never€been€around€anything€like€that€and€I€didnððt€find€out€until€after€all€thisÐ 0"€  Ðhappened€that€due€to€his€excessive€use€over€the€years€that€he€may€have€done€some€damage.ðð€€Ð #l! ÐÌà  àThe€Defendant€denied€shooting€at€the€victim€inside€their€home.€€She€stated€that€only€twoÐ ô$D # Ðshots€were€fired€inside€the€home,€one€on€the€night€that€the€victim€died€and€another€shot€that€was€firedÐ à%0!$ Ðaccidentally.€€The€Defendant€explained€that€on€an€occasion€when€the€victim€was€drinking,€he€wasÐ Ì&"% Ðattempting€to€show€the€Defendant€how€to€clean€her€shotgun,€which,€unbeknownst€to€them,€wasÐ ¸'#& Ðloaded,€and€the€gun€discharged.€€She€also€stated€that€there€were€a€couple€of€holes€in€the€home€sheÐ ¤(ô#' Ðshared€with€the€victim€when€they€moved€in.€€The€Defendant€further€testified€that€she€had€neverÐ )à$( Ðâ âbroken€a€bottle€over€the€victimððs€head.€In€addition,€she€denied€hitting€the€victim€with€a€baseball€bat.€Ð |*Ì%) ÐFinally,€she€denied€giving€the€victim€ð ða€black€eye.ðð€€She€stated€that€to€her€knowledge,€the€victim€wasÐ ° Ðnever€afraid€of€her.Ð œì Ðâ  Ð ˆØ Ðà  àWith€regard€to€the€victimððs€injuries,€the€Defendant€testified€as€follows:€€Ð tÄ Ðà8  à[The€victim]€had€many€accidents€from€his€alcohol€intake,€him€burning€his€hands€atÐ `° Ðtimes,€he€refused€to€go€to€the€hospital.€€He€would€.€.€.€have€cuts€and€bruises€whereÐ L œ Ðheððd€fall.€€He€would€jump€up€on€the€steps€and€miss€the€steps€sometimes€when€he€wasÐ 8 ˆ Ðout€cooking€on€the€grill.Ð$ tÐ Ð  Ðà8  à.€.€.€.Ð `Ð Ð  Ðà8  àà ` àThe€swollen€foot€where€he€couldnððt€get€his€boot€fastened€had€nothing€to€doÐ ü L  Ðat€all€with€a€baseball€bat.€€He€had€stepped€on€a€[sewing]€needle€that€had€broken€offÐ è 8  Ðin€his€foot€and€it€kept€getting€worse€and€worse€and€worse.€€His€foot€was€swollen€andÐ Ô$  Ðthe€infection€was€terrible.€€I€thought€it€was€a€piece€of€glass€.€.€.€.€€He€was€pushing€onÐ À  Ðit€one€day€and€it€was€so€infected€that€when€it€pushed€on€it,€the€needle€just€popped€out.€Ð ¬ü  ÐAnd€thatððs€how€we€found€out€what€it€was.€Ð˜è Ð Ð  ÐÌ€à  àThe€Defendant€denied€that€she€attempted€to€isolate€the€victim€from€others.€€She€stated€thatÐ pÀ Ðshe€and€the€victim€had€two€phone€lines€in€their€home,€and€she€explained€that€the€victimððs€sister€oftenÐ \¬ Ðcalled€their€home€on€their€computer€line,€which€was€connected€to€an€answering€machine.€€TheÐ H˜ ÐDefendant€stated€that€they€did€not€often€check€the€answering€machine€for€messages.€€The€DefendantÐ 4„ Ðalso€testified€that€the€victim€had€an€associates€degree€in€business€administration,€and€she€hated€toÐ  p Ðsee€him€ð ðwasting€a€degree.ðð€€She€stated€that€she€encouraged€him€to€work€and€compiled€resumes€forÐ  \ Ðhim.€€Ð øH ÐÌà  àThe€Defendant€denied€trying€to€control€the€victim.€€She€testified,€Ð Ð  ÐÌà8  à[The€victim]€was€a€grown€man.€[The€victim]€could€make€his€own€decisions.€€TheÐ ¨ø Ðonly€thing€that€I€would€even€come€close€to€saying€that€I€tried€to€control€him€on€is€IÐ ”ä Ðwould€try€very€hard€to€give€him€advice€and€support€to€become€a€better€person,Ð €Ð Ðbecause€his€indication€to€me€was€that€he€had€never€had€that€support,€that€he€had€hadÐ l¼ Ðit€for€short€periods€of€time€and€then€it€would€be€ignored.ÐX ¨Ð Ð  ÐThe€Defendant€could€not€recall€calling€the€victimððs€parentsðð€home€while€the€victim€was€mowing€hisÐ D!” Ðparentsðð€grass.€€She€stated€that€she€telephoned€the€victimððs€parents€on€one€occasion€because€sheÐ 0"€  Ðwanted€the€victim€to€pick€up€bread€on€his€way€home.€€She€stated€that€she€also€called€their€homeÐ #l! Ðseveral€times€on€another€occasion.€€She€explained€that€the€victim€had€begun€to€break€belongings€ofÐ $X" Ðhers,€and€she,€in€turn,€broke€his€lava€lamp.€€The€Defendant€reported€that€after€their€argument,€theÐ ô$D # Ðvictim€ð ðimmediately€became€submissive€and€started€apologizing€.€.€.€,€went€out€and€picked€someÐ à%0!$ Ðflowers,€and€[she]€told€him€.€.€.€that€if€he€ever€did€anything€like€that€again€that€[she]€was€going€toÐ Ì&"% Ðcontact€his€parents.ðð€€She€testified,€Ð ¸'#& Ðà8  àI€didnððt€know€the€situation€at€the€time.€€I€thought€I€could.€€And€that€they€would€beÐ ¤(ô#' Ðaware€of€his€problem€and€would€understand€what€I€was€dealing€with€but€that€I€wouldÐ )à$( Ðâ âcall€the€police€first€and€have€him€picked€up,€and€as€soon€as€he€was€picked€up,€I€wouldÐ |*Ì%) Ðcall€them€and€tell€them€that€I€loved€him€but€I€couldnððt€handle€the€situation€anymoreÐ ° Ðand€that€I€needed€help.МìÐ Ð  Ðâ âThe€Defendant€claimed€that€the€victim€then€ð ðgot€some€guns€down[,]€put€some€shells€in€his€bookÐ ˆØ Ðbag,ðð€and€told€her€that€if€she€called€any€of€her€ð ðcop€buddies€.€.€.€,€heððd€go€up€in€the€woods€and€shootÐ tÄ Ðthem€down.ðð€€The€Defendant€testified€that€after€this€incident,€the€victim€took€some€of€his€personalÐ `° Ðbelongings€to€his€parentsðð€home€because€she€had€broken€his€lava€lamp.€€She€stated€that€the€victimÐ L œ Ðtold€her€that€ð ðhe€was€afraid€[she]€was€going€to€break€something€else€of€his.ðð€€Ð 8 ˆ Ѐ€€€€€€€€€€€€€€€€€€€€€€Ð $ t Ðà  àWith€regard€to€the€victimððs€drinking€habits,€the€Defendant€testified€that€she€generally€found€Ð  ` Ðtwo€and€a€half€empty€beer€cans€hidden€beside€the€refrigerator€and€that€the€victim€was€usually€holdingÐ ü L  Ða€half„full€glass€of€beer€when€she€went€into€the€kitchen€in€the€mornings.€€The€Defendant€maintainedÐ è 8  Ðthat€the€victim€drank€all€day€long,€but€did€not€drink€a€lot€at€a€time€until€the€evenings.€€She€reportedÐ Ô$  Ðthat€during€dinner,€the€victim€began€to€drink€more€and€often€became€ð ða€little€bit€obnoxiousðð€aroundÐ À  Ðthe€time€that€her€children€had€finished€their€meals.€€The€Defendant€stated€that€at€this€time€duringÐ ¬ü  Ðdinner,€she€usually€sent€her€children€away€so€that€they€would€not€see€the€victim€in€an€intoxicatedÐ ˜è  Ðstate.€€She€testified€that€approximately€thirty€to€forty„five€minutes€later,€the€victim€usually€fell€asleepÐ „Ô  Ðin€a€chair,€and€she€then€awakened€him€and€helped€him€into€bed.Ð pÀ ÐÌà  àWhen€asked€whether€the€victim€was€planning€to€leave€her€at€the€time€of€his€death,€theÐ H˜ ÐDefendant€responded,€ð ðI€asked€[the€victim]€to€go€home.€€I€asked€[him]€to€get€an€apartment.€€I€said,Ð 4„ ÐððYouððve€got€the€money,€if€youððre€going€to€spend€it,€get€you€an€apartment€and€letððs€work€this€out€fromÐ  p Ða€distance.€€Iððll€go€homeðð.€.€.€.€€He€said€he€couldnððt€go€home,€his€mom€and€dad€would€never€agreeÐ  \ Ðwith€what€he€did.ðð€€Ð øH ÐÌà  àThe€Defendant€testified€that€she€knew€she€would€not€marry€or€have€a€lasting€relationship€withÐ Ð  Ðthe€victim,€but€she€ð ðloved€him€very€much€as€a€friend€and€.€.€.€wanted€very€much€to€help€him€betterÐ ¼  Ðhimself.ðð€€With€regard€to€accusations€by€the€victimððs€family€that€she€was€not€remorseful€about€theÐ ¨ø Ðvictimððs€death,€the€Defendant€testified,€ð ðI€donððt€know€what€the€definition€of€remorse€is€but€I€wentÐ ”ä Ðstraight€home€to€my€parents,€that€I€couldnððt€get€out€for€three€months,€I€couldnððt€talk€to€nobody€[sic].€Ð €Ð ÐI€slept€in€a€bedroom€with€every€light€including€the€overhead€light€on.€€I€had€nightmares€about€[theÐ l¼ Ðvictim].€€I€miss€him€still€today.ðð€€She€testified€that€she€kept€a€picture€of€the€victim€in€her€Bible€andÐ X ¨ Ðthat€she€ð ðtalk[ed]€to€him€every€day.ðð€€She€stated€that€she€called€the€victimððs€family€following€herÐ D!” Ðarrest€because€her€family€was€in€North€Carolina€and€because€the€Butlers€were€ð ðlike€familyðð€to€her.€Ð 0"€  ÐShe€also€stated€that€she€did€not€call€the€victimððs€family€again€because€they€told€her€ð ðnever€to€callÐ #l! Ðbackðð€and€because€her€lawyer€told€her€that€they€ð ðmay€misconstrue€what€[she]€said€to€them.ððÐ $X" ÐÌà  àWhen€asked€what€her€role€was€in€the€shooting€death€of€the€victim,€the€Defendant€stated,€ð ðIÐ à%0!$ Ðwish€Iððd€never€told€him€I€was€leaving€that€day.€€I€wished€Iððd€have€never€had€my€gun€around€him€evenÐ Ì&"% Ðthough€it€was€normal.€€I€wished€Iððd€have€never€let€him€get€the€gun€away€from€me.ðð€€She€also€statedÐ ¸'#& Ðthat€she€wished€she€had€not€had€the€gun€ð ðaround€[the€victim]€at€all.ðð€€The€Defendant€further€testified,Ð ¤(ô#' Ðð ðI€feel€like€itððs€my€fault€because€if€I€hadnððt€told€him€I€was€leaving,€then€maybe€he€wouldnððt€have€hadÐ )à$( Ðone€of€his€little€fits,€try€to€get€my€attention€.€.€.€.€and€that€wouldnððt€have€happened.ððÐ |*Ì%) ÐÐ h+¸&* Ðà  àFinally,€the€Defendant€testified€that€since€the€victimððs€death,€she€and€her€children€hadÐ ° Ðsuffered.€€She€stated,€ð ðIððve€spent€two€years€without€my€kids€and€Iððve€not€done€anything€wrong.ðð€€SheÐ œì Ðalso€stated,€ð ð[The€victim]€deserved€a€whole€lot€better€than€what€happened.ðð€€€When€asked€what€sheÐ ˆØ Ðwould€like€to€say€to€the€victimððs€family,€she€stated,€ð ðI€would€only€tell€them€that€Iððm€sorry€about€[theÐ tÄ Ðvictim].€€Iððm€sorry€I€couldnððt€fix€him.€€Iððm€sorry€I€couldnððt€help€him.ðð€€She€admitted€that€she€wasÐ `° Ðguilty€of€a€crime€and€stated,€ð ðI€have€to€accept€whatððs€happening.€€I€have€to€just€move€on.€€Iððm€goingÐ L œ Ðto€have€to€start€all€over€again€but€thatððs€okay.€.€.€.€Iððve€been€through€a€lot€in€my€life.€€I€guess€Iððll€haveÐ 8 ˆ Ðto€make€it€through€this,€too.ððÐ $ t ÐÌà  àOn€cross„examination,€the€Defendant€testified€that€while€she€was€in€Corbin,€Kentucky,€sheÐ ü L  Ðwent€to€the€firing€range€once€with€her€supervisor,€a€firearms€instructor,€to€fire€guns.€€She€admittedÐ è 8  Ðthat€she€did€a€good€job€at€the€firing€range.€€She€stated€that€she€liked€to€ð ðtarget€practiceðð€and€often€didÐ Ô$  Ðso€with€the€victim.€€She€claimed€that€she€bought€a€gun€for€protection,€and€she€stated€that€the€victimÐ À  Ðalso€bought€her€a€shotgun.€€The€Defendant€denied€that€she€fired€the€shot€that€caused€the€victimððsÐ ¬ü  Ðdeath.€Ð ˜è  ÐÌà  àThe€Defendant€also€testified€on€cross„examination€that€a€fireman€who€was€ð ðriding€alongððÐ pÀ Ðwith€the€officer€who€arrested€the€victim€in€Kentucky€was€a€man€whom€she€had€dated;€she€testifiedÐ \¬ Ðthat€he€later€became€a€police€officer.€€She€stated€that€she€kept€in€contact€with€him€and€called€him€onÐ H˜ Ða€couple€of€occasions€after€the€victim€ð ðwould€get€upset€and€.€.€.€get€in€his€car€and€leave€and€it€wouldÐ 4„ Ðscare€[her].ðð€€When€accused€of€threatening€to€call€the€victimððs€probation€officer€if€he€left€her,€theÐ  p ÐDefendant€€stated€that€she€did€not€know€that€the€victim€was€on€probation€while€they€lived€together.Ð  \ ÐÌà  àThe€Defendant€admitted€that€officers€found€a€marijuana€pipe€in€a€bedside€table€in€herÐ ä4 Ðbedroom.€€However,€she€claimed€that€she€and€the€victim€never€used€the€table€and€that€she€did€notÐ Ð  Ðknow€how€long€the€pipe€might€have€been€in€the€drawer.€€She€also€admitted€that€officers€found€a€lockÐ ¼  Ðbox€in€the€closet€containing€drug€paraphernalia,€but€she€maintained€that€the€victim€had€locked€up€theÐ ¨ø Ðparaphernalia€in€the€box€because€he€was€trying€to€quit€smoking€marijuana.Ð ”ä ÐÌà  àThe€Defendant€further€admitted€that€she€had€been€taking€anti„depressant€medication.€€SheÐ l¼ Ðstated€that€she€began€taking€the€medication€for€several€reasons,€including€her€ð ðgrandmother€leavingÐ X ¨ Ðhome,€[her]€friends,€[her]€job.ðð€€She€testified€that€she€stopped€taking€her€medication€when€the€victimÐ D!” Ðdied€and€that€she€resumed€taking€an€anti„depressant€three€months€prior€to€the€sentencing€hearing.€€Ð 0"€  ÐÌà  àThe€Defendant€also€admitted€that€she€tested€positive€for€the€use€of€marijuana€in€a€drug€screenÐ $X" Ðconducted€at€the€time€of€her€presentence€investigation.€€She€stated€that€she€told€her€probation€officerÐ ô$D #
