InMay1996,whileemployedatReedJewelers,thedefendantstoleatotalofapproximatelytwothousanddollars($2000)worthofjewelryontwoseparateoccasions.Shethengaveherfriendsthejewelrytopawn,andtheysplittheproceedsofthesale.InJuly1996,thedefendantwashiredbyFreidenCompany,anotherjewelrystore,foronetotwoweeks.Duringthattime,thedefendantstolejewelryontwoorthreeoccasions.Again,herfriendspawnedthejewelryandsharedtheproceeds.OnAugust26,1996,thedefendantenteredaShoeCarnivalshoestoreandshopliftedapairoftennisshoes.Thedefendantwasthenarrestedandindictedwiththreecountsoftheft.  Sixmonthslater,thedefendantnegotiatedapleawiththeState,agreeingtopleadguiltyinexchangefortwoconcurrenttwoyearsentencesforthetwocountsoftheftoveronethousanddollars($1000)andoneconcurrentsixmonthsentencefortheftunderfivehundred($500).Thedefendantpetitionedforsuspensionofhersentence,askingthecourtforprobationinlieuofconfinement.Thecauseproceededtoasentencinghearing,atwhichthedefendanttestified.  Accordingtothedefendant,shehadtwosmallchildrenandwasfourmonthspregnantwithherthirdchildatthetimeofthesentencinghearing.SheadmittedstealingjewelryfromheremployersandshoesfromShoeCarnivaloveraperiodofseveralmonths.Shealsoadmittedthatwhileshewasemployedatoneofthejewelrystores,sheallowedherroommatetopurchasejewelrywithastolencreditcard.Thedefendanthadnopriorrecordandhadbeenemployedwithatemporaryagencyfortwoweeks.Atthetimeofthethefts,thedefendantwasexperiencingdifficulttimesinherlifeandhadbecomeinvolvedwiththewrongpeople,butshefeltsorryforcommittingthethefts.  Attheconclusionofthehearing,thetrialcourtfoundthatthedefendantstestimonywas rehearsed,thatshemaintainedasustainedintenttoviolatethelawseveraltimesoveraperiodofmonths,andthatshewasatthe centeroftheoffensesthatwerecommittedbyherandhercodefendants.Basedonthis,thetrialcourtfoundthatthedefendantwasnotafavorablecandidateforalternativesentencingandorderedhertoservehersentenceinconfinement.  Thedefendantnowarguesthatthetrialcourterredinrefusingtoplaceheronprobationororderingsomeothertypeofalternativesentencing.Itisundisputedthatduetothenatureofthecrimecommitted,thedefendantispresumedtobeafavorablecandidateforalternativesentencingunderT.C.A.4035102(6).Therecord,however,showsthattheStateeffectivelyrebuttedthispresumption.  Thetrialcourtfoundthatthedefendantstestimonyduringthesentencinghearingwas rehearsed,thusindicatingthatthetrialcourtbelievedthedefendanttobeuntruthfulinhertestimony.Untruthfulnessindicatesthatthedefendantlackspotentialforrehabilitation,andassuch,itisavalidreasonfordenyingprobation.E.g.,Statev.Bunch,646S.W.2d158(Tenn.1983);Statev.Dykes,803S.W.2d250(Tenn.Crim.App.1990).Moreover,therecordsupportsthetrialcourtsdeterminationthatthedefendantwasatthe centeroftheoffensesthatwerecommitted,indicatingthatthedefendantwascrucialtothethefts,andperhapsevensuggestingthatthedefendantorchestratedthem.Underthecircumstancesofthiscase,thisdeterminationisalsoprobativeofthedefendantspotentialforrehabilitation,makingittooavalidreasonfordenyingprobation.Finally,bycommittingseveraltheftsoveraperiodofmonths,thedefendantdemonstratedasustainedintenttoviolatethelaw,anothervalidreasonfordenyingprobation.Statev.DavidLewis,C.C.A.No.02C019512CR00363,ShelbyCounty(Tenn.Crim.App.filedJuly25,1997,atJackson);seeStatev.Byrd,861S.W.2d377(Tenn.Crim.App.1993).Giventhesecircumstances,thetrialcourtwasjustifiedindenyingthedefendantalternativesentencing.Thedefendantssentencesareaffirmed.̜       _______________________________       JOHNH.PEAY,Judge̜CONCUR:̛̜______________________________PAULG.SUMMERS,Judge______________________________THOMAST.WOODALL,Judge
