Thepetitionerischallengingtheindictmentandreasonabledoubtjuryinstructionpertainingtohis1979convictionandlifesentenceforfelonymurder.Therecordindicatesthatthepetitionerpreviouslyfiledtwopetitionsforpostconvictionrelief.Thefirst,whichwasfiledin1980,wasdismissedafteranevidentiaryhearing.Noappealwastaken.ThesecondwassummarilydismissedandthatdismissalwasaffirmedbythisCourtonappeal.LynnBrucePersonv.State,No.02C019104CC00063(Tenn.Crim.App.,Nov.27,1991).Theinstantpetitionisthepetitionersthird.  T.C.A.4030202(c)providesthatnomorethanonepetitionforpostconvictionreliefmaybefiledattackingasinglejudgment,andmandatesthatthetrialcourtshallsummarilydismissanysecondorsubsequentpetitionifapriorpetitionwasfiledandresolvedonthemeritsbyacourtofcompetentjurisdiction.Sincethepetitionerpreviouslyfiledatleastonepetitionthatwasresolvedonthemeritsbythetrialcourt,thepetitioner'spresentpetitionwasproperlydismissed.Additionally,afterreviewingtheentirerecordonappeal,wefindthatthepetitionersclaimsdonotfallwithinoneofthelimitedcircumstancesunderwhichapriorpetitionmaybereopened.SeeT.C.A.4030217(thepetitionerfailstocitearecent rulingofthehigheststateappellatecourtortheUnitedStatessupremecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial).
