àThe€record€establishes€that€the€appellant,€46€years€of€age€at€the€time€of€sentencing,€hadÐ & v Ðseveral€prior€convictions€including€a€felony€conviction€in€1975€for€receiving€stolen€property.€€TheÐ  _ Ðpresentence€report€established€that€the€appellant€was€arrested€in€1994€and€1995€for€driving€underÐ ø H Ðthe€influence€and€was€granted€a€suspended€sentence€and€probation€for€second€offense€driving€underÐ á 1  Ðthe€influence,€but€the€appellant€admitted€that€he€has€ð ðquite€a€few€DUIs.ðð€€In€testifying€about€one€ofÐ Ê   Ðthe€DUI€convictions,€the€appellant€stated€that€while€he€was€charged€with€a€fifth€offense€DUI,€he€wasÐ ³  Ðeventually€convicted€of€a€second€offense.׃ ×Ý ƒ#ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€€The€presentence€report€also€establishes€that€the€defendantÐ œì  Ðhad€a€charge€for€aggravated€assault€which€was€retired.€Ð …Õ  ÐÌà  àDuring€the€opening€statements€at€the€sentencing€hearing,€the€stateððs€attorney€asserted€thatÐ W§  Ðthe€presentence€report€failed€to€reflect€all€of€the€defendantððs€convictions;€however,€he€stated€that€heÐ @ Ðhad€no€certified€copies€of€these€convictions€and€did€not€make€a€motion€to€amend€the€report,€insteadÐ )y Ðrelying€on€cross„examination€of€the€appellant€to€supplement€the€presentence€report€as€to€theÐ b Ðappellantððs€criminal€history.׃ Ó×Ý ƒ#ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€€€Ð ûK ÐÌà  àDuring€cross„examination€by€the€state,€however,€the€appellant€candidly€mentioned€otherÐ Í Ðinstances€of€criminal€conduct€during€his€testimony,€including€several€offenses€not€reflected€in€theÐ ¶ Ðpresentence€report.€€The€appellant€admitted€to€a€citation€for€theft€of€property€for€shoplifting€onÐ Ÿï ÐFebruary€25,€2002€at€Rivergate€Mall€and€a€conviction€for€theft€of€merchandise€under€five€hundredÐ ˆØ Ðdollars€at€Rivergate€Mall€on€October€31,€2001,€for€which€he€was€found€guilty€and€served€ninety€daysÐ qÁ Ðat€thirty€percent.€€In€fact,€the€appellant€admitted€to€being€arrested€two€or€three€times€for€shopliftingÐ Zª Ðin€the€last€few€years.€€Counsel€for€the€state€questioned€the€appellant€about€specific€arrests€for€theftÐ C“ Ðoccurring€on€October€8,€2001,€September€29,€2001,€and€September€27,€2001.€€After€being€questionedÐ ,| Ðabout€these€three€theft€arrests,€the€appellant€replied,€ð ðNo€sir€[I€do€not€remember€all€of€them].€€IÐ ° Ðhavenððt€kept€track€of€them.€€Iððm€not€saying€it€didnððt€happen.€€But€if€youððre€asking€me€to€recall€howÐ ™é Ðmany€times€Iððve€been€arrested€for€shoplifting,€I€donððt€know.ðð€€The€appellant€asserted€that€he€did€notÐ ‚Ò Ðhave€any€arrests€in€Tennessee€between€1983€and€1994.€€However,€the€appellant€was€questionedÐ k» Ðabout€an€arrest€in€Florida€in€1992,€and€while€he€admitted€to€the€arrest,€he€did€not€recall€the€particularÐ T¤ Ðdate€or€circumstances.€€The€appellant€also€admitted€that€he€was€arrested€in€Colorado€when€he€wasÐ =  Ðnineteen€years€old.€Ð & v ÐÌà  àThe€appellant€attended€Franklin€High€School€until€1973,€when€he€dropped€out€of€school€inÐ ø H Ðthe€eleventh€grade.€€He€went€on€to€obtain€a€GED€in€1977.€€His€employment€history€included€severalÐ á 1  Ðshort„term,€weekly€wage€jobs€from€1999€to€2001€but€that€employment€could€not€be€verified.€€HeÐ Ê   Ðtestified€that€he€had€worked€all€his€life€and€that€for€the€most€part€he€had€good€jobs€but€that€ð ðin€theÐ ³  Ðlast€four€or€five€years€my€mother€passed€away€and€my€ex„wife€passed€away.€€And€Iððve€kind€of€letÐ œì  Ðthings€slide€since€then.ððÐ …Õ  ÐÌà  àAt€6'1"€and€165€pounds,€the€appellant€describes€his€physical€health€as€ð ðgoodðð€although€heÐ W§  Ðis€prescribed€lithium€for€manic€depression/bipolar€disorder€and€drinks€up€to€two€fifths€of€liquorÐ @ Ðdaily.€€He€reported€his€last€use€of€marijuana€in€1990.€€The€appellant€participated€in€and€completedÐ )y Ðseveral€treatment€programs€for€alcoholism€including€one€at€Cumberland€Heights€in€2001€and€oneÐ b Ðat€Tennessee€Christian€Medical€Center€in€2000.€€He€was€last€treated€for€bipolar€disorder€atÐ ûK ÐVanderbilt€in€2002.€€Ð ä4 ÐÌà  àThe€presentence€report€established€that€the€appellant€had€a€somewhat€disjointed€family€life.€Ð ¶ ÐHis€motherððs€name€was€not€in€the€report.€€His€father€reportedly€lives€in€Florida€and€his€sister€residesÐ Ÿï Ðin€Brentwood.€€The€appellant€has€two€ex„wives€and€a€total€of€four€children.€€The€report€indicated€thatÐ ˆØ Ðtwo€of€the€children€are€adults€and€he€does€not€have€custody€of€the€other€two.€He€pays€$400€monthlyÐ qÁ Ðin€child€support.€€The€appellant€reported€a€child€support€arrearage,€but€stated€that€he€normally€getsÐ Zª Ða€garnishment€on€his€wages€to€pay€the€support.€€The€presentence€report€stated€that€ð ð[appellant]Ð C“ Ðwished€he€had€a€closer€relationship€with€his€children€and€his€father.ðð€Ð ,| ÐÌà  àThe€appellant€expressed€remorse€about€the€incident,€stating,€ð ðIððm€extremely€sorry€for€whatÐ þN Ðhappened.€.€.€.€€And€then€for€her€to€have€to€sit€up€here€and€you€question€her€when€Iððm€the€one€thatÐ ç 7 Ðdid€something€to€her,€it€made€me€feel€even€worse.ððÐ Ð!   ÐÌà  àThe€appellant€testified€that€while€in€custody€awaiting€the€sentencing€hearing,€he€securedÐ ¢#ò" Ðconditional€acceptance€into€two€halfway€house€programs,€Shipley€House€and€Oxford€House,€whichÐ ‹$Û# Ðoffer€alcohol€treatment€programs.€€While€recognizing€his€alcohol€problem,€the€appellant€expressedÐ t%Ä $ Ðhis€desire€for€treatment€and€a€ð ðwillingness€to€do€what€Iððm€told€to€do.ðð€€He€also€informed€the€courtÐ ]&­!% Ðthat€a€caseworker€would€help€him€manage€his€bipolar€disorder.€€Ð F'–"& ÐÌà  àAfter€receiving€testimony€from€the€victim€and€the€appellant,€the€trial€court€found:Ð )h$( ÐÌà8  àAll€right.€€Well,€.€.€.€[appellant],€you€pled€guilty€to€attempted€aggravated€robbery.€€ItÐ ê*:&* Ðis€a€C€felony.€€The€agreed€upon€sentence€is€four€years€as€a€Range€1€standardÐ Ó+#'+ Ðoffender,€which€means€you€are€presumed€eligible€[for€probation].€€However,€justÐ ° Ðbecause€you€are€presumed€eligible€doesnððt€necessarily€mean€you€are€eligible€in€theÐ ™é Ðsense€you€still€have€to€convince€me€that€you€are€suitable€for€an€alternative€sentence,Ð ‚Ò Ðthat€is,€complete€suspension€of€your€sentence.€€I€have€to€look€at€whether€or€not€thereÐ k» Ðhave€been€measures€least€restrictive€frequently€or€recently€applied€to€you,€what€yourÐ T¤ Ðcriminal€history€is€and€whatððs€necessary€to€avoid€the€depreciating€the€seriousness€ofÐ =  Ðthis€offense.€€Ð& vÐ Ð  ÐÌà8  àActually,€.€.€.€[the€appellant]€presents€a€pretty€remorseful€picture.€.€.€.€Ðø HÐ Ð  ÐÓ  Óà8 @ àÓ†^ÓÌà8  àThat€being€said,€.€.€.€[appellant],€you€havenððt€convinced€me€at€this€point.€€ObviouslyÐ Ê   Ðyou€have€not€been€in€a€position€to€participate€in€any€programs€because€of€whereÐ ³  Ðyouððre€located.€€Well,€you€now€will€be.€€I€want€you€to€enter€the€Lifelines€program,Ð œì  Ðbecause€the€problem€is€„€„€itððs€not€just€drugs€and€alcohol.€€Itððs€a€whole€lifestyle€kindÐ …Õ  Ðof€issue.€€You€need€some€life€skills,€and€you€need€a€few€other€things.€€Iððm€not€sayingÐ n¾  ÐIððll€never€grant€you€probation€but€just€not€at€this€point.€€I€just€donððt€think€that€„€„€IÐ W§  Ðthink€thereððs€been€too€many€times€in€your€past€where€other€alternatives€have€beenÐ @ Ðapplied.€€So€Iððm€going€to€order€you€into€the€Lifelines€program.€€If€you€successfullyÐ )y Ðcomplete€that€and€have€no€write„ups,€then€.€.€.€[counsel]€can€apply€to€suspend€yourÐ b Ðsentence.€€But€just€not€at€this€time,€Iððm€not€sufficiently€convinced€thatððs€theÐ ûK Ðappropriate€resolution€to€this.€.€.€.€Ðä4Ð Ð  ÐÌà  àThe€appellant€asserts€on€appeal€that€the€trial€court€failed€to€make€the€required€findings€of€factÐ ¶ Ðon€the€record€so€as€to€accord€the€sentence€in€this€case€the€presumption€of€correctness€as€prescribedÐ Ÿï Ðby€Tennessee€Code€Annotated€section€40„35„401(d).€€While€the€trial€court€did€not€make€specificÐ ˆØ Ðfindings€of€fact,€it€did€express€concern€about€the€appellantððs€previous€criminal€history,€alcoholÐ qÁ Ðproblems€and€history€of€treatment€failure,€concluding€that€he€needed€to€be€placed€in€a€programÐ Zª Ðwhere€he€would€be€forced€to€deal€with€his€alcohol€and€lifestyle€issues.€€Ð C“ ÐÌà  àAfter€a€òòdeóó€òònovoóó€review€of€the€record,€we€note€that€there€are€factors€which€weigh€in€theÐ e Ðappellantððs€favor€for€probation,€namely€his€successful€proactive€attempts€to€secure€conditionalÐ þN Ðacceptance€at€two€halfway€houses€and€his€recognition€of€his€own€problems€with€alcohol€and€bipolarÐ ç 7 Ðdisorder.€€However,€the€appellant€has€numerous€prior€encounters€with€the€legal€system,€and€yetÐ Ð!   Ðcontinued€to€commit€crimes.€€Although€the€appellantððs€actions€are€likely€the€result€of€his€mentalÐ ¹" !
