àThe€appellant,€Jabbaul€Pettus,€appeals€the€œsentence›€imposed€by€theÏCircuit€Court€of€Montgomery€County€œafter€he€was€found€to€be€in€violation€of€theÏterms€and€conditions€of€the€community€corrections€program.€€While€on€theÏprogram€he€committed€and€pled€guilty€to€the€offense€of€attempted€aggravatedÏrobbery.›€€At€the€time€of€the€œnew€offense,›€Pettus€was€serving€an€eight€(8)€yearÏsentence€€with€the€community€corrections€program€for€œpossession›€of€cocaineÏwith€the€intent€to€sell.€€As€a€result,€the€trial€court€revoked€his€sentence€under€theÏCommunity€Corrections€Act€and€œre„sentenced›€him€to€ten€(10)€years€for€the€drugÏcharge€and€six€(6)€years€for€the€attempted€aggravated€robbery,€with€theÏsentences€to€be€served€consecutively.€€Pettus€claims€that€his€sentence€forÏpossession€of€cocaine€with€the€intent€to€sell€is€illegal€because€he€wasÏsentenced€for€a€Class€B€felony€whereas€the€indictment€merely€alleged€a€ClassÏC€felony.€€He€further€maintains€that€he€should€have€received€a€separate€re„sentencing€hearing€for€the€drug€charge€apart€from€the€œsentencing€hearing›€onÏœattempted›€aggravated€robbery.€€Finally,€appellant€argues€that€the€trial€courtÏerred€in€ordering€consecutive€sentencing.€€We€find€œno€error›€and€œaffirm.Ì›Ìà@ àò òòòPROCEDURAL€HISTORYóóó óÌà àIn€October€1994,€Pettus€was€indicted€for€one€(1)€count€of€possession€ofÏcocaine€with€the€intent€to€sell.€€The€indictment€did€not€list€the€amount€of€cocaineÏfor€which€Pettus€was€charged.€€In€January€1995,€Pettus€entered€a€guilty€plea€forÍpossession€of€cocaine€with€the€intent€to€sell,€a€Class€B€felony.€€The€trial€judgeÏsentenced€him€to€eight€(8)€years€to€be€served€in€the€community€correctionsÏœprogram›€pursuant€to€T.C.A.€ðð€40„36„101,€et.€seq.Ìà àIn€October€1995,€Pettus€pled€guilty€to€the€charge€of€attempted€aggravatedÏrobbery.€€The€offense€was€committed€while€he€was€under€the€communityÏcorrections€program.€€At€the€sentencing€hearing,€Pettus€received€a€six€(6)€yearÏsentence€for€attempted€aggravated€robbery€as€a€Range€I,€Standard€Offender.€ÏFurthermore,€because€he€violated€the€community€corrections€program,€the€trialÏcourt€revoked€his€previous€sentence€and€re„sentenced€him€to€ten€(10)€years€forÏthe€prior€œoffense,€with€the€sentences€to€run€consecutively.›ÌÌà@ àœò òòòILLEGAL€SENTENCEó óóó›Ìà àPettus€contends€that€his€re„sentencing€for€the€possession€of€cocaine€withÏthe€intent€to€sell€is€illegal€because€he€was€sentenced€to€ten€(10)€years,€whichÏexceeds€the€sentence€prescribed€for€a€Class€C€felony.€€He€argues€that€becauseÏthe€indictment€did€not€specify€that€the€amount€of€cocaine€was€0.5€grams€orÏmore,€then€it€is€presumed€to€be€less€than€0.5€grams,€a€Class€C€felony.€€T.C.A.€ððÏœ39„17„417(c)›€(1),€(2);€òòState€v.€Hilliardóó,€906€S.W.2d€466€(Tenn.€Crim.€App.€1995).€ÏThe€range€of€sentencing€for€a€Class€C€felony€for€a€standard€offender€is€fromÏthree€(3)€to€six€(6)€years.€€Therefore,€Pettus€argues€that€a€ten€(10)€year€Class€BÏsentence€is€unauthorized€by€statute.Ìà àGenerally,€a€sentence€that€is€imposed€in€direct€contravention€to€expressÏstatutory€provisions€is€illegal€and€is€subject€to€being€set€aside€at€any€time.€€òòSeeóóÍòòState€v.€Burkhartóó,€566€S.W.2d€871€(Tenn.€1978).€€Recently,€this€Court€hasÏreiterated€this€principle€in€òòWoods€v.€Stateóó,€928€S.W.2d€52€(Tenn.€Crim.€App.Ï1996).€€In€that€case,€the€defendant€pled€guilty€to€three€(3)€counts€of€robbery€andÏwas€sentenced€as€a€Range€I,€œStandard›€œOffender›€to€ten€(10)€year€sentences.€ÏThe€specified€sentence€for€a€Class€C€felony€within€Range€I€is€only€three€(3)€toÏsix€(6)€years.€€Therefore,€this€Court€held€that€his€sentence€was€illegal€because€itÏexceeded€the€statutory€limits.Ìà àThat€is€not€the€situation€in€this€case.€€Even€though€the€indictment€did€notÏspecify€the€amount€of€cocaine,€Pettus€entered€a€knowing€and€voluntary€plea€ofÏguilty€as€a€œStandard›€œOffender›€to€the€Class€B€felony€with€a€range€of€punishmentÏof€eight€(8)€to€twelve€(12)€years.€€Therefore,€the€original€eight„year€communityÏcorrections€sentence€was€within€this€statutory€range€of€punishment.€ÏFurthermore,€the€ten„year€sentence€that€Pettus€received€upon€re„sentencingÏwas€also€within€the€statutory€range.€€Neither€sentence€was€illegal.Ìà àA€defendant€can€enter€a€plea€of€guilty€pursuant€to€a€plea€agreement€andÏbe€sentenced€to€a€higher€range€of€classification€than€that€which€would€ordinarilyÏbe€imposed.€€œòòState›€v.€Mahleróó,€735€S.W.2d€226€(Tenn.€1987).Ìà àIn€òòState€v.€Wallenóó,€863€S.W.2d€34€(Tenn.€1993),€the€defendant€wasÏsentenced€as€an€especially€aggravated€offender€on€the€basis€that€he€committedÏan€offense€while€on€parole€from€a€conviction€that€was€subsequently€overturned.€ÏThe€defendant€pled€guilty€to€three€(3)€counts€of€armed€robbery€and€later€claimedÏthat€his€sentence€as€an€especially€aggravated€offender€was€illegal€because€itÏwas€based€on€void€œprior€convictions.›€€The€Supreme€Court€rejected€his€argumentÍsaying,€ð ðthe€petitioner,€with€full€knowledge€of€his€rights,€voluntarily€took€theÏbenefits€of€the€plea€bargain.€€In€accepting€those€benefits,€.€.€.€he€waived€anyÏirregularity€or€defect€in€the€proceedings€.€.€.€ð ð€863€S.W.2d€at€38.Ìœà àPettusðð€reliance€on€òòState›€v.€œHilliardóó,€906€S.W.2d€466€(Tenn.€Crim.€App.Ï1995),€is›€œmisplaced.›€€In€œòòHilliardóó›€the€defendant€did€not€plead€guilty€to€the€Class€BÏfelony€but€rather€was€tried€and€found€œguilty€on€an€indictment€that€did€not€specifyÏthe€amount€of€cocaine.›€€Since€the€indictment€did€not€specify€the€Class€B€felonyÏamount,€this€Court€œconcluded€on€direct€appeal€that€defendant›€could€only€beÏsentenced€for€the€Class€C€felony.Ìà àUnlike€òòHilliardóó,€Pettus€œknowingly›€and€voluntarily€pled€guilty€to€the€Class€BÏfelony.€€He€is€now€œbeing€òòre„sentencedóó›€based€upon€his€prior€plea€of€guilty€andÏviolation€of€the€terms€of€the€community€corrections€program.€€His€prior€guiltyÏplea€has€the€effect€of€waiving€all€non„jurisdictional€and€procedural€defects€andÏconstitutional€infirmities€in€any€prior€stage€of€the€proceeding.€€òòState€v.€Griffinóó,Ï914€S.W.2d€564,€567€(Tenn.€Crim.€App.€1995).€€There€are€no€jurisdictionalÏdefects.€€Therefore,€we€conclude€that€Pettus€waived€any€claims€with€regard€toÏthe€indictment€by€his€œprior€plea›€of€œguilty.€€He€has€not€received€an€illegalÏsentence.€€This€issue€is€without€merit.Ì›Ìà@ àò òòòSEPARATE€RE„SENTENCING€HEARINGó óóóÌà àPettus€next€alleges€that€he€should€have€received€a€separate€œre„sentencing›€hearing€distinct€from€the€sentencing€hearing€for€attemptedÏaggravated€robbery.€€œTo€re„sentence€for€a€violation€of€the€CommunityÍCorrections€Act,€the›€trial€court€must€conduct€a€sentencing€hearing€pursuant€toÏthe€Criminal€Sentencing€Reform€Act€of€1989€and€conform€the€new€sentence€toÏthe€provisions€of€the€Act.€€òòState€v.€Timothy€Lemont€Wadeóó,€C.C.A.€No.€01C01„9303„CR„00092€(Tenn.€Crim.€App.€filed€November€24,€1993€at€Nashville);€òòseeÏalsoóó€T.C.A.€ðð€40„35„209(a)€and€œ210(a)„(e).€€The€trial€court€cannot€arbitrarilyÏestablish€the€length€of€the€new€sentence€and€should€approach€the€sentencingÏof€the€defendant€in€the€same€manner€as€if€it€were€sentencing€defendant€initially,Ïexcept€that€the€trial€court€may€consider€the€fact€that€community€corrections€wasÏnot€successful.€€òòState€v.€McGillóó,€C.C.A.€No.€03C01„9409„CR„00345€(Tenn.€Crim.ÏApp.€filed€September€19,€1995,€at€Knoxville).›€€There€is€no€authority€to€suggestÏthat€Pettus€is€entitled€to€a€separate€œre„sentencing›€hearing.€€He€admitted€to€hisÏviolation€of€community€corrections.€€He€suggested€that€the€trial€court€ð ðset€aÏdisposition€at€the€same€time€a€sentencing€hearing€is€setðð€in€the€robbery€case.€ÏOn€that€date€the€trial€court€made€extensive€findings€pursuant€to€the€CriminalÏSentencing€Reform€Act€of€1989.€€These€findings€were€relevant€to€the€attemptedÏrobbery€œcharge€as€well€as€the€drug€re„sentencing€charge.›€€Although€the€trialÏcourt€could€have€been€more€definitive€in€its€findings€relating€to€each€charge,ÏPettus€suffered€no€prejudice€simply€because€the€sentencing€and€re„sentencingÏhearings€were€combined.€€This€issue€is€without€œmerit.Ì›œÌà@ àòòò òCONSECUTIVE€SENTENCINGó óóóÌà àThe€defendant€next€argues€the€trial€court€erred€by€ordering€his€sentencesÏto€be€served€consecutively.€€At€the€sentencing€hearing,€the€trial€court€found€thatÍthe€defendant€committed€the€attempted€aggravated€robbery€while€on€communityÏcorrections€and€ordered€defendantððs€six„€year€sentence€for€attemptedÏaggravated€robbery€and€ten„year€sentence€for€possession€of€cocaine€with€intentÏto€sell€to€be€served€consecutively.€€T.C.A.€ðð40„35„115(6).€€Defendant€specificallyÏargues€that€he€was€not€on€ð ðprobationðð€as€specified€by€this€statute€but€involved€inÏa€community€correction€program.€€He,€therefore,€contends€that€there€is€noÏproper€basis€to€support€consecutive€sentencing.Ìà àConsecutive€sentencing€is€governed€by€T.€C.€A.€ðð€40„35„115.€€The€trialÏcourt€may€order€sentences€to€run€consecutively€if€it€finds€by€a€preponderance€ofÏthe€evidence€that€one€or€more€of€the€required€statutory€criteria€exist.€€òòState€v.ÏBlackóó,€924€S.W.2d€912€(Tenn.€Crim.€App.€1995).€€Furthermore,€the€court€isÏrequired€to€determine€whether€the€consecutive€sentences€(1)€are€reasonablyÏrelated€to€the€severity€of€the€offenses€committed;€(2)€serve€to€protect€the€publicÏfrom€further€criminal€conduct€by€the€offender;€and€(3)€are€congruent€with€generalÏprinciples€of€sentencing.€€òòState€v.€Wilkersonóó,€905€S.W.2d€933,€939€(Tenn.Ï1995).Ìà
