àThe€Defendant,€Melissa€J.€Pewitt,€appeals€as€of€right€from€her€conviction€inÏthe€Criminal€Court€of€Wilson€County.€€Following€a€jury€trial,€she€was€convicted€ofÏespecially€aggravated€burglary.€€In€her€appeal,€the€Defendant€presents€theÏfollowing€issues:ÌÓÓÌà8 à1)€€Whether€the€evidence€was€sufficient€to€sustain€a€guilty€verdict€onÏthe€charge€of€especially€aggravated€burglary;ÌÌà8 à2)€Whether€the€trial€court€erred€in€allowing€the€admission€ofÏphotographs€of€the€victimððs€injuries€which€unfairly€prejudiced€andÏinflamed€the€jury;ÌÌà8 à3)€Whether€the€trial€court€erred€in€allowing€the€jury€to€consider€a€chargeÏof€an€incidental€crime€in€violation€of€the€Defendantððs€due€process€rights;ÌÌà8 àElizabeth€Pewitt,€the€victim,€is€married€to€Dwayne€Pewitt€and€they€haveÏthree€(3)€children.€€In€August€1995,€the€victim€was€separated€from€her€husband€andÏwas€living€in€a€trailer€with€her€children.€€David€Pewitt€is€the€victimððs€brother„in„lawÍand€was€married€to€the€Defendant.€€In€October€1995,€David€Pewitt€came€over€toÏperform€various€repair€tasks€at€the€victimððs€trailer.€€During€this€time,€he€wasÏseparated€from€the€Defendant.€€This€contact€between€David€Pewitt€and€the€victimÏled€to€a€romantic€involvement€during€which€Pewitt€moved€into€the€trailer€with€theÏvictim€and€her€children.€€Pewitt€stayed€for€approximately€five€(5)€months€until€theÏvictim€asked€him€to€leave.€€Pewitt€began€living€with€the€Defendant€again€at€thatÏtime.€ÌÌà àOn€March€11,€1996,€the€victim€paged€David€Pewitt€on€at€least€two€(2)Ïoccasions.€€The€Defendant€answered€that€page€and€instructed€the€victim,€ð ð[Y]ouÏhad€better€leave€us€alone€or€youððll€regret€everything€you€done€[sic].ðð€€While€at€aÏfriendððs€house,€the€victim€paged€Pewitt€again€around€5:00€p.m.€and€he€returned€herÏcall.€€While€the€victim€was€talking€with€Pewitt,€she€could€hear€the€Defendant€in€theÏbackground€screaming€at€Pewitt€to€tell€the€victim€what€she€[Defendant]€said.€ÏPewitt€did€not€tell€the€victim€what€the€Defendant€said,€but€he€did€agree€to€meet€withÏher€to€talk.€€The€victim€returned€home€around€7:30€p.m.€and€began€putting€herÏchildren€to€bed.€€ÌÌà àThe€victim€was€lying€in€bed€with€her€child€when€she€heard€Pewittððs€car€turnÏinto€her€driveway.€€She€put€on€her€robe€and€went€to€the€door.€€As€Pewitt€walkedÏup€her€steps,€she€asked€him€if€he€was€alone€and€he€replied€that€he€was.€€SheÍthen€asked€him€why€he€was€driving€as€he€appeared€to€be€ð ðpretty€drunk.ðð€€PewittÏcame€inside€and€told€her€that€he€was€not€alone,€that€the€Defendant€and€her€friendÏCindy€were€out€in€the€car€and€that€he€was€supposed€to€lead€the€victim€outside€forÏan€ambush.€€Pewitt€stated€that€he€could€not€do€that€to€the€victim€and€she€lockedÏthe€door.€€The€victim€gave€Pewitt€a€letter€she€had€written€to€him€and€they€began€toÏhug€and€kiss.€€ÌÌà àThe€next€thing€the€victim€can€recall€is€someone€banging€on€her€front€door.€ÏShe€unlocked€it€because€she€did€not€want€her€door€to€be€torn€down.€€She€saw€theÏDefendant€and€Cindy€outside€and€asked€them€to€leave.€€The€Defendant€forced€herÏway€inside€and€was€screaming€at€Pewitt€to€tell€the€victim€ð ð[I]tððs€over.ðð€€TheÏDefendant€repeatedly€stated,€ð ðItððs€over,€bitch.€€Itððs€over,€do€you€understand€that.ðð€ÏThe€victim€responded€that€Pewitt€should€tell€her€if€it€was€over,€and€Pewitt€declinedÏto€say€the€relationship€was€over.€€The€victimððs€four€(4)€year€old€daughter€wasÏsleeping€on€the€couch,€woke€up€and€then€began€to€cry.€€The€victim€took€her€into€herÏbedroom€and€told€her€to€stay€there,€that€everything€was€okay.€€When€she€cameÏback€into€the€living€room,€the€Defendant€and€Pewitt€were€standing€there,€with€CindyÏstanding€just€outside€the€€door.€€Defendant€jumped€onto€Pewitt€and€hit€him,€causingÏhim€to€fall€and€break€a€table.€€The€victim€asked€her€to€leave,€but€DefendantÏresponded€that€she€had€better€leave€Pewitt€alone.€€Cindy€came€inside€slowly€andÏstood€beside€the€Defendant.€€ÌÌà àCindy€hit€the€victim€and€then€the€Defendant€began€to€hit€her.€€Both€of€themÏattempted€to€pull€the€victim€outside€by€her€hair€but€the€victim€sat€down.€€Cindy€said,Ïð ðGive€me€the€knife,€give€me€the€knife,€weððre€going€to€cut€this€bitchððs€hair.ðð€€TheÏDefendant€agreed€and€handed€a€knife€to€Cindy.€€When€they€brought€out€the€knife,ÏPewitt€walked€outside.€€The€victim€screamed,€begging€them€to€please€leave€and€forÏPewitt€to€help€her.€€While€the€victim€had€her€hands€up€trying€to€pull€her€hair€awayÏfrom€them,€they€cut€her€hands.€€After€the€victim€moved€her€hands,€they€cut€her€hair.€ÏCindy€said,€ð ðWeððre€going€to€cut€your€pretty€little€legs€up.ðð€€The€Defendant€repeated,Ïð ðYeah,€weððre€going€to€cut€you€up.ðð€€Cindy€began€to€cut€her€while€the€DefendantÏbeat€her.ÌÌà àDefendant€began€cutting€her€legs€while€Cindy€then€beat€the€victim.€€TheÏattack€continued€while€the€victim€screamed€for€help.€€Pewitt€stepped€back€insideÏand€pulled€both€women€off€of€the€victim,€then€said,€ð ðMy€God,€what€have€you€allÏdone€to€her.ðð€€The€victim€asked€him€to€take€the€women€and€leave.€€When€PewittÏgot€up,€Cindy€and€the€Defendant€both€kicked€the€victim€as€they€were€leaving.€€ÌÌà àAfter€the€victim€heard€their€car€leave,€she€walked€over€to€her€neighborððsÏhome,€the€Eadyððs,€and€asked€for€them€to€call€911.€€Eady€got€some€towels€for€herÏlegs€after€he€called€911,€and€they€returned€to€her€home€to€check€on€her€children.€ÍThe€victim€was€bleeding€so€badly€that€she€returned€outside€because€it€was€coldÏand€she€was€trying€to€stop€the€bleeding.€€The€ambulance€arrived€and€transportedÏher€to€the€University€Medical€Center€in€Lebanon.€€She€was€in€surgery€for€five€(5)Ïhours€and€stayed€in€the€hospital€for€two€(2)€days.€€After€she€left€the€hospital,€theÏvictim€stayed€with€her€mother€for€one€(1)€week.€€She€was€in€a€wheelchair€and€hadÏto€be€transferred€by€others€from€her€wheelchair€to€the€bed.€€The€victim€was€unableÏto€do€anything€for€herself,€and€her€husband€came€and€helped€her€after€she€returnedÏto€her€trailer.€€He€stayed€for€three€(3)€or€four€(4)€months.€€The€victim€displayed€herÏscars€to€the€jury.€€Ìà àJeff€Eady,€next€door€neighbor€to€the€victim,€was€in€bed€asleep€when€he€andÏhis€wife€heard€someone€banging€on€their€front€door.€€Eady€went€to€the€door€andÏsaw€the€victim€walking€down€the€porch€and€across€their€yard.€€Eady€opened€theÏdoor€and€turned€on€the€light€and€the€victim€came€back€up€the€stairs.€€Eady€couldÏsee€that€the€victim€was€bleeding,€so€he€called€911€and€asked€for€an€ambulance.€ÏThe€victim€advised€him€who€attacked€her€and€Eady€relayed€that€information€to€theÏoperator€at€911.€€Eady€noticed€that€she€was€losing€a€lot€of€blood€so€he€got€someÏtowels.€€They€walked€back€to€her€trailer€to€check€on€her€children,€then€theyÏwrapped€towels€around€her€legs.€€The€ambulance€later€arrived€and€transported€theÏvictim€to€the€hospital.€€ÌÌà àAnthony€Murray,€a€sergeant€with€the€Wilson€County€Sheriffððs€Department,Ïwas€working€on€March€11,€1996,€when€he€received€a€call€for€a€domestic€typeÏsituation.€€He€was€given€a€description€of€the€suspectððs€car€and€how€many€peopleÏwere€in€the€car.€€He€proceeded€down€Coles€Ferry€Pike€and€met€a€vehicle€matchingÏthe€description.€€He€turned€around€and€proceeded€after€the€car.€€The€carððs€driverÏrefused€to€stop€until€Murray€passed€the€vehicle€and€stopped€in€the€middle€of€theÏroad€and€forced€the€car€to€stop.€€Cindy€Mainer€was€driving€the€vehicle€whichÏbelonged€to€the€Defendant.€€When€he€got€to€the€car€and€the€suspects€exited,€heÏsaw€blood€on€the€Defendantððs€hands€when€he€put€handcuffs€on€her.€€All€three€(3)Ïof€the€suspects€were€intoxicated,€belligerent€and€uncooperative.€€The€DefendantÏcussed€at€Murray€and€then€kicked€the€back€glass€out€of€his€patrol€car€with€her€feet.€ÏHe€did€not€find€a€knife€in€their€vehicle.€€ÌÌà àVicky€Taylor,€sister€to€David€Pewitt,€had€invited€her€brother€and€theÏDefendant€to€stay€in€her€home€on€the€evening€prior€to€this€attack.€€During€that€day,ÏTaylor€was€talking€with€the€Defendant.€€The€Defendant€was€angry€at€the€victimÏbecause€she€had€paged€Pewitt€on€three€(3)€occasions€earlier€that€day.€€DefendantÏtold€Taylor€that€ð ð[she]€ought€to€go€kill€Beth€[the€victim].ðð€€Pewitt€was€in€the€other€roomÏwhen€this€occurred.€€Pewitt€and€the€Defendant€left€Taylorððs€home€fifteen€(15)€orÏtwenty€(20)€minutes€later€and€both€had€been€drinking.ÌÌà àSergeant€Jason€Locke€was€working€as€a€detective€on€the€night€of€March€11,Ï1996.€€Locke€drove€to€the€location€where€the€suspectððs€vehicle€was€stopped.€€HeÏphotographed€the€inside€of€the€vehicle.€€Locke€stated€that€all€three€(3)€suspectsÏappeared€to€have€been€drinking,€so€he€allowed€some€time€to€elapse€prior€toÏconducting€his€interviews.€€During€that€time,€Locke€went€to€the€hospital€andÏphotographed€the€victimððs€injuries.€€He€also€photographed€the€scene€at€the€victimððsÏresidence.€€All€these€photos€were€exhibited€to€the€jury.€€When€Locke€returned€to€theÏjail€where€the€suspects€were€held,€he€interviewed€the€Defendant.€€The€DefendantÏwas€read€her€constitutional€rights€and€signed€a€waiver€of€those€rights.€€AfterÏconducting€an€interview,€Locke€wrote€the€following€statement:ÌÓÓà8 àI€was€at€work€at€12€oððclock€noon€Monday,€March€11th,€1996€whenÏBeth€Pewitt€paged€me€on€my€beeper.€€She€paged€me€two€more€timesÏlater€the€same€day.€€She€was€wanting€to€talk€to€David,€my€husband.€ÏI€told€her€she€was€fixing€to€regret€everything€she€had€ever€done€to€me.€ÏOn€Monday€night,€David,€Cindy€and€I€were€riding€around€drinking€andÏI€started€thinking€about€it€and€got€mad,€and€I€told€David€we€wouldÏnever€be€happy€again€until€I€whipped€her€ass.€€We€drove€to€BethððsÏtrailer€in€Norene€and€David€went€in€first€to€get€her€out€so€we€could€takeÏher€down€the€road€and€not€do€it€at€her€trailer.€€I€walked€around€andÏsaw€David€kiss€her€and€put€his€arm€around€her€and€thatððs€when€IÏwent€in€and€Cindy€came€in€behind€me.€€I€kicked€Beth€in€her€chest,Ïside,€arms€and€head.€€The€knife€belonged€to€me.€€I€donððt€know€whereÏit€is€at€now.€€Both€Cindy€and€I€cut€Bethððs€legs,€hands,€and€hair.€€IððmÏnot€totally€sure€if€the€knife€we€used€was€mine€or€someone€elseððs.€€ÌÌÓÓAfter€he€wrote€the€statement,€the€Defendant€read€the€statement€and€signed€it.ÌÌà àDefendant€argues€that€the€evidence€is€insufficient€to€support€her€conviction€forÏespecially€aggravated€burglary€because€the€victim€consented€to€the€DefendantÏentering€her€home€and€the€State€failed€to€prove€the€requisite€intent€of€entry€into€theÏvictimððs€habitation.€€A€person€commits€the€offense€of€especially€aggravatedÏburglary€by€entering€a€habitation,€without€the€effective€consent€of€the€propertyÏowner,€with€the€intent€to€commit€a€felony,€and€the€victim€suffers€serious€bodily€injury.€ÏTenn.€Code€Ann.€ðððð€39„14„402(a)(1),€„404(a).€€ÌÌà àWhen€an€accused€challenges€the€sufficiency€of€the€convicting€evidence,€theÏstandard€is€whether,€after€reviewing€the€evidence€in€the€light€most€favorable€to€theÏprosecution,€any€rational€trier€of€fact€could€have€found€the€essential€elements€of€theÏcrime€beyond€a€reasonable€doubt.€€òòJackson€v.€Virginiaóó,€443€U.S.€307,€319€(1979).€ÏOn€appeal,€the€State€is€entitled€to€the€strongest€legitimate€view€of€the€evidence€andÏall€inferences€therefrom.€€òòState€v.€Cabbageóó,€571€S.W.2d€832,€835€(Tenn.€1978).ÏBecause€a€verdict€of€guilt€removes€the€presumption€of€innocence€and€replaces€itÏwith€a€presumption€of€guilt,€the€accused€has€the€burden€in€this€court€of€illustratingÏwhy€the€evidence€is€insufficient€to€support€the€verdict€returned€by€the€trier€of€fact.€ÏòòState€v.€Tuggleóó,€639€S.W.2d€913,€914€(Tenn.€1982);€òòState€v.€Graceóó,€493€S.W.2dÏ474,€476€(Tenn.€1973).ÌÌà àQuestions€concerning€the€credibility€of€the€witnesses,€the€weight€and€value€toÏbe€given€the€evidence,€as€well€as€all€factual€issues€raised€by€the€evidence,€areÏresolved€by€the€trier€of€fact,€not€this€court.€€òòState€v.€Pappasóó,€754€S.W.2d€620,€623Ï(Tenn.€Crim.€App.),€òòpermóó.€òòtoóó€òòappealóó€òòdeniedóó,€òòidóó.€(Tenn.€1987).€€Nor€may€this€courtÏreweigh€or€reevaluate€the€evidence.€€òòCabbageóó,€571€S.W.2d€at€835.€€A€jury€verdictÏapproved€by€the€trial€judge€accredits€the€Stateððs€witnesses€and€resolves€allÏconflicts€in€favor€of€the€State.€€òòGraceóó,€493€S.W.2d€at€476.ÌÌà àIn€the€light€most€favorable€to€the€State,€the€evidence€shows€that€theÏDefendant€entered€the€victimððs€mobile€home€without€consent€of€the€victim€in€order€toÏcause€the€victim€serious€bodily€injury.€€While€the€testimony€from€the€victim€makes€itÏclear€that€the€front€door€of€her€home€was€unlocked,€there€is€no€requirement€withinÏthe€statute€that€a€defendant€must€enter€the€home€without€consent€through€aÏð ðlockedðð€door.€€The€victim€testified€that€she€gave€no€consent€to€the€Defendant€toÏenter,€but€that€she€asked€Defendant€to€leave€the€property.€€The€DefendantÏnevertheless€barged€into€the€victimððs€home.€€We€find€there€was€sufficient€proof€fromÏwhich€a€reasonable€trier€of€fact€could€have€found€the€elements€of€especiallyÏaggravated€burglary.€€This€issue€is€without€merit.€€òòÌÌóóà àDefendant€argues€that€the€admission€of€photographs€of€the€injuries€to€theÏvictim€were€prejudicial€and€inflamed€the€jury.€€Defendant€further€insists€that€his€errorÍwas€plain€error€as€pursuant€to€Rule€52(b)€of€the€Tennessee€Rules€of€CriminalÏProcedure.€€These€photographs€showed€the€blood€and€lacerations€on€the€legs€ofÏthe€victim.€€Defendant€contends€that€the€victimððs€display€of€the€scars€on€her€legÏwere€sufficient€to€prove€ð ðserious€bodily€injuryðð€as€an€element€of€especiallyÏaggravated€burglary,€and€that€these€photographs€only€served€to€inflame€and€exciteÏthe€jury.ÌÌà àIn€the€case€òòsubóó€òòjudiceóó,€the€trial€court€did€not€abuse€its€discretion€in€admittingÏthe€photographs€into€evidence.€€In€order€to€convict€a€defendant€of€especiallyÍaggravated€burglary,€the€State€must€prove€that€the€victim€of€the€offense€sufferedÏð ðserious€bodily€injury.ðð€€Tenn.€Code€Ann.€ðð€39„14„404(a)(2).€€Even€if€the€visualÏdemonstration€of€her€legs€in€addition€to€the€photographs€was€cumulative,€theÏrelevance€of€the€photographs€to€depict€the€serious€nature€of€the€victimððs€bodilyÏinjuries€is€not€diminished.€€While€such€photos€may€be€disturbing€or€even€gruesomeÏto€some€jurors,€that€alone€is€insufficient€to€render€these€otherwise€relevantÏphotographs€inadmissible.€€Having€found€no€error,€this€issue€is€without€merit.òòÌÌóóà àThe€Defendant€argues€that€she€should€not€have€been€prosecuted€forÏespecially€aggravated€burglary€as€this€act€was€merely€incidental€to€the€commissionÏof€another€felony,€aggravated€assault.€€In€addition,€the€Defendant€asserts€that€theÏelement€of€ð ðserious€bodily€injuryðð€in€both€the€offenses€of€aggravated€assault€andÏespecially€aggravated€burglary€cause€the€consideration€of€both€offenses€to€be€inÏerror€and€a€violation€of€her€rights€against€double€jeopardy.€€Similarly,€the€DefendantÏconcludes€that€it€was€ð ðplain€errorðð€for€the€jury€foreman€to€be€precluded€from€readingÏthe€juryððs€verdict€on€the€charge€of€aggravated€assault€after€finding€her€guilty€ofÏespecially€aggravated€burglary.€€ÌÌà àThe€elements€of€aggravated€assault€are€that€a€person€commits€the€offense€ifÏshe€intentionally€or€knowingly€causes€serious€bodily€injury€to€someone.€€Tenn.ÏCode€Ann.€ðð€39„13„102(a)(1)(A).€€In€order€to€commit€the€offense€of€especiallyÍaggravated€burglary,€a€person€must€enter€a€building,€not€open€to€the€public€andÏwithout€the€ownerððs€consent,€with€the€intent€to€commit€a€felony€and€cause€ð ðseriousÏbodily€injuryðð€to€another€person.€€Tenn.€Code€Ann.€ðððð€39„14„402(a)(1),€„404(a).€ÏWhile€the€jury€was€charged€on€both€offenses€upon€consideration€of€aggravatedÏassault€as€a€lesser€offense,€the€Defendant€was€convicted€of€only€one€(1)€offenseÏof€especially€aggravated€burglary.€€The€jury€was€specifically€instructed€by€the€trialÏcourt€that€if€it€found€the€Defendant€guilty€of€especially€aggravated€burglary,€then€itÏwas€not€to€consider€any€other€offenses€included€within€the€charge€to€the€jury.€€ForÏthese€reasons,€the€Defendantððs€reliance€upon€òòState€v.€Anthonyóó,€817€S.W.2d€299Ï(Tenn.€1991),€and€òòState€v.€Olleróó,€851€S.W.2d€841€(Tenn.€Crim.€App.€1992),€isÏmisplaced.€€In€both€òòAnthonyóó€and€òòOlleróó,€the€defendants€were€òòindictedóó€òòandóó€òòconvictedóóÏof€a€minimum€of€òòtwoóó€(2)€offenses,€whereas€in€the€case€òòsubóó€òòjudiceóó€Defendant€wasÏonly€convicted€of€one€(1)€offense.€€ÌÌà àDefendant€further€relies€upon€the€section€of€Tennessee€Code€AnnotatedÏwhich€states€that€ð ð[a]cts€which€constitute€an€offense€under€this€section€may€beÏprosecuted€under€this€section€or€any€other€applicable€section,€but€not€both.ðð€€Tenn.ÏCode€Ann.€ðð€39„14„404(d).€€Courts€have€interpreted€this€statute€to€mean€that€if€theÏserious€bodily€injury€element€used€to€establish€the€especially€aggravated€burglaryÏoffense€€is€the€same€injury€that€is€an€element€of€an€accompanying€offense,€theÏdefendant€may€not€be€convicted€of€both€the€especially€aggravated€burglary€andÍthe€accompanying€offense.€€òòSeeóó€òòOlleróó,€851€S.W.2d€at€843;€òòState€v.€Hollandóó,€860ÏS.W.2d€53,€60€(Tenn.€Crim.€App.€1993).€€This€does€not€apply€to€Defendantððs€òòoneóóÏconviction€in€the€case€òòsubóó€òòjudiceóó.ÌÌà àFinally,€the€Defendant€argues€that€the€trial€court€erred€in€not€allowing€the€juryÏto€announce€the€verdict€as€to€its€decision€on€the€aggravated€assault€charge.€€AsÏaggravated€assault€was€only€to€be€considered€by€the€jury€if€the€jury€did€not€find€theÏelements€of€especially€aggravated€burglary,€then€there€was€no€error€by€the€foremanÏnot€reading€the€juryððs€verdict€on€the€aggravated€assault€charge.€€This€issue€has€noÏmerit.ÌÌà
