Thepetitionerenteredpleasofguiltytoburglaryfirstdegree,armedrobbery,andaggravatedrapepursuanttoapleabargainagreement.Theagreedsentenceswereten(10)yearsforburglaryfirstdegreeandtwenty(20)yearsforbotharmedrobberyandaggravatedrape.Itwasfurtheragreedthatthesentencesforburglaryfirstdegreeandarmedrobberywouldbeservedconcurrently,butthesentenceforaggravatedrapewouldbeservedconsecutivelytothesentenceforburglaryfirstdegreeforaneffectivesentenceofthirty(30)years.ThejudgmentofthetrialcourtwasenteredJune21,1985.Nodirectappealwastakenfromthejudgmentofthetrialcourt. Thetrialcourtcorrectlysummarilydismissedthepetitionersaction.Theactionwasbarredbythestatuteoflimitations.Thepetitionallegesagroundforpostconvictionrelief.Furthermore,thegroundwaswaivedbecauseitwasnotraisedandlitigatedinapriorpostconvictionaction.Moreover,thereisnoallegationcontainedinthepetitionwhichexplainswhythegroundraisedinthepresentactionwasnotwaived.Thereisnoclericalerrorallegedinthepetition.Thesentencesallegedinthepetitionwereproperinallrespects,andthepetitioneragreedtothesesentences.Finally,thepetitionerdoesnotpredicatehisactionuponaconstitutionalissue.Intheinitialparagraphofhispetition,itstatestheactionisbeingbroughtpursuanttoTenn.CodeAnn.395702 +   ׀andRule36,TennesseeRulesofCriminalProcedure.
