DistrictAttorneyGeneral DAVIDL.PUCKETT AssistantDistrictAttorneyGeneralRutherfordCountyJudicialBldg.Room303Murfreesboro,TN37130 OPINIONFILED:򀀀AFFIRMEDJOEG.RILEY,JUDGE  OPINION   Thedefendant,JamesPinkerton,appealsfromaDUIjudgmentofconvictionenteredbytheCircuitCourtofCannonCounty.ThedefendantpledguiltytoDUI,firstoffense,reservingtherighttoappealasacertifiedquestionoflawthetrialcourtsdenialofhismotiontosuppress.Tenn.R.Crim.P.37(b)(2)(i).Thedefendantcontendstheactionsofthearrestingofficerconstituteda stopforFourthAmendmentpurposes,andtheofficerlackedreasonablesuspicionbaseduponspecificandarticulablefactsthatacrimewasbeingcommittedorwasabouttobecommitted.Afterareviewoftherecord,thejudgmentofthetrialcourtisAFFIRMED.  BACKGROUND A.    CannonCountySheriffsDeputyCharlieHarrisreceivedatelephonecomplaintfromAprilGannon,whoresidedonHighway53South.SheadvisedthatthedefendantwasdrivingawhiteChevroletS10truckonHighway53South,andhehadbeendrinkingalcohol.SherequestedthatDeputyHarrisinvestigatethematter.DeputyHarrisproceededtothelocationtoinvestigatethecomplaint. Thedeputyfirstsawthedefendantaboutthirty(30)yardsfromGannonsdrivewayandobservedhimturnintothedriveway.DeputyHarrispulledinbehindthedefendantandparkedhisvehicle.Thedeputydidnotactivatehisbluelights.ThedefendantwaswalkingtowardthefrontdoorofGannonshousewhenthedeputyapproachedthedefendantandaskedforhisname.Whenthedefendantresponded,theofficernoticedanodorofalcoholonhisbreath.Whenaskedifhehadbeendrinking,thedefendantstatedhehad justacouple.DeputyHarristhenaskedthedefendanttoperformafieldsobrietytest.Duetothedefendantspoorperformanceonthefieldsobrietytest,thedefendantwasarrestedfordrivingundertheinfluence.  B.    Atthehearingonthemotiontosuppress,thetrialcourtfoundthattheactionsofDeputyHarrisdidnotconstitutean investigatorystop.ThequestioncertifiedtothisCourtiswhetherthetrialcourterred inoverrulingdefendantsMotiontoSuppresstheevidenceobtainedbyDeputyCharleyHarrisasaresultof[that]courtsfindingthattheDeputysconductwasnotastoprequiringthecourttoapplythelawinStatev.Cobb,[C.C.A.No.01C019011CC00366,HickmanCounty(Tenn.Crim.App.filedMay7,1991,atNashville)].  ANALYSIS    ThedefendantarguestheunreportedcaseofStatev.Cobb,supra,andStatev.Coleman,791S.W.2d504(Tenn.Crim.App.1989),arecontrollingoftheissuecertified.  A.   DeputyHarrisreceivedinformationfromacitizenwhogavehername,address,andspecificinformationaboutthedefendant.Thedeputyobservedavehiclematchingthedescriptiongivenbythecomplainantpullintoherresidence.Theofficerdidnotactivatehisbluelights,butsimplyparkedhisvehiclebehindthedefendantsinthedriveway.UnlikethefactsinCobbandColeman,DeputyHarrisdidnotstopthedefendantsvehicle.Thedefendantvoluntarilyparkedhisvehicleintendingtogoinsidetheresidence.ThereisnoshowingthedefendantstoppedhisvehicleasaresultofanyactionbyDeputyHarris.SeeStatev.Moore,776S.W.2d933,935(Tenn.1989).Accordingly,therewasnoinvestigatorystopofthevehicle.  B.   Defendantalsocontendsthathis seizurebyDeputyHarriswasnotsupportedbyspecific,articulablefacts. Wefindnoconstitutionalviolation.Theofficerwasonthepropertyofacomplainantwhoaskedforhisassistance.Thedefendantsvehiclewasnot stoppedbytheofficer.Theofficersimplyapproachedthedefendantandaskedhimhisname.Therewasnostoporseizureatthistime.SeeStatev.Moore,776S.W.2dat935;Statev.Butler,795S.W.2d680,685(Tenn.Crim.App.1990).Uponthedefendantresponding,theofficersmelledalcohol.Hethenhadsufficientcausetodetainthedefendantforfieldsobrietytests.Baseduponthedefendantspoorperformanceofthefieldsobrietytests,theofficerhadprobablecausetoarrestthedefendant.Wefindnounconstitutionalseizure.
