InDecember1996,TracyLee    Poarch   wasindictedforoperatingamotorvehicleafterhavingbeendeclaredahabitualoffenderinviolationofTennesseeCodeAnnotatedX/XXX/#X/XXX/K#Ԁ5510616(1993);drivingundertheinfluenceofan  intoxicant  < (  DUI  ),  thirdoffenseinviolationofTennesseeCodeAnnotatedX/XXX/#X/XXX/O#Ԁ5510401    (    Supp   .1996);andcriminalimpersonationinviolationofTennesseeCodeAnnotatedX/XXX/#X/XXX/2#Ԁ3916301(1990).Theappellantenteredapleaofguiltytothe P  criminalimpersonationcharge,andafterajurytrial,hewasconvictedonthetworemainingcharges.TheappellantwasorderedtoserveasentenceoftwoyearsintheTennesseeDepartmentofCorrectionforviolationofthehabitualoffenderstatus,ninemonthsinthecountyjailforthedrivingundertheinfluenceofanintoxicantconviction,andsixmonthsinthecountyjailforthecriminalimpersonationconviction,torunconcurrently. Theappellants  issuesarewhether    theevidenceissufficienttosustainhisconvictionfordrivingunderthe  influenceanddrivingafterhavingbeendeclaredahabitualoffender.Theargumentsarerelatedandwerecombinedintoone.Weaffirm.     Atapproximately4:30a.m.onMarch15,1996,OfficerHomerDavisoftheBedfordCountySheriffsDepartmentreceivedaradiocallaboutaonevehicleaccidentonHighway130inthePleasantGrovecommunity.HeandDetectiveRobertFilerdrovetothescenetoinvestigate.Onceonthescene,OfficerDavissawacarofftheroadandpartiallyinaditch.Therearwheelswerespinning,andthecarwas indrive.Also,theheadlightswereon,andthewindshieldwiperswererunning. DetectiveFilerknockedonthedriverssidewindowandattemptedtoawakenthepersonslumpedoverthesteeringwheel.Attrial,Fileridentified 8(4: thatpersonastheappellant.Fileropenedthedriverssidedoor,putthevehicleinpark,turnedtheignitionoff,andremovedtheappellantfromthevehicle. OfficerDavisandDetectiveFilertestifiedthattheappellantappearedtobeveryintoxicated.Hecouldbarelystandandcouldnotperformanyofthefieldsobrietytests.DetectiveFilerthenarrestedtheappellantandobservedthatappellantfortwentyminutesbeforeadministeringthe    breathalyzer   .Approximatelytwentyeightminuteslater,headministeredthe    breathalyzer   ,andtheresultsindicatedthattheappellanthadabloodalcoholcontentof.21.  Afterhewasarrested,theappellantstatedtoDetectiveFilerthathewas drivingaroundafterworkhavingafew.Whenaskedforhisdriverslicense,theappellantrespondedthathedidnothaveitwithhim.Heidentifiedhimselfas ThomasRay    Poarch   whowasbornin1972,butDetectiveFilerlaterdeterminedthat ThomasRay    Poarch   wasinfacttheappellantsbrother. OfficerDavistestifiedthatonlytheappellantwasinthevehicle.OfficerDavisstatedthathehadnotseenanyonewalkingtowardtheconveniencemarketfromthePleasantGroveareawherethevehiclewasfoundasheandDetectiveFilerweretravelingtotheaccidentscene.Also,OfficerDavistestifiedthathewasatthesceneapproximatelysixtyminutesanddidnotseeanyonearriveatthescenelookingfortheappellant. Todd    Poarch   ,theappellantsbrother,testifiedthathewasdrivingthevehiclethatnight,nottheappellant.Hestatedthathewasdrivingtohissistersresidencewhenheranthevehicleofftheroad.Healsostatedthathehadattemptedtogettheappellanttohelphim,buttheappellant,whohadbeen 0948 passedout,refused.Todd    Poarch   testifiedthathewalkedseveralmilestoaconveniencemarkettocallhismother.Hethenwaitedthereforhersoshecouldtakehimandhisbrotherhome.However,accordingtoTodd    Poarch   ,theappellantandthecarweregonewhenheandhismotherarrivedattheaccidentsceneatdaybreak. Theappellantsmother,Bessie    Poarch   ,testifiedthatshereceivedacallfromhersonToddintheearlymorninghoursonMarch15,1996.Shetestifiedthatshedrovefromherhomein    Cornersville   tothePantryconveniencemarketin    Shelbyville   topickupTodd.Theythendrovetotheaccidentsceneandarrivedtherearounddaybreak.However,theappellantandthecarwerenolongerthere. Theappellantcontendsthattheevidenceisnotsufficienttosupportthejuryverdict.Inhisbrief,theappellantinsiststhat[    t]he   evidenceagainstthe[appellant]failedtoprovebeyondareasonabledoubtthatthe[appellant]wasoperatingthemotorvehicle.However,heprovidesnospecificproofinsupportofhisargument. Thestateassertsthattheevidenceissufficienttosupporttheappellantsconvictionfordrivingundertheinfluenceofanintoxicant.Itcontendsthatit provedbeyondareasonabledoubtthattheappellantwasdrivingorhadphysicalcontrolofthevehicleonapublicroadandthatthe[appellant]wasundertheinfluenceofanintoxicant.Insupportofitsargument,thestatenotesthatuponthearrivalofOfficerDavisandDetectiveFiler,thecarwasstillindriveandwasstillrunning.Furthermore,thetireswerespinning,theheadlightswereon,andthewindshieldwiperswererunning.Inaddition,theappellantwasfoundbytheofficersinthedriversseatandslumpedoverthesteeringwheel. 0948  Thestatefurtherarguesthatbothofficersdeterminedthattheappellantwasveryintoxicated.Hewasunabletoperformanyfieldsobrietytests,butthe    breathalyzer   thatwasadministeredthirtyminuteslaterindicatedtheappellantsbloodalcoholcontentwas.21.Theappellantadmittedthathehadbeen drivingaroundafterworkhavingafew.Also,nootherindividualswereseeninthevicinityoftheappellantsvehicle.XXXX Greatweightisaccordedjuryverdictsincriminaltrials.Juryverdicts   accreditthestateswitnessesandresolveallevidentiaryconflictsinthestatesfavor.Statev.Williams,657    S.W.2d   405,410(Tenn.1983);Statev.Banes,874      S.W.2d   73,78(Tenn.    Crim   .    App   .1993).Onappeal,thestateisentitledtoboththestrongestlegitimateviewoftheevidenceandallreasonableinferenceswhichmaybedrawntherefrom.Statev.Cabbage,571    S.W.2d   832(Tenn.1978). 0 Moreover,guiltyverdictsremovethepresumptionofinnocence,enjoyedbydefendantsattrial,andreplaceitwithapresumptionofguilt.Statev.Grace, @ 493    S.W.2d   474(Tenn.1973).Appellants,therefore,carrytheburdenofovercomingapresumptionofguiltwhenappealingjuryconvictions.Id. App   .1978). 3.2  TennesseeCodeAnnotated#XXXX*#XXXXԀ5510401(    Supp   .1996)statesthatitis P726 unlawfulforanypersontodriveortobeincontrolofanyautomobileorother 0948 motorvehicleonanypublicroadsandhighwayswhileundertheinfluenceofanintoxicant.Fromourreviewoftherecord,theappellant,whohadabloodalcohollevelof.21,wasfoundbytwoofficersinthedriversseatandslumpedoverthesteeringwheelofacarthatwasstillindrive.Thetireswerespinning,theheadlightswereon,andthewindshieldwiperswererunning.Theappellantadmittedthathehadbeen drivingaroundafterworkhavingafew,andnootherindividualswereseeninthevicinityoftheaccidentsceneorontheroadtowardtheconveniencemarket.Basedontheforegoing,weconcludethatatrieroffactcouldhavefoundtheappellantguiltyofdrivingundertheinfluenceofanintoxicantbeyondareasonabledoubt.Theevidenceissufficient.  Nodisputeexiststhattheappellan thadbeendeclaredahabitu  almotorvehicleoffender.    Sincewehave  foundtheevidencesufficientasto    DUI    ,wefindtheevidenceequallysufficientastotheothercharge.
