Initially,wenotethatthetrialcourtsummarilydeniedthepostconvictionpetition.IndoingsothetrialjudgefailedtostateanyfindingsoffactandconclusionsoflawasisrequiredbyT.C.A.4030211(b).Thetrialcourt,nottheappellatecourt,hasthedutytoweighandevaluatetheevidenceandtoresolvequestionsregardingthecredibilityofwitnesses.Blackv.State,794S.W.2d752,755(Tenn.Crim.App.1990).Factualissuesraisedbytheevidencemustberesolvedbythetrialcourtandplacedinappropriatefindingsoffact.Absentsuchfindings,itwouldordinarilybeinappropriateforthisCourttodeterminecontestedfactualissuesfromaprintedrecord.GeorgeTatev.State,No.02C019108CR00170(Tenn.Crim.App.,atJackson,May20,1992),perm.app.denied,(Tenn.1992).  Regardless,thisCourthasheldthatevenifthetrialcourtfailstocomplywiththisduty,areversalisnotwarrantediftherecordsufficientlyreflectstheapparentreasonsforthetrialcourt'sactionssoastoallowformeaningfulappellatereview.Statev.Swanson,680S.W.2d487,489(Tenn.Crim.App.1984).Fromareviewoftherecordinthiscase,thetrialjudge'sreasonsfordismissalofthepostconvictionpetitionareapparent,andtherefore,wehaveaddressedtheissueonthemerits.̀  Thepetitionerarguesthathisattorneywasineffectivebecausehefailedtoobjectorotherwisecrossexaminethepoliceofficerregardingtheidentificationofavehicleatthesceneofthecrimeanditsrelationshiptothepetitioner.  Theproofattrialshowedthatthevictim,aparttimeemployeeataliquorstore,observedayoungblackmaleenterthestorenearclosingtime.Thevictim,aformerprincipalatalocalschool,thoughtherecognizedthepersonsface.Thevictimgaveadescriptionofthepersontotheinvestigatingofficer.Thefollowingweek,thevictimwenttothepolicestationandidentifiedthepetitionerwhilelookingthroughabookofphotographs.Subsequently,whenthepetitionerwaspickedupforquestioning,theofficertoldthepetitionerthathehadbeenidentifiedinarobbery.Theofficertestifiedthatthepetitionerresponded well,whatstheclerksnameatthestore.Hesaid,heprobablyknowsmefromschool.Whiletherewasconflictingtestimonyastowhetherthevictimpositivelyidentifiedthepetitioneratthepreliminaryhearing,heunequivocallyidentifiedthepetitionerattrial.  Thetestimonyregardingthevehiclewasinsignificant.Trialcounselobjectedonthebasisofhearsay,however,theinvestigatingofficerwasallowedtotestifythathewasgivenadescriptionofavehiclethatwasseeninthevicinityoftheliquorstoreandthathewasabletotieavehicleofthatdescriptionwiththepetitionerthroughthepetitionersgirlfriend.Atthepostconvictionhearing,trialcounseltestifiedthatthepetitionerwasidentifiedbythevictimandthecardidnothaveanythingtodowiththatidentification.Moreover,hetestifiedthathedidnotpursuetestimonyregardingthecarbecauseitwouldhavebeendetrimentaltothecase.Specifically,trialcounselnotedthatwhentheinvestigatingofficerquestionedthepetitionersgirlfriendregardingwhethersheownedamaroonMonteCarlo,sherespondedthatshedid butitaintbeenusedinnoarmedrobbery.  Inordertoreceivepostconvictionreliefonthebasisofineffectiveassistanceofcounsel,thepetitionermustfirstestablishthattheservicesrenderedortheadvicegivenwasbelow"therangeofcompetencedemandedofattorneysincriminalcases."Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Second,hemustshowthatthedeficiencies"actuallyhadanadverseeffectonthedefense."Stricklandv.Washington,466U.S.668,693,104S.Ct.2052,2067,80L.Ed.2d674(1984).Moreover,thisCourtwillnotsecondguessvalidstrategicandtacticalchoicesmadebycounsel,andcounselwillnotbedeemedineffectiveevenifadifferentstrategymighthaveproducedadifferentresult.Hellardv.State,629S.W.2d4,9(Tenn.1982).
