(#(    ` Attherevocationhearing,thedefendantadmittedthatshehadbeenchargedin p*%* LincolnCountywith22countsofwritingworthlesschecksandthatshehadbeenconvictedofseven \+&+ oftheseoffenses,withtheremainingfifteenhavingbeendismissedwiththeagreementthatshe H,', wouldpayrestitution.Thedefendanttestified,however,thatshehadmaderestitutiononall22 4-(- _checksandhadpaidallcourtcostsandsupervisionfeesassessedtoher.Thedefendantalso  admittedthatshehadnotpaidanyprobationsupervisionfeesonherDeKalbCountydrugcases;she  claimedthatshehadbeenfinanciallyunabletodosoduetoherdifficultyinobtainingsteady  employmentandthecostsassociatedwiththerearingofhertwoteenagechildren. t    ` Thedefendantprovidedadditionalbackgroundinformationabouthersituation.She L  testifiedthatshehadreceiveda largeworkerscompensationsettlementforabackinjury.The 8  defendantwasworkingatnight,andsheprovidedherseventeenyearolddaughterwithafewsigned $ t checksforthedaughtersusewhilethedefendantwasatwork.Thedefendantclaimedshehadnot  ` keptcloseenoughtrackofherownspendingandthatofherdaughterandthroughinadvertence,the  L  bankaccountbecameoverdrawn.Thedefendantmaintainedthatshenevermeanttobedishonest  8  withanyone,andbecausethechecksborehersignature,sheowneduptothemistake,pleadedguilty, $  andpaidalloftherequiredrestitutionandcosts.      ` Thedefendanttestifiedthatfollowingherbackinjury,shewasunabletoworkfor   severalmonths.Duetotheinjury,shehaslimitsonthetypeofworksheisabletodo.Atthetime   ofthehearing,shewaslaidofffromaproductionjobatDixieMetalCraft.Sherelatedthat p followingtheWorldTradeCenterattacks,theplanthadlaidoffover40percentofitspersonnel,and \ theremainingpersonnelwereworkingreducedhours.Priortothelayoff,thedefendanthadbeen H working55hoursaweek.ThehearingwasheldinDecember2001,andthedefendanthopedthat 4 shewouldberecalledtoworkafterthefirstoftheyear.Withrespecttotheunpaidprobationfees,  p thedefendanttestifiedthatshehadbeenfinanciallystrappedgivenherworksituation,the  \ requirementthatshemakerestitutionontheworthlesschecks,andthecostsassociatedwithhertwo H children.Sheclaimed, ImdoingtheverybestthatIcando. 4    ` Whenaskedaboutherpriorrevocationinthesecases,thedefendanttestifiedthatshe   hadbeenusingdrugsbutrealizeditwouldbeinherbestinteresttoseekhelp.Shecheckedherself  intoaninpatientrehabilitationprograminNashville,andsheaskedhercounselorattheprogram  tonotifyherprobationofficerwhereshewas.Afterasevendayinpatientstay,thedefendanthad  theoptionofreturningtoherhomeinSmithvilleorgoingtoahalfwayhouseinLewisburg.Because l thedefendantknewthatshewouldfallbackintothedrugcultureifshereturnedtoheroldfriends X  inSmithville,shechosethelatteroption.Shetestifiedthatthewarrantfornotreportingwasissued D! asaresultofhertimeinthehalfwayhouseinLewisburg.Sheclaimedthathavingtheopportunity 0"  togetherselfoffofdrugshadbeenworththesubsequent45daysshehadtoserveinjailforthe #l! probationviolation. $X"    ` Thedefendantimploredthecourttogiveheranotheropportunityonprobation.She %0!$ claimedthatshehadworkedveryhardtoremaindrugfreeandtobuildasolidreputationinthe &"% communityinLincolnCountywhereshehadrelocated.Shewantedtheopportunitytostayoutof '#& jailsothatshecouldparentherchildren.Throughcounsel,thedefendantproposedthatthetrial (#' courtextendherprobation,ratherthanrequiringhertoservetheentiresentence. )$(   |*%)    ` Thelowercourtacknowledgedthatthedefendanthad alotofpositivethingstobe   said...in[her]behalf.However,thecourtfoundthatthedefendanthadbeenaffordedprior  opportunitiesofwhichshehadnotavailedherself.Thecourtfoundthatitcouldnotoverlookthe  convictionsandthenonpaymentoffees,anditfoundthatthedefendanthadthemeanstopayatleast t someofthefeesbuthadselectivelychosennottodoso. `    ` Thedefendantfiledthisappeal,inwhichshedoesnotarguewiththecourtsdecision 8  torevokeprobationbutdoesquestiontheorderthatsheserveheroriginalfouryearsentence,rather $ t thananorderthatsheserveanadditionaltwoyearsonprobation.Thedefendantraisestheharshness  ` ofthisremedygiventhatshehadservedallbutapproximately60daysofherfouryearsentence  L  whentherevocationwarrantwasissued.  8     ` Thestandardofreviewuponappealofanorderrevoking% 6 %6&probationistheabuseof   discretionstandard.Statev.Harkins,811S.W.2d79,82(Tenn.1991).Inorderforanabuseof   discretiontooccur,thereviewingcourtmustfindthattherecordcontainsnosubstantialevidence   tosupporttheconclusionofthetrialjudgethataviolationofthetermsofprobationhasoccurred.
