àThe€appellant,€Grant€Lee€œProvencher›,€appeals€as€of€right€the€sentence€heÏreceived€following€a€guilty€plea€in€the€Washington€County€Criminal€Court.€€TheÏappellant€pled€guilty€to€reckless€homicide,€a€Class€D€felony,€and€was€sentenced€as€aÏRange€I€standard€offender€to€three€(3)€years€in€the€Washington€County€jail.€€HeÏcontends€on€appeal€that€the€trial€court€erred€in€denying€his€request€for€alternativeÏsentencing.€€Ìà àAfter€a€review€of€the€record,€we€affirm€the€judgment€of€the€trial€court.Ìà àThe€facts€of€this€case€demonstrate€once€again€how€the€mixing€of€alcohol€withÏdangerous€instrumentalities€can€result€in€senseless€tragedy.€€On€February€6,€1996,Ïthe€appellant€was€drinking€alcoholic€beverages€and€socializing€with€friends€in€hisÍJohnson€City€apartment.€€Among€those€participating€in€the€party€were€the€victim,ÏJason€œMcWatters›,€and€his€girlfriend,€Summer€Phillips.€€During€that€evening,€theÏappellant€entered€his€bedroom€and€brought€out€a€.357€caliber€hand€gun.€€HeÏremoved€the€magazine€clip€from€the€pistol€and€allowed€Ms.€Phillips€to€handle€it.€€SheÏpointed€it€and€proceeded€to€click€the€hammer€as€if€to€fire€the€weapon.€€When€sheÏreturned€the€weapon€to€the€appellant,€he€aimed€it€at€Ms.€Phillips€and€began€cockingÏand€depressing€the€hammer.€€During€that€time,€the€gun€made€a€clicking€noise€butÏnever€fired.Ìà àThe€victim€told€appellant€not€to€point€the€gun€at€Ms.€Phillips;€however,€theÏappellant€assured€him€that€the€gun€was€unloaded.€€Thereafter,€the€appellant€aimedÏthe€gun€directly€at€the€victimððs€head€and€depressed€the€hammer.€€The€gun€fired€aÏbullet€into€the€victimððs€forehead,€killing€him€instantly.€€Although€the€appellant€tried€toÏhelp€the€victim,€he€panicked€and€fled€from€the€apartment€upon€finding€that€the€victimÏhad€no€pulse.€€Before€leaving,€the€appellant€stated,€ð ðyou€guys€donððt€know€me,€youÏguys€donððt€know€what€happened,€Iððve€got€to€get€out€of€here!ððÌà àThe€appellant€was€indicted€by€the€Washington€County€grand€jury€for€theÏoffense€of€reckless€homicide.€€He€entered€a€plea€agreement€whereby€he€pleadedÏguilty€to€reckless€homicide€and€received€a€three€(3)€year€sentence€as€a€Range€IÏstandard€offender.€€The€trial€court€conducted€a€sentencing€hearing€and€ordered€theÏappellant€to€serve€his€entire€sentence€in€the€Washington€County€jail.€€The€appellantÍargues€on€appeal€that€the€trial€court€erred€in€denying€his€request€for€alternativeÏsentencing.€€He€contends€that€he€is€a€suitable€candidate€for€probation€or€some€otherÏsentencing€alternative€to€incarceration.Ìà àThis€issue€is€without€merit.Ìà àWhen€a€defendant€challenges€the€length,€range,€or€manner€of€his€sentence,Ïwe€must€conduct€a€òòde€novoóó€review€of€the€record.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„401(d)€(Supp.€1996).€€The€sentence€imposed€by€the€trial€court€is€accompanied€by€aÏpresumption€of€correctness€and€the€appealing€party€has€the€burden€of€showing€thatÏthe€sentence€is€improper.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„401€(SentencingÏCommission€Comments).€€However,€the€presumption€of€correctness€is€conditionedÏupon€an€affirmative€showing€in€the€record€that€the€trial€court€considered€theÏsentencing€principles€and€all€relevant€facts€and€circumstances.€€òòSeeóó€òòState€v.€œAshby›óó,Ï823€S.W.2d€166,€169€(Tenn.€1991).Ìà àTo€determine€the€appropriate€sentence,€the€trial€court€must€consider€theÏfollowing:€€(1)€evidence€from€the€trial€and€sentencing€hearing;€(2)€the€presentenceÏreport;€(3)€the€principles€of€sentencing€and€the€arguments€concerning€sentencingÏalternatives;€(4)€the€nature€and€characteristics€of€the€offense;€(5)€information€offeredÏby€the€State€or€the€defendant€concerning€enhancing€or€mitigating€factors;€and€(6)€theÏdefendantððs€statements€in€his€own€behalf€concerning€sentencing.€€òòSeeóó€€Tenn.€CodeÏAnn.€ðð€40„35„210(b);€òòseeóó€òòalsoóó€òòState€v.€Smithóó,€735€S.W.2d€859,€863€(Tenn.€Crim.€App.Í1987).€€Ìà àIn€this€case,€the€trial€court€considered€the€evidence€from€the€sentencingÏhearing,€the€presentence€report,€and€all€relevant€factors€and€circumstances€beforeÏordering€the€appellant€to€serve€three€(3)€years€in€the€Washington€County€jail.€€We,Ïtherefore,€review€appellantððs€sentence€with€a€presumption€of€correctness.€€Ìà àThe€trial€court€acknowledged€that€the€appellant€was€a€presumable€candidateÏfor€alternative€sentencing€under€Tennessee€Code€Annotated€section€40„35„102.× ƒ' ××  ×€ÏThe€appellant€pled€guilty€to€reckless€homicide,€a€Class€D€felony,€and€he€wasÏsentenced€as€a€Range€I€standard€offender.€€However,€the€trial€court€found€that€theÏstatutory€presumption€was€rebutted€by€evidence€to€the€contrary.€€We€agree.€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€€Ïà ðmeasures€less€restrictive€than€confinement€haveÏfrequently€been€applied€unsuccessfully€to€the€defendant,ðð€and€whether€the€defendantÏhas€a€potential€for€rehabilitation€or€treatment.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„103(1),Ï(5)€(Supp.€1996).€€€à àà àÌà àThe€trial€court€examined€the€above€factors€in€determining€that€the€appellantÏshould€serve€his€three€(3)€year€sentence€in€confinement.€€From€the€appellantððsÏtestimony€at€the€sentencing€hearing,€the€trial€court€found€that€the€appellant€was€soÏintoxicated€on€the€night€of€the€shooting€that€his€memory€had€been€disturbed.€ÏFurthermore,€the€appellant€admitted€that€since€the€time€of€the€offense,€he€hadÏrepeatedly€binged€on€drugs€and€alcohol€to€avoid€dealing€with€the€consequences€ofÏhis€actions.€€The€trial€court€determined€that€although€there€was€no€evidence€thatÏconfinement€would€provide€deterrence,€there€was€proof€that€the€violent€offenseÏcoupled€with€appellantððs€intoxication€presented€a€major€public€concern.€€€Ìà àMoreover,€the€trial€court€found€that€the€offense€involved€multiple€enhancementÏfactors€including€the€appellantððs€criminal€history,€more€than€one€victim,€the€use€of€aÏfirearm,€and€no€hesitation€about€committing€a€crime€when€the€risk€to€human€life€wasÏhigh.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„114€(1),(3),(9),€&€(10)€(Supp.€1996).× ×€€FromÍappellantððs€presentence€report,€the€trial€court€found€that€the€appellant€had€two€priorÏassault€convictions€for€which€he€served€probationary€sentences.€€While€servingÏprobation€for€the€second€assault€conviction,€the€appellant€was€held€in€contempt€ofÏcourt€for€failing€to€pay€restitution.€€Ìà àThe€appellantððs€social€history€and€present€condition€also€influenced€the€trialÏcourtððs€decision.€€The€trial€court€found€that€the€appellant€was€a€high€school€dropoutÏwith€a€history€of€underage€drinking€and€drug€abuse.€€Although€the€appellant€hadÏreceived€a€œG.E.D.›€and€planned€to€attend€college,€he€had€demonstrated€an€inability€to€Ïmaintain€employment€and€to€improve€his€life€due€to€persistent€substance€abuseÏproblems.× ƒ) ××  ×€€Ìà àMoreover,€there€was€a€question€as€to€whether€the€appellant€was€trulyÏremorseful€for€the€reckless€killing€of€the€victim.€€As€the€trial€court€noted,€the€appellantÏtestified€that€he€felt€sorrow€and€regret€for€his€actions€on€the€night€of€the€shooting;Ïhowever,€he€did€not€express€those€feelings€until€he€was€recalled€to€testify€by€his€trialÏcounsel.× ƒ+ ××  ×€€Furthermore,€the€appellant€admitted€that€he€had€relied€upon€alcohol€andÍdrugs€to€escape€from€the€consequences€of€his€actions.€€Based€upon€that€evidenceÏand€the€appellantððs€probation€record€for€two€previous€violent€offenses,€the€trial€courtÏdetermined€that€appellantððs€potential€for€rehabilitation€was€ð ðnot€good.ðð€€€€€€€€€€€€€€€€€€€€Ìà àFrom€our€òòde€novoóó€review,€we€find€that€the€trial€court€was€justified€in€denying€anÏalternative€sentence.€€While€not€relying€solely€upon€the€violent€nature€of€the€presentÏoffense,€we€conclude€that€the€offense€combined€with€appellantððs€history€of€substanceÏabuse,€intoxication,€and€previous€violent€offenses,€rebutted€the€presumption€that€heÏwas€a€favorable€candidate€for€alternative€sentencing.€€The€appellant€has€served€twoÏprior€probationary€sentences,€yet€he€has€continued€to€mix€alcohol€and€drugs€withÏdangerous€criminal€activities.€€Ìà àThe€evidence€fails€to€demonstrate€how€a€probationary€sentence€in€this€caseÏwould€ð ðsubserve€the€ends€of€justice€and€the€best€interest€of€both€the€public€and€theÏdefendant.ðð€€òòSeeóó€òòState€v.€Dykesóó,€803€S.W.2d€250,€259€(Tenn.€Crim.€App.€1990),€òòper.Ïapp.€deniedóó€(Tenn.€1990).€€We,€therefore,€conclude€that€the€appellant€has€failed€toÏcarry€his€burden€of€showing€that€his€sentence€was€improper.€€Ìà
