ÐTenn.€R.€Evid.€601.€€To€testify€to€a€matter,€a€witness€must€have€personal€knowledge€of€that€matter.€Ð  $\" ÐòòSeeóó€Tenn.€R.€Evid.€602.€€Here,€there€is€no€legal€reason€why€the€victimððs€testimony€was€insufficientÐ ø$H # Ðto€prove€her€age€or€that€the€State€was€required,€as€the€defendant€suggests,€to€offer€ð ðofficialÐ ä%4!$ Ðdocumentationðð€of€age.€€òòSeeóó€òòState€v.€Banesóó,€874€S.W.2d€73,€78€(Tenn.€Crim.€App.€1993)€(in€anÐ Ð& "% Ðaggravated€rape€case,€victimððs€testimony€that€she€was€eleven€years€old€at€the€time€of€intercourse€wasÐ ¼' #& Ðsufficient€proof€that€the€victim€was€under€the€age€of€thirteen).€€Although€it€is€the€Stateððs€burden€toÐ ¨(ø#' Ðprove€every€element€of€a€crime,€the€proof€of€the€victimððs€age€was€never€challenged€by€the€defendantÐ ”)ä$( Ðat€trial.€€On€appeal,€the€defendant€offers€no€authority,€nor€are€we€aware€of€any,€that€the€testimony€ofÐ €*Ð%) Ða€victim€is€insufficient€to€establish€the€victimððs€age.€€Furthermore,€the€investigating€police€officers,Ð l+¼&* ÐTommy€Massey€and€David€Harrison,€testified€without€objection€that€she€was€twelve€at€the€time.€Ð ° ÐAccordingly,€we€conclude€that€the€testimony€at€trial€was€sufficient€to€prove€beyond€a€reasonableÐ œì Ðdoubt€that€the€victim€was€under€the€age€of€thirteen€when€the€aggravated€sexual€battery€occurred.€€€Ð ˆØ ЀÌà  àThe€defendant€next€argues€that€the€impeachment€of€the€Stateððs€witnesses€that€took€placeÐ `° Ðduring€cross„examination€rendered€their€testimony€incredible.€€Specifically,€he€asserts€that€fourÐ L œ Ðinconsistencies€seriously€undermine€the€credibility€of€the€Stateððs€witnesses.€€The€fact€that€theÐ 8 ˆ Ðwitnesses€were€impeached€does€not€necessarily€make€the€evidence€insufficient€to€convict€theÐ $ t Ðdefendant€of€aggravated€sexual€battery.€€Ð  ` ÐÌ€à  àFirst,€on€direct€examination,€Myah€Smith,€who€was€in€the€room€with€the€victim€and€theÐ è 8  Ðdefendant,€testified€that€the€defendant€ð ðwas€feeling€on€herðð€with€his€hand€ð ðdown€in€her€pants.ðð€€OnÐ Ô$  Ðcross„examination,€she€testified€that,€during€a€pretrial€interview,€she€never€mentioned€ð ðany€kind€ofÐ À  Ðtouchingðð€and€that€the€first€time€she€said€she€had€witnessed€the€defendant€touching€the€victim€wasÐ ¬ü  Ðon€direct€examination.€€Second,€on€both€direct€and€cross€examinations,€the€victim€testified€that€sheÐ ˜è  Ðwas€ð ðnot€sureðð€whether€the€defendant€ð ðplaced€his€finger€inside€of€[her]€the€first€time€or€the€secondÐ „Ô  Ðtimeðð€he€put€his€hand€in€her€pants.€€Third,€the€victim€testified€that€she€told€her€brother€about€theÐ pÀ Ðincident€as€they€were€walking€home€from€the€Smith€residence.€€Her€brother€testified,€however,€thatÐ \¬ Ðthe€victim€told€him€about€it€before€they€left€the€apartment.€€Fourth,€after€the€third€time€the€defendantÐ H˜ Ðlaid€on€top€of€the€her,€the€victim€testified€that€she€thought€he€had€left€the€room€while€Myah€SmithÐ 4„ Ðtestified€that€he€sat€down€in€a€chair.Ô‡ XXXXÔÐ  p ÐÌà  àIn€making€this€argument,€the€defendant€fails€to€acknowledge€the€inconsistencies€of€his€ownÐ øH Ðstatements.€€He€first€told€Officer€Massey€that€he€was€not€at€the€Smith€residence€on€the€night€inÐ ä4 Ðquestion.€€When€Officer€Massey€suggested€to€him€that€he€could€prove€that€he€was€there€that€night,Ð Ð  ÐÔ#†XXX XH#ÔÔ‡ XXXXÔthe€defendant€later€recanted€this€story€and€claimed€to€have€been€there€until€4:00€a.m.€€Ruth€SmithÐ ¼  Ðtestified€that€he€was€there€until€7:00€a.m.€€During€his€direct€examination,€the€defendant€testified€thatÐ ¨ø Ðhe€left€at€6:15€a.m.€and€that€Ô#†XXX XÒI#ÔÔ‡ XXXXÔhe€did€not€recall€what€he€told€the€police€when€he€was€questioned€aboutÐ ”ä Ðhis€whereabouts€on€the€night€in€question.׃×Ý ƒ#ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€Ô#†XXX X&K#ÔÔ‡ XXXXÔÐ €Ð ÐÔ#†XXX X@L#ÔÌà  àAdditionally,€the€defendant€asserts€that,€because€he€was€acquitted€of€the€charge€of€child€rape,Ð X ¨ Ðthe€jurors€did€not€believe€the€victimððs€testimony€on€the€issue€of€penetration.׃×Ý ƒ#ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€€He€reasons€that€if€theÐ D!” Ðjury€chose€not€to€accredit€the€victimððs€testimony€on€that€issue,€it€necessarily€follows€that€they€shouldÐ 0"€  Ðnot€have€believed€her€testimony€concerning€any€sexual€contact€that€may€have€taken€place€betweenÐ #l!
