àThis€Courtððs€decision€in€the€direct€appeal€was€entered€on€November€21,€1995.ÏHowever,€appellantððs€counsel€did€not€file€the€application€for€permission€to€appealÏuntil€March€29,€1996,€approximately€two€(2)€months€after€the€sixty€(60)€day€time€limit.€ÏTenn.€R.€App.€P.€11.€€Counsel€did€not€receive€a€copy€of€our€November€opinion€untilÏFebruary€1,€1996,€and€apparently€thought€that€he€had€sixty€(60)€days€from€February€1Ïto€file€the€application€for€permission€to€appeal.€€Ìà àAfter€filing€the€application,€appellantððs€counsel€filed€a€motion€to€late„file€hisÏbrief.€€The€Supreme€Court€denied€the€motion€and€subsequently€dismissedÏappellantððs€application€for€permission€to€appeal.€€Counsel€next€filed€a€motionÏrequesting€this€Court€to€vacate€and€re„enter€its€judgment€of€November€21,€1995.€€WeÏdenied€the€motion€on€July€17,€1996.Ìà àThe€trial€court€at€the€post„conviction€hearing€reviewed€the€above€evidence€andÏconcluded€that€a€factual€basis€existed€to€grant€a€delayed€appeal.€€However,€the€trialÏcourt€dismissed€appellantððs€petition€for€a€lack€of€jurisdiction€in€accordance€withÏòòPinkston€v.€Stateóó,€668€S.W.2d€676,€677„78€(Tenn.€Crim.€App.€1984),€òòper.€app.€deniedóóÏ(Tenn.€1984).Ìà
