AtthetimeofAnthony,theoffenseofkidnappingwasdefinedinsuchawaythatitwouldnecessarilyandalwaysbecommittedwhenapersoncommittedeitherarobberyorarape.ItwasthisinclusionoftheelementsofkidnappingineveryrobberyorrapethatgaverisetothesupremecourtinAnthonyconcludingthatthelegislaturedidnotcontemplateakidnappingconvictionoccurringwitheachandeveryrobberyorrapeconviction.Itwaswithinthisframeworkthatthecourtdevisedatesttodeterminewhenmultipleconvictionscouldbehad,i.e.,whetherthekidnappingwasmorethanjustessentiallyincidentaltotheaccompanyingfelony. Idonotbelieve,though,thatAnthonyreachestothiscase.Thisisbecauseacarburglaryisnotnecessarilycommittedwitheachandeverytheftofacar.Themajorityopinionacknowledgesasmuch,butitstatesthatthemajorityofthepaneldoesnotbelievethatthelegislatureintendedthatstealingacarwouldconstitutebothburglaryandtheft.However,itistheveryfactthatitwouldbedifficultalthoughnotimpossibletostealacarwithoutsomemannerofintrusionthatleadsmetobelievethatthelegislatureintendedtoapplybothburglaryandthefttothefactsinthiscase.Theburglaryprecedesandfacilitatesthetheftandisnotessentiallyincidentaltoit.Withouttheburglary,thetheftofacarbecomesmuchmoredifficult. ThemajorityopinionreliesuponStatev.Roberts,943S.W.2d403(Tenn.Crim.App.1996),inwhichtheprinciplesofAnthonyweresimilarlyusedtovacateacarburglaryconvictionwhilesustaininganattemptedcartheftconviction.InotethatIdissentedinRobertsforthesamereasonsthatIpresentinthiscase.Inthissense,IbelievethatthereasoningusedinRobertsasappliedinthiscaseinthemajorityopinionshouldbereconsidered.      _____________________________      JosephM.Tipton,Judge
