àThe€appellant,€Larry€Dale€Ramsey,€appeals€the€decision€of€the€SullivanÏCounty€Criminal€Court€imposing€an€effective€eight€year€Department€of€CorrectionÏsentence€following€entry€of€his€guilty€pleas€to€one€count€of€rape€and€two€counts€ofÏsexual€battery.€€€In€this€appeal,€the€appellant€contends€that€the€trial€court€erred€inÏdenying€him€a€non„incarcerative€alternative€sentence.ÌÌà àAfter€a€review€of€the€record,€we€affirm€the€sentence€imposed€by€the€trialÏcourt.ÌÌÌà@ àò òBackgroundó óÌÌà àThe€appellantððs€convictions€result€from€the€appellantððs€ongoing€sexualÏabuse€of€the€thirteen€year€old€daughter€of€his€live„in€girlfriend.€The€appellantÏconceded€that€his€aberrant€behavior€began€in€June€1994.ÌÓÓà8 àWhen€we€lived€in€Bristol€Heights,€about€15€months€or€so€ago.€€[TheÏvictim]€was€fourteen€years€old€and€we€were€laying€on€the€couchÏtogether,€I€had€been€watching€tv€when€she€came€over€to€lay€down.€ÏShe€asked€me€to€rub€her€back€and€I€was€rubbing€it.€€I€thought€she€wasÏawake,€but€she€might€have€dozed€off.€€I€believe€she€was€wearingÏshorts€and€a€shirt.€€The€shirt€was€pulled€up€so€I€could€rub€her€back.€€IÏwas€almost€asleep€myself,€but€I€remember€putting€my€hand€down€theÏback€of€her€shorts€and€rubbed€her€[vagina].€€After€I€rubbed€it,€I€put€myÍfinger€in€her.€€I€only€left€it€in€her€for€a€couple€of€seconds€and€I€stoppedÏbecause€I€knew€what€I€was€doing€was€wrong.€€I€donððt€know€if€she€wasÏawake€or€not€when€I€did€it,€but€she€did€wake€up€later€and€get€(sic)€upÏto€go€to€bed.€€I€never€touched€her€again€until€we€moved€to€416€HilltopÏRd.€€I€have€never€put€my€finger€in€her€since€then.€€I€have€rubbed€herÏbreasts€over€her€clothes€maybe€12€times€over€the€last€year.€€I€haveÏalso€rubbed€her€[vagina]€over€her€clothes€and€under€her€clothes€quiteÏa€few€times€over€the€last€year.€€Iððve€never€done€any€of€these€things€toÏher€with€her€permission€or€while€I€thought€she€was€awake.€€I€neverÏwanted€to€hurt€[her]€and€Iððm€not€sure€why€I€did€this€to€her.ÌÌÌÓÓSince€the€occurrence€of€these€offenses,€the€victim€and€her€mother€have€moved€outÏof€the€appellantððs€home.ÌÌà àAlthough€charged€with€one€count€of€rape€and€thirteen€counts€of€sexualÏbattery,€the€appellant€pled€guilty,€on€January€6,€1997,€to€one€count€of€rape€and€twoÏcounts€of€sexual€battery.€€The€negotiated€plea€agreement€provided€that€theÏappellant€would€be€sentenced€to€eight€years€for€rape€and€to€one€year€for€eachÏcount€of€sexual€battery,€all€to€run€concurrently.€€The€manner€of€service€of€theÏsentences€were€to€be€submitted€to€the€trial€court.€€On€May€2,€1997,€a€sentencingÏhearing€was€conducted.ÌÌà àNo€witnesses€were€called€by€the€State€or€the€appellant€at€the€sentencingÏhearing.€€Rather,€the€parties€submitted€and€relied€upon€the€presentence€report€andÏletters€of€good€character€from€the€appellantððs€ex„wife€and€his€employer.€€TheÏpresentence€report€revealed€that€the€appellant€is€a€forty„four€year€old€high€schoolÍgraduate€with€no€prior€criminal€record.€€He€is€in€good€physical€and€mental€conditionÏand€does€not€drink€alcohol€nor€does€he€use€illegal€drugs.€€The€appellant€has€twoÏadult€children€from€a€prior€marriage€that€ended€in€1980.€€Since€1982,€he€hasÏmaintained€stable€employment€as€an€electrician.€€ÌÌà àIncluded€in€the€presentence€report€was€a€statement€made€by€the€victim:ÌÓÓÌà8 àIf€you€grew€up€without€a€father€you€would€probably€understand€how€IÏfeel.€€Thereððs€nothing€worse€than€the€feeling€of€seeing€all€of€theseÏfamilyððs€[sic]€happy€and€knowing€that€your€family€isnððt€completelyÏcomplete€without€a€father.€€Then€when€you€have€the€chance€to€have€aÏreal€family,€everything€just€goes€away€just€like€it€was€a€dream.€€I€donððtÏknow€if€the€judge€will€put€him€on€probation€or€send€him€to€prison€but€IÏdo€know€that€if€there€is€any€way€possible€that€I€could€still€have€contactÏwith€him€I€would€be€the€happiest€girl€in€the€world.€€I€wouldnððt€care€ifÏthere€had€to€be€someone€with€us€at€all€times€when€I€see€him,€just€asÏlong€as€I€still€got€to€see€him.€€I€always€believed€that€you€learn€fromÏyour€mistakes.€€In€this€case€its€a€big€one€but€that€doesnððt€mean€youÏhave€to€be€punished€for€every€mistake€that€you€made.€€I€know€that€if€IÏgot€sent€off€for€every€big€mistake€that€I€made€I€would€be€sent€off€untilÏIððm€50.€€So€what€Iððm€saying€is€or€should€I€say€asking€is,€please€donððtÏput€him€in€prison.ÌÌÓÓà àThe€trial€court€also€had€the€benefit€of€a€psycho€sexual€evaluation€of€theÏappellant€completed€by€Counseling€and€Consultation€Services,€Inc.,€a€private€non„profit€counseling€center€in€Johnson€City.€€The€clinical€interview€of€the€appellantÏindicated€that€the€appellant€ð ðappears€to€have€significantly€objectified€his€victimÏgiving€minimal€thought€to€how€his€offending€was€affecting€her.€€He€is€unaware€ofÏhow€his€being€sexual€with€his€victim€has€negatively€affected€her€despite€reporting€ofÏher€running€away,€being€placed€in€detention,€etc.ðð€€The€evaluation€concluded€thatÍthe€appellant€was€in€need€of€Specialized€Sexual€Offender€Treatment,€which€couldÏbe€maintained€on€an€out„patient€basis,€and,€more€significantly,€that€the€appellantÏð ðshould€have€ò ònoó ó€contact€with€anyone€under€the€age€of€18.€.€.€.ðð€€(emphasis€inÏoriginal).€€€€ÌÌà àThe€court,€in€a€thorough€application€and€consideration€of€relevantÏsentencing€principles,€found:ÌÓÓà8 àSo,€[the€victim]€was€just€less€than€a€month,€maybe,€two,€three€weeksÏpast€her€thirteenth€birthday€when€this€all€started.€.€.€.€€[Y]ou€[stated],€.€.€.ÏððWhat€I€did€was€wrong.€.€.€.€€This€sort€of€thing€.€.€.€will€never€happenÏagain.ðð€€Well,€now,€I€am€assuming€that€statement€went€to€whatÏhappened€in€1994.€€But€it€happened€in€1995€twice,€and€thatððs€justÏwhat€you€pled€guilty€to.€€Thatððs€two€more€sexual€battery€offensesÏagainst€the€same€victim€in€1995.€€You€had€a€whole€year€to€think€aboutÏit.€€€.€.€.€€You€state,€€I€care€about€[the€victim]€and€her€mother€very€much;Ïand€if€I€am€put€on€probation,€I€believe€that€I€pose€no€threat€to€anyone.€ÏYou€have€lived€and€worked€in€the€community€for€the€past€twenty„fiveÏyears.€€And€have€never€caused€problems€for€anyone€before€thisÏincident.€€Now,€her€mother€was€your€live„in€girlfriend€for€seven€years.€ÏThe€little€girl€said,€ððIt€didnððt€really€hurt€me€mentally€until€I€found€out€thatÏLarry€may€go€to€prison.€.€.€.€ð ð€€Now,€that€is€pitiful.€€.€.€.ÌÌà8 àSheððs€fifteen€years€old.€€She€is€still€too€young€to€have€any€judgmentÏabout€what€you€did€to€her.€.€.€.€€Seven€years,€she€was€what,€six€yearsÏold€when€you€started€living€with€her€mother.€€€.€.€.€And€the€probationÏreport€states€no€mitigating€factors.€€It€lists€two€enhancing€factors,€itÏinvolved€a€victim,€was€committed€to€gratify€the€defendantððs€desire€forÏpleasure€or€excitement.€You€abused€a€position€of€public€or€privateÏtrust.€€.€.€.ÌÌà8 àYou€have€no€prior€record.€€You€completed€high€school.€€You€went€to€aÏvocational€school€to€become€an€electrician.€€Thatððs€all€in€your€favor.€ÏBut€then€again,€you€know,€you€could€be€a€bank€president,€and€beÏbeating€your€wife€.€.€.€because€this€is€a€secret€crime.€€.€.€.€€You€are€notÏtaking€any€drugs,€no€alcohol€since€1989.€€.€.€.€You€have€an€ex„wife,Ítwo€grown€sons.€€.€.€.ÌÌà8 à.€.€.€If€you€had€to€pick€victims,€this€little€girl€is€probably€the€epitome€ofÏthe€definition€of€victim.€€She€has€nobody,€nobody.€€So€let€me€see€whatÏenhancement€factors€there€are.€€The€victim€of€the€offense€wasÏparticularly€vulnerable€because€of€age,€or€physical€or€mentalÏdisability.€.€.€.[× ƒ+ ××  ×]€€Age€is€not€an€element€in€this€crime€of€rape.€€.€.€.ÏNumber€seven€applies.€.€.€it€involved€a€victim,€was€committed€to€gratifyÏyour€desire€for€pleasure€or€excitement.[× ƒ, ××  ×]€€And€number€fifteen,€youÏabused€a€position€of€private€trust.€.€.€.€[× ƒ- ××  ×]€€You€had€a€little€girl€who€didnððtÏhave€a€Daddy.€€.€.€.€€But€„€„€„€and€she€wanted€a€Daddy,€and€she€hadÏlived€with€you€from€the€time€that€she€was€six,€and€in€her€mind,€she€wasÏyour€daughter.€€You€were€the€closest€thing€she€ever€had€to€a€Daddy.€ÏAnd€so,€I€give€great€weight€to€those€enhancement€factors.€€.€.€.€ÏNothing€exists€to€excuse€or€justify€your€conduct.€€.€.€.€You€are€oldÏenough€to€know€better.€€[T]here€are€no€mitigating€factors.€€And€onÏcommunity€corrections,€.€.€.ÌÌà8 à.€.€.€You€are€not€eligible€for€community€corrections.€€I€didnððt€think€itÏapplied€to€sex€offenders.€So,€should€you€be€placed€out€in€theÏcommunity.€€.€.€.€€ÌÌà8 àSo,€now,€whether€or€not€you€should€get€probation.ÌÌà8 à.€.€.ÌÌà8 àNow,€this€is€a€B€felony.€€You€are€not€presumed€to€be€a€favorableÏcandidate€for€alternative€sentencing€options.€.€.€.€I€find€that€theÏpresumption€„€„€„€letððs€see,€you€are€not€presumed€to€be€a€favorableÏcandidate.€€So,€I€find€that,€number€one,€confinement€is€necessary€toÏprotect€society.€€Number€two,€in€your€case,€confinement€is€necessaryÏto€avoid€depreciating€the€seriousness€of€the€offense.€€you€donððt€go€outÏand€steal€and€plunder,€rape€women€on€the€street;€but€you€raped€aÏlittle€girl€in€what€was€the€only€home€she€had.€€So,€probation€is€denied.ÌÌÌÓÓÌà@ àò òAnalysisó óÌÌà àAgain,€the€appellant€contests€the€trial€courtððs€order€denying€him€a€non„incarcerative€sentencing€alternative.€€Specifically,€he€asserts€that€the€trial€courtÏincorrectly€applied€enhancement€factors€and€unjustly€rejected€mitigating€factors€inÏdetermining€that€a€sentence€of€confinement€was€necessary€to€protect€society€and€toÏavoid€depreciating€the€seriousness€of€the€offense.ÌÌà àWhen€a€sentencing€determination€is€challenged€on€appeal,€this€courtÏconducts€a€òòde€novo€óóreview€with€consideration€of€the€evidence€received€at€theÏsentencing€hearing,€the€presentence€report,€the€principles€of€sentencing€andÏarguments€to€sentencing€alternatives,€the€nature€and€characteristics€of€the€criminalÏconduct€involved,€any€statutory€enhancing€or€mitigating€factors,€any€statement€thatÏthe€defendant€made€on€his€own€behalf,€and€the€potential€or€lack€of€potential€forÏrehabilitation€or€treatment.€€Tenn.€Code€Ann.€ðððððð€40„35„102€(1995€Supp.);€40„35„103€(1990);€40„35„210€(1995€Supp.).€€Although€a€òòde€novoóó€review€is€conducted€byÏthis€court,€the€trial€courtððs€determination€is€presumed€correct€on€appeal,€conditionedÏupon€an€affirmative€showing€in€the€record€that€the€trial€court€properly€consideredÏrelevant€sentencing€principles.€€Tenn.€Code€Ann.€ðð€40„35„401(d)€(1990);€òòState€v.ÍAshbyóó,€823€S.W.2d€166,€169€(Tenn.€1991).€€In€the€present€case,€this€court€could€notÏhave€conducted€a€more€thorough€and€complete€review€of€the€applicableÏsentencing€considerations.€€The€presumption€of€correctness€applies.€€Moreover,€theÏappellant€bears€the€burden€of€showing€that€the€sentence€imposed€by€the€trial€courtÏis€improper.€€òòSeeóó€€Tenn.€Code€Ann.€ðð€40„35„210(b)(3).à
