ThemarijuanachargesresultedfromtheDefendantssaleofmarijuanatoaconfidentialinformant.Whilethemarijuanachargeswerepending,theDefendantwasarrestedonachargeofpossessingmorethan.5gramsofcocaine.TheindictmentsstatethatthemarijuanasalesoccurredonJanuary9andJanuary16,1996,andthatthecocainepossessiontookplaceonAugust26,1996.Onappeal,theDefendantarguesthatthetrialjudgeabusedhisdiscretionbyrequiringtheDefendanttoserveanadditionalfivemonthsforthecocaineconviction. Whenanaccusedchallengesthelength,range,ormannerofserviceofasentence,thiscourthasadutytoconductadenovoreviewofthesentencewithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d).Thispresumptionis conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.𛀀Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofasentence,thiscourtmustconsider:(a)theevidence,ifany,receivedatthetrialandsentencinghearing;(b)thepresentencereport;(c)theprinciplesofsentencingandargumentsastosentencingalternatives;(d)thenatureandcharacteristicsofthecriminalconductinvolved;(e)anystatutorymitigatingorenhancementfactors;(f)anystatementthatthedefendantmadeonhisownbehalf;and(g)thepotentialorlackofpotentialforrehabilitationortreatment.Tenn.CodeAnn.-X-Ԁ4035102,103,210;Statev.Smith,735S.W.2d859,863(Tenn.Crim.App.1987).  ThepresentencereportreflectsthattheDefendantwastwentyeightyearsold,single,andhadnochildren.HisformaleducationendedwiththeeleventhgradebuttheDefendantstatedthatheearnedhisGED.Hisemploymenthistoryisfair.Helosthismostrecentjobasanelectriciansassistantduetohisarrestandlegalproblems.Hehadbeenterminatedfromhisprioremploymentbecausehewassuspectedofsmokingmarijuanawhileonhisbreakandsubsequentlyrefusedtotakeadrugtest. TheDefendantscriminalhistoryisquiteextensive.Hehasbeenarrestedapproximatelyeighteentimes.Amonghisconvictionsareseveraltrafficoffenses(includingtwoconvictionsfordrivingonasuspendedlicense),onepublicintoxication,onecasualexchangeofmarijuana,onesaleofmarijuana,twothefts,andseveralotherunspecifiedmisdemeanors.Onthedatesofthemarijuanasales,theDefendantwasonprobationfrompriorconvictions.AtthetimetheDefendantwaschargedwithpossessingthecocaine,hisprobationhadexpiredbuthewasonbondpendingresolutionofthemarijuanacharges. TheDefendanttestifiedconcerninghislonghistoryofdrugandalcoholabuse.Hestartedexperimentingwithmarijuanawhenhewasaboutthirteenyearsold.Inadditiontoalcohol,he wenttopillslikevaliums,andtheneventually...startedcocaineuse.Hereachedthepointthathewasexperiencingmemorylossandblackouts.Hesaidthathesoldmarijuanatosupporthisowndrughabit.TheDefendantadmittedthathestartedusingcocainefairlyheavilyfollowinghisarrestonthechargesofsellingmarijuana.TheDefendanttestifiedatthesentencinghearingthathehadbeeninjailforaboutfivemonths,and afterbeinginjailthislongandtheyvebeenovercrowdingus,andforfearofgoingtoprison,IintendtowalkastraightlineandshowthecourtIcandoright. ConcerningtheamountoftimetheDefendantwastoserveinconfinement,thejudgestated,8 Heisbeinggivenanalternativesentence,butstillthe"givinghimthelongertimeincustody,Ithink,areallthesamethingsthatwouldhavejustifiedsendinghimtothepenitentiary.Thatis,itsnecessarytoprotectsocietybyrestrainingapersonwhohasalonghistoryofcriminalconduct,necessarytoavoiddepreciatingtheseriousnessoftheoffense,andthingslessrestrictivethanconfinementhavebeenusedrecentlywithoutsuccess.Allofthosethingsapplytothissetoffactsthatwehavehere.      WebelievethattheDefendantslengthycriminalrecord,thefailureofpastattemptstorehabilitatehim,andhiscontinueddisregardforthelawsofthisStatejustifythelengthofconfinementorderedbythetrialjudge.Trialjudgesaretraditionallyvestedwithbroaddiscretioninsentencingmatters.Fromthisrecord,weareunabletoconcludethatthetrialjudgeerredorabusedhisdiscretion.
