ÐBoyd€did€not€recall€if€the€attorneys€had€received€any€discovery€prior€to€the€petitionerððs€plea.€€BoydÐ $X" Ðconceded€that€the€attorneys€would€have€stopped€trial€preparation€upon€the€petitionerððs€agreement€toÐ ô$D # Ðthe€guilty€plea.€€Ð à%0!$ ÐÌà  àà ` àScott€Grissom,€the€third€Public€Defender,€testified€that€the€attorneys€met€with€theÐ ¸'#& Ðpetitioner€two€or€three€times€prior€to€the€plea.€€Grissom€ð ðvaguelyðð€remembered€discussing€the€factsÐ ¤(ô#' Ðof€the€case€with€the€petitioner.€€He€admitted€that€the€attorneys€ð ðdidnððt€go€out€and€interview€witnessesÐ )à$( Ðor€anything€like€that€at€that€point€in€time.ðð€€Grissom€did€not€recall€the€petitioner€asking€if,€as€a€resultÐ |*Ì%) Ðof€his€conviction,€he€would€be€registered€as€a€sex€offender€or€if€he€would€be€required€to€submit€toÐ h+¸&* Ðpsychological€testing.€€Grissom€related€that€he€called€Faye€Claude€at€the€Tennessee€Department€ofÐ ° ÐCorrection€ð ðto€verify€that€we€were€accurate€that€that€was€not€going€to€be€an€eighty„five€(85%)€percentÐ œì Ðlike€the€other,€that€the€attempt€statute€was€not€in€that€same€eighty„five€(85%)€percent€range€as€theÐ ˆØ Ðcharge€itself.ðð€€Grissom€could€not€recall€if€he€related€this€information€to€the€petitioner.€Ð tÄ ÐÌà  àà ` àFinally,€the€petitioner€testified€in€his€own€behalf.€€He€contended€that€he€had€threeÐ L œ Ðshort€meetings€with€the€attorneys,€specifically€complaining€that,€at€a€meeting€in€the€chapel€at€theÐ 8 ˆ Ðcounty€jail,€two€inmates€and€three€children€were€also€present.€€The€petitioner€claimed€that€ð ðI€wroteÐ $ t Ð[the€attorneys]€many€letters€on€evidence€and€possible€witnesses€and€stuff€to€my€defense€as€to€whatÐ  ` Ðthey€could€do.ðð€€He€attested€that€he€never€received€a€response€to€those€letters.€€The€petitioner€alsoÐ ü L  Ðalleged€that€counsel€did€not€investigate€his€case.€€Additionally,€the€petitioner€complained€that€he€wasÐ è 8  Ðnot€informed€about€a€possible€suppression€hearing€or€the€procedures€for€discovery.€€The€petitionerÐ Ô$  Ðmaintained€that€he€asked€counsel€if€he€would€be€required€to€register€as€a€sex€offender€and€submit€toÐ À  Ða€psychological€examination€as€a€result€of€his€plea.€€He€also€asked€if€he€would€be€eligible€for€releaseÐ ¬ü  Ðafter€serving€thirty„five€percent€(35%)€of€his€sentence.€€The€petitioner€conceded€that€Boyd€agreedÐ ˜è  Ðto€investigate€the€petitionerððs€release€eligibility€and€admitted€that€counsel€explained€to€the€petitionerÐ „Ô  Ðthat€he€would€be€pleading€outside€his€range.€Ð pÀ ÐÌà  àà ` àThe€petitioner€conceded€that€he€was€told€that€he€had€a€thirty„five€percent€(35%)Ð H˜ Ðrelease€eligibility€date.€€However,€he€further€alleged€that€ð ðI€have€read€law€books€that€also€states€thatÐ 4„ ÐI€have€[to]€serve€one€hundred€(100%)€percent.ðð€€The€petitioner€contended€that€he€would€have€goneÐ  p Ðto€trial€if€he€had€known€the€details€of€his€plea.€€The€petitioner€informed€the€court€that,€while€in€jailÐ  \ Ðprior€to€the€plea,€he€learned€through€word„of„mouth€that€Tennessee€has€a€sex€offender€registry€andÐ øH Ðwas€aware€that€he€might€be€required€to€register€as€part€of€his€sentence.€€He€also€knew€that,€as€partÐ ä4 Ðof€his€sentence,€he€could€be€required€to€undergo€psychological€evaluation.€€The€petitionerÐ Ð  Ðacknowledged€that€a€ð ðTOMIS€Offender€Sentence€Letterðð€he€received€from€the€TennesseeÐ ¼  ÐDepartment€of€Correction€stated€that€the€petitioner€has€a€release€eligibility€of€thirty„five€percentÐ ¨ø Ð(35%);€however,€the€petitioner€continued€to€insist€that€he€will€be€required€to€serve€one€hundredÐ ”ä Ðpercent€(100%)€of€his€sentence€in€confinement.€€The€petitioner€also€admitted€that,€during€the€guiltyÐ €Ð Ðplea€hearing,€he€informed€the€court€that€he€had€no€complaints€with€the€representation€of€theÐ l¼ Ðattorneys.€€Moreover,€the€petitioner€conceded€that€he€had€previously€ð ðentered€a€negotiatedÐ X ¨ Ðsettlementðð€to€other€criminal€charges.€€€Ð D!” ÐÌà  àà ` àAt€the€conclusion€of€the€hearing,€after€considering€the€foregoing€proof,€the€trial€courtÐ #l!
