X    Intheinstantcase,therecordreflectsthatonFebruary8,2000,thesessionscourtissuedan 0"  exparteorderofprotection.Theorder,whichprohibited anycontact,directorindirect,withthe #l! victim,wasservedbyasheriffsdeputyonFebruary10,2000, [b]yreadingandgivingacopyto $X" [thedefendant].AlthoughtheaddressprovidedforthedefendantwastheWestsideMotelin $D # Maryville,hewaslocatedattheSalvationArmyinMaryville.Theorderstatedthatthematterwas %0!$ setforahearingonFebruary28andadmonishedthedefendantthathis failuretoappearincourt &"% [would]resultinjudgmentbeingrenderedagainst[him].OnFebruary28,thesessionscourt '#& enteredanorderprohibitingthedefendantforoneyearfrom abusing,threateningtoabuse...,or (#' committinganyactsofviolenceuponthevictim,butallowingsocialcontactsolongasthe )$( defendantbehavedina peacefulandsobermanner. |*%)  h+&*   ItisuncontestedthatthedefendantfailedtoappearatthehearingonFebruary28.Itis  furtheruncontestedthatthedefendantwasnotpersonallyservedwiththeorderofprotectionentered  onthatdateuntilOctober6,2000.However,althoughnotmentionedbyeitherparty,therecord  reflectsthatservicewasattemptedduringtheinterim.AcertificateofservicedatedMarch6recites t thatthedefendantwas nottobefoundinBlountCountyandthattheorderwasbeingreturnedto ` thecourt.Anotationbythecourtclerkindicatesthattheorderwasreturnedunservedandfiledwith L  thecourtonAugust21,2000.Theinstantoffenseoccurredapproximatelyonemonthlater. 8    Inmyview,theinabilityofthesheriffandthecourtclerktoeffectserviceuponthedefendant  ` beforetheoffensedidnotrendertheorderofprotectioninvalid.Ourstatutoryschemecontainsno  L  timerequirementsforserviceofanorderofprotectionissuedafterahearing.Additionally,although  8  thestatutesprohibittheenforcementofanexparteprotectiveorderthathasnotbeenserved,see $  Tenn.CodeAnn.363611(b),thereisnosuchlimitationonenforcementofapermanent   protectiveorder.Here,personalservicewasattempted.However,becausethedefendantwas   transientandlivinginvariousmotelsandshelters,hecouldnotbefoundandservicewasnot   completed.Nevertheless,throughtheexparteorderofprotectionthatwasproperlyservedonhim,   thedefendanthadknowledgeoftheproceedingsandhadknowledgethatajudgmentwouldbe p enteredagainsthimshouldhefailtoappearatthehearingonFebruary28.Accordingly,Iconclude \ thattheorderofprotectionissuedbythesessionscourtonFebruary28wasvalidandineffectatthe H timeoftheinstantoffense.Iwouldreversethejudgmentofthetrialcourtandremandforentryof 4 ajudgmentofguiltyontheoffenseofaggravatedassault.  p  #XXO#  XOX   `     h     ___________________________________ X     `     h     NORMAMcGEEOGLE,JUDGE
