T   Oncrossexamination,theDefendantclaimedthathehadbeen hearingvoicesduringhis & v plea.Hestatedthathedidnotrememberthejudgeaskinghimaboutthemedicationhewasonat  _ thetime,ortellingthejudgethatthemedicationhelpedtoclearhismind.Hemaintainedthathis  H lawyertoldhimthathischoiceswerethedeathpenaltyifhewenttotrial,orprobationifhepled.  1    DianeThackery,theDefendantsattorneyduringhispleaprocess,alsotestified.She   testifiedthattheStatehadfiledanoticeofintenttoseekthedeathpenaltyontheDefendantsfirst   degreemurdercharge,andthattheStatewasclaimingtheexistenceofthreeaggravatingfactors. n  ShestatedthatsheexplainedtotheDefendantthatthethreepossiblesentencesforafirstdegree W  murderconvictionweredeath,lifewithoutthepossibilityofparole,andlifewiththepossibilityof @ parole.Sheexplainedtohimthatthelatterofthesesentencesstillmeantaminimumoffiftyone )y yearsinprison.ShedeniedhavingtoldtheDefendantthathewaseligibleforprobationonthe b murdercharge.ShetoldtheDefendantthat,ifhewenttotrial,hefaced arealpossibility,perhaps K evenaprobabilitythathewouldbesentencedtodeath.ShestatedthatshemetwiththeDefendant 4 severaltimestodiscusshiscase.Shewasawareofhispastmentalhealthproblemsandhadhim  evaluated.Asaresultoftheevaluation,theDefendantwasdeemedcompetenttostandtrial,and  noinsanitydefensewasavailable.Acopyoftheevaluationreportwasintroducedatthehearing.
