Knoxville,TN37902 OPINIONFILED:________________AFFIRMEDCURWOODWITT,JUDGE @ OPINION   Thepetitioner,RonaldE.Robinson, '   ׀appealstheKnoxCountyCriminalCourt'sdismissalofhispetitionforpostconvictionrelief.Robinsonispresentlyservinganeffective37yearsentenceforconvictionsofaggravatedrape,twocountsofaggravatedkidnapping,aggravatedassault,assaultandbattery.Statev.RonaldEugeneRobinson,No.03C019212CR00433(Tenn.Crim.App.,Knoxville,Oct.26,1993),perm.app.denied(Tenn.1994)(concurringinresultsonly).Hefiledatimelypetitionforpostconvictionrelief,whichheamendedfourtimesproseandafifthtimethroughcounsel.Theallegationswerenumerous;however,atthepostconvictionhearingheproceededononlytwoissuesineffectiveassistanceofcounselandactualinnocence.Thetrialcourtheardthetestimonyofwitnesses,includingthepetitioner,andconcludedthepetitionwaswithoutmerit.Inthisappealofthetrialcourt'sruling,thepetitionerspecificallychallengesonlyoneofthetrialcourt'sdeterminationsthathewasaffordedtheeffectiveassistanceofcounselinthedeterminationthathewouldnottestifyathistrial.Havingreviewedtherecordandthebriefsoftheparties,weaffirmthetrialcourt'sdismissalofthisaction.  InpostconvictionproceedingsfiledonorbeforeMay10,1995,apetitionerhastheburdenofprovinghispostconvictionallegationsbyapreponderanceoftheevidence.CompareMcBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983)(burdenofproofisbypreponderanceofevidence)withTenn.CodeAnn.4030210(f)(1997)(burdenofproofisbyclearandconvincingevidence).Atrialcourt'sfindingsoffactfollowingapostconvictionhearinghavetheweightofajuryverdict.Bretonv.State,477S.W.2d754,756(Tenn.Crim.App.1971).Onappeal,thosefindingsareconclusiveunlesstheevidencepreponderatesagainstthejudgment.Butlerv.State,789S.W.2d898,900(Tenn.1990).  Inthecaseatbar,thepetitioner'sappellateissueisasfollows."Wasthecourt,afterconductingafullevidentiaryhearing,correctindismissingRonaldE.Robinson'sPostConvictionReliefPetitionasbeingwithoutlegalmerit?"Theonlyspecificfactualfindingofthetrialcourtwhichisaddressedintheargumentaccompanyingthisissueiswhetherthetrialcourtcorrectlydeterminedthatthepetitionerwasaffordedtheeffectiveassistanceofcounselintheprocessbywhichitwasdeterminedthathewouldnottestifyathistrial. (     Thepetitionertestifiedatthehearingthathewantedtotakethestandathistrialbuthiscounseldidnotlethimdoso.Ontheotherhand,thepetitioner'strialcounseltestifiedthatherecommendedthatthepetitionernottestifybecauseofthepetitioner'scriminalrecord,butthepetitionermadehisowndecisionnottotestify.Thepetitionerallegestrialcounsel'sfailuretoallowhimtotestifywasineffectivebecauseitdeprivedhimofadefenseina"hesaid,shesaid"typeofcase. )   ׀Thetrialcourtfoundthetrialattorney'stestimonymorecrediblethanthatofthepetitionerontheissueofwhetherthepetitionermadehisowndecisionnottotestify.Thetrialcourtalsofoundthattrialcounselhadadequatelyconferredwiththepetitionerpriortotrialandpreparedthecase.Thecourtconcludedthatthepetitionerwaseffectivelyrepresentedbytrialcounsel.Wecannotsaythattheevidencepreponderatestothecontrary.
