In1991,theappellantwasparalyzedfromtheneckdowninadrivebyshooting.Hebecamedepressed.Afterrehabilitation,heregainedtheuseofhisarms.InMarch1993,theappellantwaslivingwithhisgirlfriendandherthreeyearolddaughter,thevictim.TheappellanttestifiedthatonthemorningofMarch19,1993,thevictimcomplainedofastomachache.Thinkingthatthevictimsstomachproblemswerecausedbysomethingthatshehadeatenthepreviousevening,theappellantsentthechildtoherroom.Later,theappellantheardthechild dryheaving.Hethenheardherfall.Theappellanttestifiedthatthevictimtoldhimthatshehitherheadandthatherstomachwasstillhurting.SinceMarch19th,theappellanthasspenttimearoundchildrenwithoutincident. Thechildwastreatedintheemergencyroomlaterthatevening.Shewasplacedinthepediatricintensivecareunituntilthe23rdofMarch.Thechildwasdiagnosedwithrightoccipitalskullfractureandmultiplecontusions.Shehadconsiderablebruisingandswellingtoherheadandface,andbruisingonherneck,arms,hands,andback.Themedicalrecordsindicatethattheseinjurieswereprobablechildabuse.Therewasevidenceofapreviousclavicularfracture,aburnonherfoot,andmultiplebruisesofdifferentages.Themedicalrecordsindicatethattheseinjurieswereconsistentwithongoingabuseandneglect.Thevictimremainedinthehospitalforadditionaltestsuntilthe25thwhenshewasdischargedtothecustodyoftheDepartmentofHumanServices. Themedicalrecordsreflectthatthevictimsaidthattheappellanttoldhertosaythatshehurtherselfwhenshefelloutofbed.Shealsosaidthattheappellanthitherandthathehitherwith thewall. Whenadefendantchallengesthelength,range,ormannerofserviceofasentence,thisCourtconductsadenovoreviewwithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1990).Thepresumptionisconditioneduponthetrialcourtsfollowingtheprinciplesofsentencing.Statev.Ashby,823S.W.2d166(Tenn.1991).Thisreviewextendstosentencingissuesconcerningprobation.Statev.Dykes,803S.W.2d250,258(Tenn.Crim.App.1990).Inconductingourreview,thisCourtconsiders(a)anyevidencereceivedatthetrialand/orsentencinghearing;(b)thepresentencereport;(c)theprinciplesofsentencing;(d)theargumentsofcounselrelativetotheseprinciples;(e)thenatureandcircumstancesoftheoffense;(f)anymitigatingand/orenhancementfactors;(g)anystatementmadebythedefendantinhisorherownbehalf;and(h)thedefendant'spotentialorlackthereofforrehabilitation.Tenn.CodeAnn.4035210(b)(1990). Whenprobationisatissuethecourtmustconsiderthecircumstancesoftheoffense,thedefendant'scriminalrecord,socialhistory,presentconditionandwhereappropriate,hisorherphysicalormentalcondition.Statev.Kear,809S.W.2d197,198(Tenn.Crim.App.1991).Inaddition,thedeterrenteffectuponothercriminalactivitymaybeconsidered.Statev.Lewis,641S.W.2d517,521(Tenn.Crim.App.1982).Also,thelackoftruthfulnessisprobativeofadefendant'sprospectsforrehabilitationandisaproperconsideration.Statev.Chestnut,643S.W.2d343,353(Tenn.Crim.App.1982). Theevidenceatthesentencinghearingconsistedofthetestimonyoftheappellantandhismother,apresentencingreport,thechildsmedicalrecords,andphotosthatshowedthechildsinjurieswhenshewasinthehospital.Aspreviouslystated,theappellanttestifiedthatthechildsinjurieswerecausedbyafall.Hedeniedhittingthevictim.Thephotosofthechildsinjurieswereshocking.Thechildhadswollen racooneyesandbruisingandswellingonherneck.Thephotosalsoshowedotherbruisesandinjuries.Thedefenseattorneytoldthecourtthatthebruisingaroundtheeyeswascausedbythetypeoffracturesustainedbythechild.Thecourtrejectedthisexplanation,citingthemedicalrecordsandtheinjuriesdepictedinthephotos.Theevidencedoesnotpreponderateagainstthisfindingasurgedbytheappellant.  Thetrialcourtstatedthattheappellantwaseligibleforprobation,butdeniedtheappellantsrequestforalternativesentencing.SeeTenn.CodeAnn.4035303(a)(1990).Thecourtfoundthattheappellanthadbeenpreviouslyconvictedofdrivingwithoutalicense,solicitingprostitution,andpossessionofacontrolledsubstance.ThecourtnotedthattheappellantwasplacedonProjectFirstOffenderforsolicitationofprostitution.Heapparentlyfailedtocompletetheprogramandhadhisstatusrevoked.Hereceivedsuspendedsentencesforhisothertwoconvictions.Thecourtsaidthat,whiletheappellantdidnothavealonghistoryofcriminalconduct,measureslessrestrictivethanconfinementhadrecentlybeenappliedunsuccessfullytohim. Thecourtfoundthatconfinementwasnecessarytoavoiddepreciatingtheseriousnessoftheoffense.Thecourtfoundthatthethreeyearoldvictimwasvulnerable,thatshehadreceivedextensivephysicalabuse,andthattheinjuries  inflicteduponherwereparticularlygreat.Thecourtfoundthatthechildhadbeenseverelybeaten.Thecourtdescribedtheoffenseasan abhorrentcrimeand anincrediblyseriousoffense.Thecourtfurthernotedthattheappellantviolatedthepositionoftrustthatheheldincaringforthechild. Thecourtalsofoundthattheappellantliedabouthowthechildwasinjured.Thecourtnotedthattheappellanthadgiventwoinconsistentstoriestothepoliceduringtheinvestigationofthecase,andtheappellanthadcontinuedtodenyinjuringthechildwhenhetestifiedincourt.Thecourtfoundnoapplicablemitigatingfactors,statingthattheappellantsphysicalconditiondidnotreducehisculpabilityfortheoffense. Theappellantarguesthatthepresumptionofcorrectnessshouldnotattachtothetrialcourtsfindingsbecausehefailedtofollowthesentencingprinciples.Wedisagree.Theappellantalsoarguesthatseriousinjuryisanelementofaggravatedchildabuse,and,thatthenatureoftheoffenseshouldnotbeusedtodenyprobation.SeeTenn.CodeAnn.3915402(1991).Wedisagree.Thecourtalsotookintoconsiderationthechildsyoungage,hervulnerability,andthepositionoftrustinwhichtheappellantwasplacedincaringforthechild.Lastly,theappellantarguesthatthecourtcannotdenyprobationbasedupontheseriousnessoftheoffenseunlessthenatureoftheoffenseoutweighsallfactorsfavoringprobation.SeeStatev.Hartley,818͜S.W.2d370(Tenn.Crim.App.1991).Thisissueiswithoutmeritbecausethetrialcourtdidnotdenyprobationsolelyonthebasisoftheoffense. Theevidencedoesnotpreponderateagainstthefindingsofthetrialcourt.Thecourtsfindingsthattheoffensewasabhorrentandthattheappellantwasuntruthfulareparticularlycompelling.
