Specifically,hecontendsthat,becausehewasoutonbailonoffenses13960and14010whenhe  committedtheoffensesincases14926and14358,thetrialcourtwasrequiredbystatutetoorderthat  thesentencesrun_consecutivly_Ԁtoeachother._] U#  3      _ԀThePetitionerarguesthatthetrialcourtenhanced  hiscurrentsentence,incasenumber14977,toRangeIIIatfortyfivepercentasaresultoftheprior k illegalsentences,_\} U#  4      _Ԁandheis,consequently,currentlyrestrainedofhislibertybyvirtueofthoseprior T sentences.TheStatecountersthat,althoughthesentencesmightbeillegal,thePetitionerisnot =  entitledtothereliefsought;theStatecontendsthatthePetitionerisnot restrainedontheprior & v sentencesasthePetitionerhasalreadyservedthesesentencesandthesentenceshavefullyexpired.  _ Furthermore,theStatearguesthatthepriorconvictionsthatthePetitionerchallengesalonecould  H nothaveelevatedthePetitionersclassificationtoaRangeIIIpersistentoffender.  1      WeneednotaddresswhetherthejudgmentsthatthePetitionerchallengesare,infact,illegal   becausetherecordprovidesinsufficientgroundsuponwhichwecangrantthePetitionertherelief   heseeks.ThePetitionerfailedtoprovideacompleteandadequaterecorduponwhichwecould   granthimrelief.Therecorddoesnotindicatewhatfactorsthetrialcourtconsideredindetermining n  thePetitionerssentence.Thejudgmentforcase14977evidencesonlythesentenceimposedand W  thePetitionersrangeclassification.Also,wenotethattherecordisinsufficienttoestablishwhether @ thePetitioneragreedtohisrangeclassificationpursuanttohispleaagreement.Thisinformation )y aloneisinsufficientforthisCourttoconcludethatthejudgmentincase14977isfaciallyinvalid. b Ѐ  Furthermore,werewetosetasidethejudgmentsforthepriorsentences,thePetitionerwould 4 stillnotbeentitledtohabeasrelief.ToplacethePetitionerinRangeIIIforhisSecondDegree  Murdersentence,thestatuterequiresatleastfive(5)priorconvictionswithinthesameclass,a  higherclass,orwithinthenexttwolowerclasses,oratleasttwo(2)classAoranycombinationof  three(3)classAorclassBfelonyconvictions.Tenn.CodeAnn.4035107(a).Becausethe  PetitioneriscurrentlyincarceratedforaclassAfelony,hewouldneedfivepriorconvictionsofclass  Corhigher,orthreepriorconvictionsinclassAorB,or2priorclassAfelonyconvictionsforthe  trialcourttosentencethePetitionerasaPersistentOffender.SeeTenn.CodeAnn.4035107(a).  OfthejudgmentsthePetitionerchallenges,thetrialcourtcouldhaveusedonlytwo!thetwoclass k Cfelonyconvictionsforthesaleofcocaineincase14010!toelevatethePetitionertoaRangeIII T classification.ThesetwoclassCfelonyconvictionsalonewerenotenoughtoplacethePetitioner =  inRangeIIIasapersistentoffender.However,therecordbeforeusdoesnotindicatewhatother & v convictions,ifany,thatthePetitionermayhavethatthetrialcourtmayhaveconsideredwhenit  _ imposedtheRangeIIIclassification.
