VictorS.Johnson,III,DistrictAttorneyGeneral;andRogerD.Moore,AssistantDistrictAttorney #d" General,fortheappellee,StateofTennessee. $P#     OPINION  %(!%   XThiscaserelatestotheDecember1997deathofLenoraRobinson,thedefendantsthirty '#' threeyearoldwife.Thevictimsmother,CharlieYork,testifiedthatthevictimanddefendant (#( marriedonSeptember1,1989.Shesaidthatthecoupledidnothavechildrentogether,butthe )$) defendantsyoungdaughter,_Brittney_,livedwiththem.Shestatedthatbeforethemarriage,the t*%* defendanthadworkedforanexterminatingcompanyandsomecollectionagencies.Mrs.York `+&+ _testifiedthatinApril1996,thevictimandthedefendantstartedtheirowncollectionagency.She  saidthatthevictimconfidedtoherthatthecouplehadseriousfinancialproblems.Mrs.Yorksaid  thatinthemonthsbeforeherdaughtersdeath,thevictimrevealedthatsheandthedefendantwere  heavilyindebtandthatthedefendantwantedtofilebankruptcy.Shesaidthatwhilemostofthe t couplescreditcardswereinthevictimsname,thevictimdidnotwanttofilebankruptcybecause ` itwouldruinhercredit.Mrs.Yorktestifiedthatinadditiontofinancialproblems,thevictimand L  thedefendantwerehavingsexualproblems,andthevictimwasnothappyinthemarriage.Mrs. 8  YorkstatedthatthedefendantacteddistantduringthemonthofDecember1997. $ t  X XMrs.YorktestifiedthatthevictimstartedfeelingsickonFriday,December19,1997.She  L  saidthatalthoughthevictimwasill,onSunday,December21,thevictimfixedChristmasdinner  8  atthevictimshomeforherfatherandstepmother.Mrs.Yorksaidthatlaterthatevening,shecalled $  tocheckonherdaughter,butthevictimwastooweaktotalkonthetelephone.Shestatedthatthe   nextmorning,thevictimcalledMrs.Yorkandtoldherthatshehadbeensickallnight.Mrs.York   saidshewentovertothevictimshouse,toldthevictimthatshehadtoseeadoctor,andsuggested   thattheygototheemergencyroom.Mrs.Yorktestifiedthatalthoughsheagreedtoseeadoctor,the   victimsaidthedefendantwantedhertogotoBaptistCentraCareinsteadofthehospital.Mrs.York p saidthatsheandthedefendanttookthevictimtoBaptist. \  X XMrs.YorktestifiedthataBaptistCentraCaredoctordiagnosedthevictimwithviral 4 syndrome,gaveheraPhenerganshottoalleviatenausea,andgaveherthreeprescriptionstofill.She  p saidthatthedoctordidnotreferthevictimtoahospitalandthatsheandthedefendanttookthe  \ victimhome.Shestatedthatshestayedwithherdaughterallday,cleaningthebathroomandbed H linensfromwherethevictimhadbeensickthenightbefore.Shesaidthatthevictimsleptallday 4 andthatthedefendantranerrandsandwasinandoutofthehouse.Mrs.Yorksaidthatshewent   homeabout4:30p.m.,butsheforgothercellphoneandreturnedtothevictimshometogetit.She   testifiedthatshealsotookthedefendantsdaughterhomewithher.Mrs.Yorkstatedthatwhenshe  left,thevictimandthedefendantwerealoneinthehouse.Shesaidthatshecalledthedefendant  about10:00p.m.tocheckonthevictim.   X XMrs.Yorktestifiedthatearlythenextmorning,December23,1997,thedefendant X  telephonedandtoldher, Charlie,Ithinkwevelosther.Mrs.Yorksaidthatshescreamedand D! wentovertothedefendantshouse.Shestatedthatthepoliceandanambulancewerethere.She 0"  saidthatshewentintothevictimsbedroom,wheremedicaltechnicianswereworkingonthebody, #l! andsawthatthevictimhadabrownsubstancecomingoutofhernosethathadnotbeenpresentthe $X" nightbefore.Shestatedthatthedefendantwaspresentanddressedinhispajamas.  $D #    %0!$   Mrs.Yorktestifiedthatafterthevictimsbodywasremovedfromthehouse,shetalkedto &"% thedefendantaboutfuneralarrangements.Shesaidthattheyagreedthatshewouldcontactafuneral '#& directorandthatsheaskedthedefendantwhattypeofservicehewanted.Mrs.Yorkstatedthatthe (#' defendantsaidthathedidnotwantreligionormusicatthefuneralandwantedonlyagraveside )$( service.Shestatedthatalthoughthedefendantwantedtoburythevictimthenextday,heagreedto |*%) waituntilDecember26togivethevictimssistertimetotraveltoNashville.Shesaidthatafterthe h+&* 9; 98$$XXdXXd8 9  funeral,thedefendantdidnotseemtowantanyoneinhishouse.Shestatedthatifanyonebrought  foodtohishouse,hetoldthemtotakeittoherhome.Shesaidthatifshefixedhimameal,he  wouldeitherpickitupormeetheratthefrontdoorandtakeit.Mrs.Yorkstatedthatsheneversaw  thedefendantgrieve.ShesaidthatshetalkedwithDetectiveE.J.BernardoftheNashville t MetropolitanPoliceDepartmentandthatsheknewthepolicewereinvestigatingthevictimsdeath. ` Shetestifiedthatherhusbandcontinuedtohavecontactwiththedefendant.Shestatedthatthe L  victimwasaboutfivefeetfiveinchestall,weighedonehundredfiftypounds,smokedonetotwo 8  packsofcigarettesaday,andoccasionallydrankbeer. $ t  X XKenYork,thevictimsstepfather,gavetestimonyaboutthevictimsdeaththatwas  L  substantiallysimilartoCharlieYorkstestimony.Inaddition,hetestifiedthatthevictimandthe  8  defendanthadastormymarriage.Hesaidthatthedefendanttoldhimthatthevictimwasdifficult $  tolivewithandthatitwasimpossibletogetalongwithher.Mr.Yorkstatedthatthedefendantdid   notstaygainfullyemployedandthatheandMrs.Yorkloanedthedefendantandthevictimmoney   onseveraloccasions.Hesaidtheymostrecentlyloanedthedefendantandthevictimmoneyfora   newcar.Hesaidthecarandmostofthecreditcardswereinthevictimsname.Mr.Yorkstated   thatinthefallof1997,thevictimbeganpressuringthedefendanttogetajobandhelpherwiththe p billsandthattheirmarriagerapidlydeteriorated. \  X XMr.YorktestifiedthatheandMrs.Yorkwereclosetothevictimandthedefendantandthat 4 thetwocouplessaweachotherseveraltimesaweek.Hesaidthatsoonafterthevictimsdeath,  p DetectiveBernardoftheNashvilleMetropolitanPoliceDepartmenttoldhimthepolicewere  \ investigatingthevictimsdeathasahomicide.Mr.Yorkstatedthateventhoughheknewthepolice H weregoingtoarrestthedefendant,heremainedthedefendantsclosefriend.Hesaidthatthe 4 defendanttoldhimthathehadnothadsexwiththevictimsinceearlyDecemberandhadagreat   needforsex.Mr.Yorksaidthatthedefendanttoldhimthathehadsexwithotherwomenin   NovemberandDecember1997andthathehadsexwithawomanonJanuary23,1998,inthemarital  bed.Mr.Yorkstatedthatoncethedefendantlearnedthathewasunderinvestigation,heaskedMr.  YorktohelpconvinceMrs.Yorkandthevictimsfathertoagreetoapleabargain.   X XBobWilliams,thevictimsfather,testifiedthathisnewwifewasclosetothevictim.Hesaid X  thatonSunday,December21,1997,theywenttothevictimshouseforChristmasdinner,which D! thevictimcookedbutwastoosicktoeat.Hesaidthatheheardofhisdaughtersdeaththemorning 0"  ofDecember23andthatwhenhewenttothehouse,thedefendantwasupset.Heacknowledgedthat #l! diabetesraninhisfamilyandthathisdaughter,Theresa,hadit. $X"  X XTheresaMettlen,thevictimssister,testifiedthatalthoughshewasnotclosetothedefendant, %0!$ shestayedathishousewhileherfamilywasinNashvilleforthevictimsfuneral.Shedidnot &"% believethatthedefendantseemedveryupset.Shesaidthatonenightafterthefuneral,whilesheand '#& herhusbandwerewatchingtelevisionwiththedefendant,hetoldthemabouthissexlifewithhis (#' secondwife,Brittneysmother.Mrs.Mettlensaidthatshethoughtthiswasoddconsideringthatthe )$( victimhadjustpassedaway.Oncrossexamination,Mrs.Mettlenadmittedthattheconversation |*%)  startedwhenshetoldthedefendantthatshehadfoundherhusbands littleblackbook.Shesaid h+&* 8+ 88$$XXd$XXd8 8  thedefendanttoldherthatthevictimhadfoundhislittleblackbook,too,andhethencontinuedwith  theconversationabouthisexwife.   X XDr.BradleyRudgetestifiedthatheisaphysicianatBaptistCentraCareandsawthevictim t onDecember22,1997.Hesaidthevictimcomplainedofheadache,cough,nausea,vomiting,and ` bodyaches.Hesaidherlungswereclearandherrespiratoryratewasnormal.Hesaidhediagnosed L  herwithviralsyndrome,gaveheraPhenerganshotfornausea,andprescribedsomemedications. 8  Dr.Rudgesaidthathereferspatientstospecialistsifnecessaryorcallsanambulanceifapatientis $ t acutelyill,butthathedidnotreferthevictimtotheemergencyroombecausehedidnotthinkthat  ` herlifewasinjeopardy.  L    8  DetectiveE.J.BernardoftheNashvilleMetropolitanPoliceDepartment,HomicideDivision, $  testifiedasfollows:Apatrolofficercalledhimtothedefendantshomeonthemorningof   December23,1997.Whenhearrived,medicalpersonnelandthevictimsfamilywerepresent.   DetectiveBernardwenttothevictimsbedroomandsawherlyinginbed.Thebodyhadnovisible   signsofinjury,butthevictimhadabrownsubstancecomingoutofhernoseandmouth.Years   before,DetectiveBernardhadseenasimilarsubstancecomingoutofthenoseandmouthofa p cyanidepoisoningvictim.FamilymemberstoldDetectiveBernardthatthevictimhadbeensick \ withflulikesymptomsthedaybeforeandthatshehadbeentoBaptistCentraCarefortreatment. H Thedefendanttoldthedetectivethathehadsleptinanotherbedroomandhadcheckedonhiswife 4 duringthenight;but,whenhegotupthatmorning,shewasdead.Thedefendantwasdressedin  p pajamas,hishairwasmussed,andhisfacewascleanbutunshaved.DetectiveBernardsawnosigns  \ offorcedentrytothehouse,andhedidnotsearchorsecurethepremises.Hewalkedthroughthe H hometoseeifhecouldfindmedicationsornarcoticsthatcouldhavecausedthevictimsdeath,but 4 hefoundnone.Hedid,however,findaletterthatthedefendanthadwrittentothevictimsometime   beforeherdeath.Duringtheautopsy,DetectiveBernarddetectedasweetsmellcomingfromthe   body,andherequestedthatthedoctortestfo
