(    OnoraboutFebruary9,1997,thepetitioner,whoisservingatwentyfiveyearsentencefora1988seconddegreemurderconviction,filedapetitionforwritofhabeascorpusseekinghisreleasefromprison.In1991,hewaschargedwithfelonyescape.Thereafter,thepetitionerapparentlyenteredintoapleabargainintheGeneralSessionsCourtwherebyhepledguiltytomisdemeanorescapeandreceivedanelevenmonth,twentyninedaysentenceatseventyfivepercent.Hecharacterizeshisclaimasfollows:8 8 (# (#ThePetitionercontendsthathissentenceisvoid,duetohewassentencedtofelonychargesandservingtimeonfelonychargeswhentheescapetookplace,andheshouldhavebeensentencedfelonyescaperatherthanamisdemeanorescape,thisisaclearviolationofdueprocessanditdamagesthePetitioneranditisavoidsentencebeingitisillegal.   8 8 (# (#ThePetitionercontendsthatheshouldhavebeensentencedtoafelonyescaperatherthanmisdemeanorescape,andthatsincehewasservingsentencesforfelonyconvictionsandhewasnotboundovertotheGrandJuryandwasnotprocessedthroughthejudicialsystemaccordingto[Rule5(d)oftheTennesseeRulesofCriminalProcedure],regardingfelonychargesandrightsofdefendantsinregardstofelonychargesappearingbeforethemagistrate,hischargesneedtobedismissedanddroppedaccordingly.   8 8 (# (#ThePetitionercontendsthatthecourtthatsentencedhimhadnojurisdictionoverhiminsentencinghimtoamisdemeanorescape,sincehewasservingsentencesforfelonyconvictionsandtherebyrespectfullyasksthisCourttodismissthechargeofescapethatisbeingheld 8/5 againsthim.     Intheorderofdismissal,thetrialcourtdeterminedthat,inadditiontotheseconddegreemurderconviction,whichhadasentencethatwouldnotexpireuntil2013,thepetitionerwasservingconcurrentsentencesonotherconvictions.Itdeterminedthattheelevenmonth,twentyninedaysentencewasconsecutive,thatthepetitionerhadbeendeniedparolein1996,andthatthenextpossibledateforparolewasOctoberof1998.Thetrialcourtconcludedthatthegeneralsessionscourthadjurisdictiontoacceptpetitioner'sguiltypleatomisdemeanorescape.Tenn.CodeAnn.401109;Tenn.R.Crim.P.5(c)(1).  Thetrialcourtdeterminedthatpetitionerhadbeenrepresentedbycounselontheescapecharge,hadbeenapprisedthatthechargewouldbeamisdemeanor,signedawaiverofrightstoconsiderationbyagrandjuryoratrialbyjurybywayofpresentmentorindictment,andpledguiltytothatoffense.  ThetrialcourtfoundthatAttorneySueEvans,whoapprovedthepleaagreementontheescapecharge,hadtheauthoritytopresideoverthecase.See '" Tenn.CodeAnn.1615209.Now,JudgeEvansisageneralsessionsjudgeinMetropolitanDavidsonCounty.  Initially,atthetimeofthepetitioner'sseconddegreemurderconviction,thePostConvictionProcedureActprovidedthatapetitionforrelief,irrespectiveoftheremedysought,hadtofiled"withinthreeyearsofthefinalactionofthehigheststateappellatecourttowhichanappealistaken."Tenn.CodeAnn.4030102(1986).Incontrast,habeascorpushasnostatutoryperiodoflimitations;however,reliefmaybegrantedonlywhenapetitionerhasestablishedlackof 8.4 jurisdictionfortheorderofconfinementorthatheisotherwiseentitledtoimmediatereleasebecauseoftheexpirationofhissentence.SeeUsseryv.Avery,432 ,  S.W.2d656(Tenn.1968);Stateexrel.Wadev.Norvell,443S.W.2d839(tETenn.   Crim.App.1969).Ifaclaimisbaseduponanallegedabridgementofaconstitutionalright,thepetitionermustusethePostConvictionProcedureAct.Luttrellv.State,644S.W.2d408(Tenn.Crim.App.1982). \    Itdoesnotappearonthefaceofthisjudgmentortherecordthatthetrialcourtwaswithoutjurisdictiontoconvictorsentencethedefendantforeithertheseconddegreemurderconviction.Thereisnoindicationthatthegeneralsessionscourtlackedauthoritytoenterthemisdemeanorescapeconviction.Neitherdoesitappearthatthesentencesofimprisonmentforthepetitionerhaveexpired.Archerv. $ State,851S.W.2d157(Tenn.1993);Pottsv.State,833S.W.2d60(Tenn.1992).    Whenitcanbeconclusivelydeterminedthatnoreliefisavailable,thepetitionmaybedismissedsummarilywithouttheappointmentofcounsel.Inthiscase,thepetitionerhasfailedtostateagrounduponwhichthetrialcourtcouldhavedeterminedthateitherofthetwojudgmentswerefaciallyinvalid.Clearly,thesentenceshavenotexpired.
