àAt€the€evidentiary€hearing,€Pectol€testified€that€he€spoke€extensively€toÏthe€petitioner€prior€to€the€juvenile€transfer€hearing.€€At€the€same€time,€two€of€theÏother€attorneys€involved€in€the€case€met€with€codefendants.€€Pectol€claimed€that€heÏand€the€other€attorneys€asked€the€district€attorney€general€to€expedite€theÏdisposition€of€the€case€due€to€the€defendants'€claims€that€they€were€beingÏmistreated€at€the€Taft€Youth€Center.€€While€Pectol€could€not€recall€whether€he€hadÏwritten€to€the€defendant€about€the€state's€offer€of€plea€bargain,€it€was€his€recollectionÏthat€he€made€the€offer€by€telephone€and€talked€in€person€to€the€petitioner€before€theÏplea€was€entered.€€Pectol€insisted€that€he€discussed€with€the€petitioner€the€waiver€ofÏa€jury€trial€and€other€of€the€petitioner's€constitutional€rights.€€He€claimed€that€heÏadvised€the€petitioner€of€the€controlling€case€law€at€the€time,€the€possibility€ofÏconsecutive€sentences,€and€the€opportunities€for€parole.€€Pectol€contended€that€heÏexplained€to€the€petitioner€the€right€to€a€grand€jury€proceeding€and€the€alternative€ofÏproceeding€through€criminal€information.€€He€testified€that€the€petitioner€was€fullyÏaware€of€the€nature€of€the€guilty€plea€and€believed€the€plea€bargain€to€be€favorable,Ïespecially€because€the€ten„year€sentence€in€Bledsoe€County€was€to€be€concurrentlyÏserved€with€the€Bradley€County€sentence.€€Pectol€denied€ever€having€coerced€theÏpetitioner€to€accept€the€offer.ÌÌà Ðñóñ›ñóñYouth€Center.›€€He€claimed€that€he€sought€assistance€from€the€petitioner'sÏgrandmother€prior€to€the€transfer€hearing.€€Pectol€investigated€to€the€extent€ofÏlearning€that€the€state€claimed€to€have€a€witness€in€addition€to€the€victim€who€wouldÏtestify€to€the€petitioner's€participation€in€the€assault.€€Pectol€described€the€petitionerÏas€familiar€with€the€criminal€justice€process€and€extraordinarily€street„wise.ÌÌà àThe€petitioner,€who€had€an€eighth„grade€education,€testified€that€heÏhad€been€denied€parole€on€three€prior€occasions€since€his€conviction.€€He€claimedÏthat€he€was€under€the€impression€that€he€would€receive€a€three„year€sentence€underÏthe€plea€agreement€and€has€denied€that€his€trial€counsel€had€ever€providedÏinformation€on€the€possibilities€of€parole.€€The€petitioner€testified€that€his€trialÏcounsel€never€visited€at€the€prison,€never€interviewed€any€of€the€witnesses€provided,Ïand€never€discussed€the€nature€of€an€indictment,€the€statutory€elements€of€theÏcrime,€or€his€right€to€a€jury€trial.€€ÌÌà Œ àà ä àñëñAt›€the€Post„Conviction€hearing€in€this€matter,€bothÏthe€Petitioner€and€his€counsel€testified.€€It€is€clear€fromÏthe€proof€that€Mr.€Pectol€was€fully€aware€of€the€state'sÏcase€against€his€client€and€realized€that€his€client's€bestÏavenue€was€to€try€to€obtain€the€most€favorable€pleaÏagreement€that€he€could€rather€than€risk€a€conviction€ofÏthe€Class€A€Felony€of€Attempted€First€Degree€Murder.€€Ð
