AssistantDistrictAttorneyGeneral      14thJudicialDistrict      307SouthWoodland̀      P.O.Box147      Manchester,TN37349OPINIONFILED_______________________AFFIRMEDPURSUANTTORULE20DAVIDG.HAYES,JUDGE    @ OPINION   Theappellant,DeborahJoRovsek,appealsasofrightfromthetrialcourtsrevocationofherprobationsentence.Shecontendsthatthetrialcourtabuseditsdiscretionbyrevokingherprobationandorderinghertoservetheentiresentencepreviouslyimposed.Theappellantcontendsthatthetrialcourtshouldhaveconsidered aperiodofshockincarcerationfollowedbyCommunityCorrections.Basedonourreviewofthebriefsandoftheentirerecordinthiscause,weconcludethatthisisanappropriatecaseforaffirmanceunderRule20,TennesseeCourtofCriminalAppealsRules.̀  InMarchof1996,theappellantpledguiltytoeightcountsofobtainingacontrolledsubstancebyfraud.ShewassentencedasaRangeI,StandardOffender,toaneffectivesentenceoffouryearstobeservedonprobation.Theappellantwasgivencreditfor74daysservedinjail.Asaconditionofprobation,theappellantwasorderedtocomplete300hoursofpublicservicework.  Subsequently,onFebruary11,1997,aprobationviolationreportwasfiled,allegingthattheappellantfailedtoreporttoherprobationofficerwheninstructedtodoso,failedtopayrequiredprobationfeeswhendue,andfailedtoreporttoherpublicserviceworksiteasscheduled.Thetrialcourtissuedaprobationrevocationwarrantthesameday,andahearingwasheldonJune17,1997.Attherevocationhearing,theappellantpledguiltyandwasallowedtomakeastatementinwhichsheaskedthetrialcourttogiveherasecondchance.Attheconclusionofthehearing,thetrialcourtstated IthinkIhavegivenyoueverybreakIcanpossiblygiveyou.Timeisup.Imsorry.Youaregoingtojail.TheappellantwasorderedtoserveherfouryearsentenceintheDepartmentofCorrection.  Therevocationofprobationiscommittedtothesounddiscretionofthetrialcourt.Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Ifthetrialcourtfindsbyapreponderanceoftheevidencethataprobationviolationhasoccurred,ithastherighttorevokeprobationandcausetheprobationertocommencetheexecutionofjudgmentasoriginallyentered.T.C.A.4035310,311(d).ThisCourtwillnotfindthatatrialcourthasabuseditsdiscretionunlesstherecordcontainsnosubstantialevidencetosupportthetrialcourt'sconclusionthattheprobationshouldberevoked.Statev.Harkins,811S.W.2d79,82(Tenn.Crim.App.1981).Theevidenceattherevocationhearingneedonlyshowthatthetrialcourtexercisedaconscientiousandintelligentjudgmentinmakingthedecisiontorevokeprobation.Statev.Leach,914S.W.2d104,106(Tenn.Crim.App.1995).  Basedontherecordbeforeus,itisclearthatthetrialcourtdidnotabuseitsdiscretioninrevokingtheappellantsprobationandorderinghertoservetheoriginalsentenceincustody.Accordingly,baseduponareadingoftheentirerecord,thebriefsoftheparties,andtheapplicablelaw,thisCourtfindsthatthejudgmentofthetrialcourtshouldbeaffirmedpursuanttoRule20,TennesseeCourtofCriminalAppealsRules.
