OnJanuary15,1992,theDefendantenteredguiltypleastoandwasconvictedofonecountoffelonycocainepossessionandonecountoffelonybailjumping.Hereceivedconcurrentsentencesoffouryearsandoneyear,orderedtobeservedconsecutivelytocertainsentenceshereceivedinFlorida. OnApril27,1995,theDefendantfiledapetitionto setaside,modifyormitigatesentencewhichwasdeniedbythetrialcourtonApril28,1995.OnMay3,1996,theDefendantfiledapetitionforpostconvictionrelieffromtheseconvictions,whichwasdismissedbythetrialcourtonMay14,1996,basedonthestatuteoflimitations. OnJuly8,1996,theDefendantfileda PETITIONFORWRITOFERRORCORAMNOBIS,orinthealternative,APPLICATIONFORWRITOFHABEASCORPUSADSUBJICIENDUMADDUCETESTIFICANDUM.Thetrialjudgetreatedthispetitionasoneforpostconvictionreliefanddismisseditastimebarred.ItisfromthisorderofthetrialcourtthattheDefendantappeals. ThepetitionessentiallyallegesthatDefendantscounselathisguiltypleaproceedingwasineffectivefornottellingtheDefendantthathisTennesseesentencesweretorunconsecutivelytohisFloridasentenceandthathisguiltypleasenteredintheTennesseecaseswerethereforenotknowing,intelligentandvoluntary,becausehewouldnothavepleadedguiltyhadheknownhewastoreceivesentencestobeservedconsecutivelytohisFloridaincarceration. Habeascorpusreliefisavailableonlywhenaconvictingcourtiswithoutjurisdictionorauthoritytosentenceadefendantorwhenthatdefendantstermofimprisonmentorrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993).TheDefendantarguesthathisTennesseesentenceswouldbeexpirediftheyhadbeenorderedtobeservedconcurrentlywithhisFloridasentence.HisargumentgainshimnoreliefbecausehisTennesseesentenceswereclearlyorderedtobeservedconsecutivelytotheFloridaincarceration. Althoughthepetitionallegesgroundsforpostconvictionrelief,thetrialjudgecorrectlydeterminedthatthepetitionwasbarredbythestatuteoflimitations.Tenn.CodeAnn.4030202;seeCarterv.State,__S.W.2d__(Tenn.1997).
