àò òIó óÌÌà àAt€approximately€10:30€p.m.€on€August€17,€1995,€Sullivan€County€DeputyÏMichael€Rutherford€responded€to€a€call€that€an€intoxicated€woman€was€walkingÏdown€Second€Avenue€in€Bristol,€Tennessee.€€The€woman,€Kathy€Elmore,€wasÏwalking€with€two€(2)€young€children€and€was€ð ðvery€belligerentðð€and€ð ðcouldnððtÏstand€up€on€her€feet.ðð€€Rutherford€sent€one€of€the€children€to€find€an€adult€whoÏcould€take€Elmore€home.€€Elmore€persisted€in€yelling€at€Officer€Rutherford€andÏcalling€him€names,€so€Rutherford€handcuffed€Elmore€and€placed€her€underÏarrest€for€public€intoxication.€€Rutherford€called€for€another€patrol€car€to€transportÏElmore€to€jail.Ìà àAfter€several€minutes€passed,€defendant€and€Lloyd€Hall€approached.€ÏDefendant,€who€was€romantically€involved€with€Elmore€at€the€time,€demandedÏto€know€what€was€happening.€€Officer€Rutherford€testified€that€defendant€hadÍbloodshot€eyes€and€appeared€to€be€very€intoxicated€as€well.€€Despite€OfficerÏRutherfordððs€repeated€orders€for€defendant€to€step€away€from€Elmore€and€leaveÏthe€scene,€defendant€refused.€Rutherford€testified,€ð ð[œa]t›€one€point,€he€did€sayÏthat,€that€I€was€not€going€to€take€him,€take€her€to,€to€jail.ðð€€When€the€defendantÏreached€his€hand€out€as€if€to€grab€either€Officer€Rutherford€or€Elmore,€RutherfordÏattempted€to€restrain€defendant.€€Defendant€jerked€away€and€would€not€put€hisÏhands€behind€his€back.€€Rutherford€sprayed€defendant€with€pepper€spray€andÏthe€two€struggled.€€Finally,€Rutherford€was€able€to€hold€defendant€on€the€groundÏwhile€he€waited€for€backup.Ìà àNita€Darlene€Gragg,€a€resident€of€the€neighborhood,€witnessed€theÏincident.€€She€testified€that€defendant€appeared€intoxicated€because€he€wasÏtalking€loudly€and€staggering.€€She€stated€that€Officer€Rutherford€asked€theÏdefendant€to€leave,€but€defendant€continued€to€stand€ð ðin€[Rutherfordððs]€face.ðð€ÏShe€further€testified€that€when€Rutherford€attempted€to€restrain€defendant,Ïdefendant€pulled€away.€€She€stated€that€Rutherford€and€defendant€struggled€forÏseveral€minutes€before€Rutherford€was€able€to€subdue€defendant.Ìà àDefendant€testified€on€his€own€behalf.€€Defendant€testified€that€OfficerÏRutherford€was€ð ðswinging€[Elmore]€aroundðð€when€he€arrived€on€the€scene.€ÏDefendant€stated€he€was€merely€trying€to€calm€Elmore€down.€€Defendant€deniedÏprovoking€the€officer€and€claimed€that€Officer€Rutherford€sprayed€him€ð ðout€of€theÏblue.ðð€€Defendant€denied€having€anything€to€drink€that€night€and€stated€that€heÏdid€not€intend€to€interfere€with€Elmoreððs€arrest,€nor€did€he€intend€to€resist€arrest.Ìà àLloyd€Hall€also€testified€for€the€defense.€€He€testified€that€defendant€didÍnot€appear€to€be€intoxicated€and€spoke€rationally.€€Hall€acknowledged€that,Ïalthough€the€officer€repeatedly€asked€the€defendant€to€back€away€from€him€andÏElmore,€the€defendant€refused.Ìà àDefendant€contends€that€the€evidence€is€insufficient€to€support€hisÏconvictions€for€public€intoxication,€resisting€arrest€and€interfering€with€an€arrest.€ÏWhen€an€accused€challenges€the€sufficiency€of€the€evidence,€this€Court€mustÏreview€the€record€to€determine€if€the€evidence€adduced€during€the€trial€wasÏsufficient€ð ðto€support€the€findings€by€the€trier€of€fact€of€guilt€beyond€a€reasonableÏdoubt.ðð€€Tenn.€R.€App.€P.€13(e).Ìà àò òB.€€Public€Intoxicationó óÌà àPublic€intoxication€is€defined€as€ð ðœappear[ing›]€in€a€public€place€under€theÏinfluence€of€a€controlled€substance€or€any€other€intoxicating€substance€to€theÏdegree€that:€(1)€[œt]he›€offender€may€be€endangered;€(2)€[œt]here›€is€endangermentÏto€other€persons€or€property;€or€(3)€[œt]he›€offender€unreasonably€annoys€peopleÏin€the€vicinity.ðð€€Tenn.€Code€Ann.€ðð€39„17„310(a).Ìà àOfficer€Rutherford€testified€that€defendant€appeared€to€be€intoxicated€andÏhad€bloodshot€eyes.€€Even€though€the€officer€asked€the€defendant€to€leave€theÏscene,€he€persisted€in€standing€close€to€the€officer€in€a€threatening€manner.€ÏGragg€also€testified€that€defendant€appeared€to€be€very€intoxicated,€was€talkingÏloudly€and€staggering.€€She€also€testified€that€defendant€stood€close€to€theÏofficer€despite€the€officerððs€repeated€attempts€to€persuade€the€defendant€toÏleave€him€and€Elmore€alone.Ìà àAlthough€Hall€and€defendant€testified€that€defendant€was€not€intoxicatedÏon€the€date€of€the€incident,€the€trial€court€accredited€the€testimony€of€the€stateððsÏwitnesses€in€this€regard.€€à àQuestions€concerning€the€credibility€of€the€witnesses,Ïthe€weight€and€value€to€be€given€the€evidence€as€well€as€all€factual€issuesÏraised€by€the€evidence€are€resolved€by€the€trier€of€fact,€not€this€Court.€€òòState€v.ÏTuttleóó,€914€S.W.2d€at€932.€€We€find€that€the€evidence€is€sufficient€to€find€theÏdefendant€guilty€of€public€intoxication.Ìà àThis€issue€is€without€merit.Ìà@ àò òC.€€Interfering€With€an€Arrestó óÌà àTenn.€Code€Ann.€ðð€39„16„602(a)€provides€that€it€is€an€offense€toÏð ðintentionally€prevent€or€obstruct€anyone€known€to€the€person€to€be€a€lawÏenforcement€officer€€€.€.€.€from€effecting€œa[n›]€.€.€.€arrest€.€.€.€€of€any€person€.€.€.€byÏusing€force€against€the€law€enforcement€officer.ðð€€When€defendant€arrived€at€theÏscene,€the€officer€informed€him€that€he€was€arresting€Elmore€for€publicÏintoxication.€€Although€the€officer€asked€defendant€to€leave,€defendant€persistedÏin€standing€close€to€the€officer€in€a€threatening€manner.€€Defendant€then€toldÏOfficer€Rutherford€that€he€was€not€going€to€allow€the€officer€to€take€Elmore€to€jailÏand€reached€his€arm€out€as€if€to€grab€Elmore€or€the€officer.€€Although€defendantÏcontends€that€there€is€no€evidence€that€he€used€force€to€prevent€the€officer€fromÏarresting€Elmore,€a€rational€trier€of€fact€could€conclude€otherwise.€€We€find€thatÏthe€evidence€is€sufficient€to€support€defendantððs€conviction€for€interfering€with€anÏarrest.Ìà àThis€issue€has€no€merit.Ìà@ àò òD.€€Resisting€Arrestó óÌà àResisting€arrest€is€defined€as€ð ðintentionally€œprevent[ing›]€or€œobstruct[ing›]Ïanyone€known€to€the€person€to€be€a€law€enforcement€officer,€or€anyone€actingÏin€a€law€enforcement€officer's€presence€and€at€such€officer's€direction,€fromÏeffecting€a€stop,€frisk,€halt,€arrest€or€search€of€any€person,€including€theÏdefendant,€by€using€force€against€the€law€enforcement€officer€or€another.ðð€€Tenn.ÏCode€Ann.€ðð€39„16„602(a).Ìà àIn€the€present€case,€defendant€refused€to€comply€with€the€officerððsÏrequests€to€leave€Elmore€alone.€€When€he€reached€his€arm€out€to€grab€theÏofficer€or€Elmore,€Officer€Rutherford€informed€the€defendant€that€he€was€underÏarrest.€€When€the€officer€tried€to€restrain€defendant,€defendant€tried€to€pull€awayÏfrom€the€officer.€€The€officer€was€forced€to€use€pepper€spray€to€subdue€theÏdefendant,€but€defendant€continued€to€struggle€with€the€officer.Ìà àAlthough€defendant€testified€that€he€did€not€intend€to€resist€arrest,€aÏrational€trier€of€fact€could€conclude€otherwise.€€The€evidence€was€sufficient€toÏsupport€defendantððs€conviction€for€resisting€arrest.Ìà àThis€issue€is€without€merit.ÌÌà@ àò òIIIó óÌÌà
