Afterreview,weaffirm. InApril1993,theappellantpledguiltytoseconddegreemurderandaggravatedrobbery.Pursuanttotheseguiltypleas,thetrialcourtimposedconcurrentsentencesoffortyyearsincarcerationforseconddegreemurderandtwentyyearsincarcerationforaggravatedrobbery.OnApril7,1997,theappellantfiledaprosepetitionseekingpostconvictionrelief.Theappellantspetitionraisedtheclaimsof(1)involuntaryguiltypleaand(2)ineffectiveassistanceofcounsel.OnApril17,1997,theKnoxCountyCriminalCourtsummarilydismissedthepetitionasbeingtimebarred. Atthetimetheappellantsconvictionsbecamefinal,April1993,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).In1995,thelegislaturereducedthestatutoryperiodforfilingpostconvictionpetitionsfromthreeyearstooneyear.Tenn.CodeAnn.4030202(a)(1995Supp.).Asaresult,thenewPostConvictionProcedureActgovernsthispetitionandallpetitionsfiledafterMay10,1995.BecausethepreviousthreeyearstatuteoflimitationshadnotexpiredatthetimethenewActwentintoeffect,hisrighttopetitionforpostconvictionreliefsurvivedunderthenewAct.SeeCarterv.State,952S.W.2d417,420(Tenn.1997).Therefore,theappellanthaduntilMay10,1996,oneyearfromtheeffectivedateofthenewAct,tofileforpostconvictionrelief.CompilersNotes,Tenn.CodeAnn.4030201(1996Supp.);seealsoDanielsv.State,No.03C019606CC00244(Tenn.Crim.App.atKnoxville,Feb.27,1997),perm.toappealdenied(Tenn.Sept.29,1997).Instead,theappellantfiledthispetitionalmost11monthsafterthestatutehadrun.Moreover,thegroundsraisedinthispetitionandonappealdonotfallwithinanyoftheexceptionstothestatuteoflimitationssetoutinTenn.CodeAnn.4030202(b)(1),(2),or(3).Thestatuteoflimitationsonthispetitionhasexpired,requiringadismissaloftheappellantspetitionforpostconvictionrelief.
