Thechargeagainstthepetitionerprovidesthathe didunlawfullyengageinsexualpenetrationwith[thevictim],twelve(12)yearsofage,bymakingthesaid[victim]performfellatioonhiminviolationofT.C.A.392603.InHill,acasedealingwithapost1989criminaloffense,theindictmentallegedmerelythatthedefendanthad unlawfullysexuallypenetrate[d][thevictim]apersonlessthanthirteen(13)yearsofage.ThisCourtfoundthattheuseoftheword unlawfullywasnotsufficienttoallegethedefendantsmensrea,anessentialelementoftheoffense.Accordingly,theindictmentwasfoundfatallydefective.  TheStatecontendsthatHillisinappositetothiscasebecausethepetitionerscrimewascommittedin1987andthereforethestatutesrelieduponinHillhavenoapplication,citingtothisCourtsRule20OrderinGregoryL.Hattonv.State,No.02C019611CC00407,LakeCounty(Tenn.Crim.App.OrderfiledFeb.19,1997,atJackson).Weagree.Thus,aswestatedinthatcase, thedecisioninHilldoesnotcontrolourreviewoftheissueraisedherein.  Atthetimeoftheoffenseinthiscase,aggravatedrapewasdefinedas unlawfulsexualpenetrationofanotheraccompaniedbyanyofthefollowingcircumstancesincludingtheageofthevictimbeinglessthanthirteenyears.T.C.A.392603(a)(4)(1982).Thestatutoryrequirementsforanindictmentallegingthis(oranyother)crimewerefoundinT.C.A.4013202(1982): Theindictmentmuststatethefactsconstitutingtheoffenseinordinaryandconciselanguage,withoutprolixityorrepetition,insuchamannerastoenableapersonofcommonunderstandingtoknowwhatisintended,andwiththatdegreeofcertaintywhichwillenablethecourt,onconviction,topronouncetheproperjudgment.Wethinktheindictmentatissuemeetstheserequirements.  Moreover,evenifHillappliedtotheinstantindictment,wethinktheallegationthatthedefendantcommittedtheoffense bymakingthesaid[victim]performfellatioon[him]issufficienttoallegeanynecessarymensreaelement.Theuseoftheterm makinginthiscontextrendersitequivalentto forcing.Onepersonforcesanothertodosomethingintentionally,deliberatelyand/orknowingly:notaccidentally.Accordingly,thelanguagecontainedintheindictmentwassufficienttoallegeacriminalmensrea.Thisissueiswithoutmerit.  Thepetitioneralsocomplainsthatthecourtbelowerredwhenitdismissedhispetitionsummarily.Itdidnot.Habeascorpusreliefisavailableonlywhenthejudgmentisvoiduponitsfaceorthepetitionerssentencehasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993);Passarellav.State,891S.W.2d619,626(Tenn.Crim.App.1994).Nosuchgroundshavebeendemonstratedhere:the defectaboutwhichthepetitionercomplainsdidnotdivestthetrialcourtofjurisdictionorrenderthesubsequentpostindictmentproceedingsanullity.Nordoesthepetitionsetforthgroundsforreliefunderthepostconvictionact. ,   כTheindictmentchargingthepetitionerwithaggravatedrapewassufficientonwhichtobaseavalidconviction,andnoevidentiaryhearingwasthereforenecessary.Thejudgmentbelowisthereforeaffirmed.Ӝ̛       ______________________________       JOHNH.PEAY,Judge̜CONCUR:̜______________________________DAVIDG.HAYES,Judge̜______________________________WILLIAMM.BARKER,Judge%
