K  Ѐ ` Todefeatthetestimonyofthesethreeeyewitnesses,the[petitioner]relied  uponanalibidefense.Alexander,Martinscompanionwhenhewasshot,testified  hehadmadeeyecontactwiththeshooterandthattheshooterwasalightskinned  blackmale,notadarkskinnedblackmale.Hecouldnotidentifythe[petitioner]as  theshooter. q  Ѐ ` TerryMeesetestifiedthatonDecember13,1995,around3:30p.m.,he C visitedthe[petitioner]athisapartmentandwithinthenexthour,theywenttoa ,| Pharmartconveniencestore,wheretheypurchasedsomesoda.AccordingtoMeese, e theythenreturnedtoMeesesapartment,wheretheywatchedtelevisionthroughout N theearlyeveningandateasupperMeesesgirlfriendprepared.Meesetestifiedthat  7 the[petitioner]thentookashortnapand% W #XgX XOX1&#%W,OX1 XXXgԀlefthisapartmentaround9:15p.m. ! K  Ѐ ` Severalpeopleacquaintedwiththe[petitioner]% b #XgX XOX1A3#%b}9OX1 XXXgԀtestifiedthatthe[petitioner]  didnotappearasifhetookdrugs.The[petitioner]himselftestifiedhewasnota  drugaddictandhadnotbeenusingcrackcocainewithinsixmonthsofthemurder,  althoughhedidadmittousingmarijuanaatleasttwiceaweekduringthattime.He  deniedkillingMartinandtestifiedhewaswithMeesewhentheshootingoccurred. q The[petitioner]alsotestifiedthatonthenightofthemurder,whenDetectiveRoland Z andotherpoliceofficersvisitedhissisterNicolesresidence,hesaidhehadbeenat C herresidencethatevening,buthedidnotindicatehowlonghehadbeenthere.He ,| testifiedthatwhenhetalkedwiththepolicethatevening,ithad slipped[his]mind e hehadbeenwithMeeseatthetimetheshootingoccurredbecause,accordingtothe N [petitioner],hewasdistractedbyhiscuriositywhythepolicewereinterestedin  7 wherehisbrotherLamonthadbeenthatevening.#XgX XOX19# S!     Id.at**29. #"    I.POSTCONVICTIONRELIEFHEARING  t% $     Atthepostconvictionreliefhearing,trialcounselstatedhewasrelievedascounselpriorto G'"& thehearingofthemotionfornewtrial,and,duringthathearing,hetestifiedregardinghis 0(#' effectivenessattrial.Trialcounseltestifiedthatininvestigatingthepetitionerscase,hehireda )i$( criminalinvestigatorwhoaidedinlocatingandobtainingstatementsfromwitnessesandin *R%) investigatingthecrimescene.Trialcounselstatedthepetitionersbrother,whowasapoliceofficer, *;&* alsoaidedintheinvestigation.Trialcounselrecalledthatpriortotrial,thestatepresentedthe +$'+ petitionerwithapleaofferofmanslaughterwitheitheratwoorfouryearsentence.Aftertrial  counselinformedthepetitioneroftheadvantagesofacceptingtheoffer,thepetitionerrejectedthe  offerandcontinuedtomaintainhisinnocence.    Trialcounselrecalledtwoeyewitnessestotheoffenses,VeraThompsonandAngela T _Hornbeck_.TheoffensesoccurredbelowHornbeckssecondfloorapartmentwhichoverlookedthe =  street.TrialcounseltestifiedthatincrossexaminingHornbeckattrial,hefocuseduponher & v identificationofthepetitionerinaphotographiclineupduringwhichHornbeckstatedshewasonly  _ 50%positivethatthepetitionerwastheperpetrator.Trialcounselfurtherstatedhequestioned  H Thompsonattrialregardingherdruguseandhervision,andheobtainedhercriminalrecord.  1    Thetrialcourtappointeddifferentcounseltorepresentthepetitioneratthemotionfornew   trialandonappeal.Appellatecounseltestifiedhereviewedthetrialrecordandchosethoseissues   toappealwhichhebelievedhadmerit.Baseduponthepetitionerssuggestion,appellatecounsel   raisedineffectiveassistanceoftrialcounselasanissueinanamendedmotionfornewtrial. n  Appellatecounselstatedbothheandthepetitioneridentifiedspecificissuesregardingineffective W  assistanceoftrialcounsel. @   Appellatecounseltestifiedthatwhenhefiledthemotionfornewtrial,hewasunawarethat b byraisingineffectiveassistanceoftrialcounsel,thepetitionerwouldbeprecludedfromraisingthe K issueasagroundforpostconvictionrelief.Followingthetrialcourtsdenialofthemotionfornew 4 trial,appellatecounseladvisedthepetitionerthatifheraisedineffectiveassistanceoftrialcounsel  asanissueondirectappeal,hecouldbebarredfromraisingtheclaimduringalaterproceeding. Althoughnotraisedbyeitherpartyinthepresentappeal,weconcludethatpursuanttothe k lawofthecasedoctrine,thepostconvictioncourtproperlydeniedthepetitionerreliefregardinghis T allegationsofineffectiveassistanceoftrialcounsel.Generally,thelawofthecasedoctrineprohibits =  acourtfromreconsideringissueswhichhavebeendecidedinapriorappealofthesamecase.State & v v.Jefferson,31S.W.3d558,56061(Tenn.2000).Thisdoctrineappliestoissueswhichwerebefore  _ theappellatecourtinthefirstappeal,aswellasissueswhichweredecidedbyimplication.Id.at  H 561.Inapriorappealofthepresentcase,thiscourtheldthepetitionersallegationsofineffective  1  assistanceoftrialcounselhadbeenpreviouslydeterminedondirectappealand,thus,couldnotform    thebasisofpostconvictionrelief.SeeJohnEarlScales,2002Tenn.Crim.App.LEXIS721,at*3.   Therefore,thelawofthecasedoctrinebarsreliefonthisissue.     Evenifthelawofthecasedoctrinedoesnotapply,thepetitionerisnotentitledtoreliefon n  thisissue.PursuanttothePostConvictionProcedureAct,agroundforreliefhasbeenpreviously W  determinedif acourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing. @ Tenn.CodeAnn.4030106(h)(2003).Furthermore, [a]fullandfairhearinghasoccurredwhere )y thepetitionerisaffordedtheopportunitytocallwitnessesandotherwisepresentevidence,regardless b ofwhetherthepetitioneractuallyintroducedanyevidence.Id.Therecordrevealsthatthe K petitionerallegedvariousclaimsofineffectiveassistanceoftrialcounselinhisamendedmotionfor 4 newtrialandpresentedevidencerelatedtotheseclaimsduringthehearing. H'"&   Theonlyevidencepresentedatthepostconvictionreliefhearingregardingthisissuewas )j$( appellatecounselstestimonythatthetwostatementsappearedtobehearsayandthathedidnot *S%) raisetrialcounselsfailuretoobjectattrialasgroundsforineffectiveassistanceoftrialcounsel. *<&* Thepostconvictioncourtfoundthepetitionerdidnotestablishprejudice.Baseduponother +%'+ evidenceidentifyingthepetitionerastheshooter,weagreethepetitionerhasnotshownthathe  wouldhavereceivedreliefhadappellatecounselraisedthisissue.Thus,thepetitionerhasfailed  toestablishprejudice.    3.ClaimsofInnocence  T     Thepetitionercontendsappellatecounselwasineffectiveinfailingtoinvestigateandpresent ' w evidencesupportinghis claimsoffactualinnocenceandinfailingtochallengesufficiencyofthe  ` evidenceondirectappeal.Thepetitionersubmitsbothtrialcounselandappellatecounselfailedto  I interviewMichaelThompson,VeraThompsonsson,andfailedtoinvestigateinformationinVera  2  Thompsonsinitialstatementtothepoliceinwhichsheidentified Michaelasthepersonwho    attemptedtorobher.Wedisagreewiththeseassertions.
