TheSumnerCountyGrandJuryreturnedanindictmentagainstthedefendantandGonzalez \ ontwocountsoftheftover$10,000.00,aClassCfelony.SeeTenn.CodeAnn.3914103,105. H Thepleaagreementprovidedthatthedefendantswouldpleadguiltytotwocountsoftheftover 4 $1,000.00andreceiveaconcurrentfouryearsentenceoneachcount,witha12monthjail  p maximum.ThedefendantandGonzalezagreedtobejointlyandseverallyliableforrestitutionin  \ theamountof$3,863.10.
