TheanalysisofTenn.CodeAnn.5550408issimplefrommyperspective.Aviolationofthisstatuterequires abloodalcoholconcentrationofpointzerofour(.04)ormore...Weshouldlooktothestatuteitselfandrely,whenpossible,upontheordinarymeaningofitslanguageandtermsused,refrainingfromanyforcedorsubtleconstructiontolimitorextendthestatutesmeaning.Statev.Smith,893S.W.2d908,917(Tenn.1994),cert.denied116S.Ct.99,133L.Ed.2d53(1995). ThestatesexpertwitnesstestifiedthattheacceptabletoleranceoftheIntoximeter3000isplusorminus.005.Therefore,asJudgeWoodallcorrectlyconcedes,a.04readingcouldresultfromanactualbloodalcoholconcentration7 XdXXd7rangingfrom.035to.054. (   ׀Inotherwords,thereisatwentyfivepercent(25%)statisticalchancethisdefendanthadanactualbloodalcoholconcentrationbelow.04.Tome,.04means.04andnot.039orbelow.Consideringthetolerance,itissimplyimpossibletoconcludebeyondareasonabledoubtthatthedefendanthadanactualbloodalcoholconcentrationof.04ormore. Thisscenarioisnodifferentthanplacingtwenty(20)peopleinaroom,fifteen(15)ofwhomarenamed Johnandfive(5)ofwhomarenamed Joe.Arandomselectionofoneofthosepersonscouldnotestablishbeyondareasonabledoubtthatsuchpersonsnameis Johnsimplybecausethereisaseventyfivepercent(75%)statisticalprobabilitythathisnameis John. Reasonabledoubtissimplynotsubjecttosuchamathematicalanalysis. TheconcurringopinionconcludesthatevidencethatdefendanthadacoupleoftallbeersinGeorgiaseveralhoursearlier,smelledofalcoholuponhisarrestinCoffeeCounty,andwasproperlyadministeredtheintoximetertest,coupledwiththereadingof.04,issufficienttoestablishbeyondareasonabledoubtthatthedefendanthadanactualbloodalcoholconcentrationof.04ormore.Iamunabletomakesuchaleap.Therecorddoesnotsuggestthatsuchfactsmakethedefendantanymoreorlesslikelytohaveareadingof.04ormoreasopposedto.039orless.
